Hey Jeff, thanks for the info below. With that information from USDA & NRCS, you should be able to pursuade the Soil &
Water Conservation District folks to sign a letter stating that they will not pursue any maintenance on this canal adjacent
to Mr. Ham’s property where it affects your bank. It is the letter from them that you ultimately need.

The email From Mr Kirby , Greene/Lenior Soil Water Conservation District, is in reference to the
LaGrange Phase I and II canal in question. NO RECORDS OF A SOIL AND WATER
CONSERVATION EASEMENT CAN BE FOUND... GES also has reviewed the Ham Farm LLC
property's recorded deed as part of the first project purchase.. The Lenoir County Records Office
shows no Consevation Easements on the property except the easement recorded by GES for the
phase one LaGrange project.. I have asked Danny Grant ,who surveyed the project, to also comment
on his finding as our professionally survey expert.. NOTE his signed /sealed maps make no reference
to any easements on the land in question.. Your comments are welcome.. Also I have a question..

Per the request of Jeff Becker, A visual siting was conducted on the farm by NRCS on 5/01/2014. The canal
that flows into Meeting House Branch in Lenoir County appears to have no record of an easement held by the
Lenoir SWCD or by USDA / NRCS. No records were found verifying an easement in the Lenoir SWCD files.
As discussed by phone on 5/19/2014, I recommend that the deed be searched by a qualified professional
verifying that no other agency, entity, or individual has an easement on this property.
