Subject: NPDES Permit Modification Contested Case Resolution OAH Case# 10 EHR 6336 Permit# NC0004375 Clariant Corporation Mecklenburg County The Division of Water Qualifr issued the subject permit on September 9, 2010, which was subsequently contested by Clariant Corporation du to concerns associated with a new mercury effluent limit of 12 ng/l. This limit was based on the statewide 30 ( d) impaired waterbody listing for mercury, which negates the use of dilution when developing mercury limits Pursuant to the Stipulation of Agreement and Joint Motion to Stay Proceedings (dated December 16, 2010), Cl 'ant conducted a six-month sampling program for mercury in the Catawba River upstream of Clariant's o tfall. These samples show that the upstream surface water is below the water quality standard and therefore d' ution can be considered. In addition, a review of ambient fish tissue data collected from Lake Wylie does not s ow high mercury concentrations. Based on the Division's review of this surface water data, a revised reason le potential analysis using full s7Q10 dilution indicates the need for a mercury limit of 629 ng/1. However, Qlariant responded that they would be willing to accept a mass -based effluent limit of 0.0004 lbs/day (which equates to the 12 ng/1 water quality standard x permitted flow of 3.9 MGD). 1 In summary, this permit modification, effective September 17, 2011, contains the following significant cha tiges from your current permit: • Effluent Sheet A (1). The Division of Water Quality issued the subject permit on September 9, 2010, which was subsequently contested by Clariant Corporation due to concerns associated with a new mercury effluent limit of 12 ng/1. This new limit was based on the water quality standard (12 ng/1) applied end of pipe, based on reasonable potential using no dilution (since all surface waters in NC are currently listed as impaired). 2. Pursuant to the Stipulation of Agreement and Joint Motion to Stay Proceedings dated December 16, 2010 (Attached), the mercury limit was stayed and Clariant conducted a six- month surface water sampling program for mercury in the Catawba River upstream of Clariant's outfall. This surface water data (Attached) indicates that the receiving stream is not at assimilative capacity, as upstream surface water mercury values only ranged from < 0.5 ng/1 to 3.02 ng/1 (n= 12 samples, average = 0.66 ng/1). A revised reasonable potential analysis indicates the need for a water -quality based effluent limit of 629 ug/1, assuming a background concentration of 0.66 ng/1. 3. The Division reviewed historical fish tissue data collected in Catawba River (Lake Wylie) via our ambient monitoring program (Attached), and there is no evidence of mercury impairment in fish tissue (n= 51 samples, all < 0.3 mg/kg). tact `-Ii t \ )! Clariant discharges to Catawba River (Lake Wylie) with good dilution (IWC= 1.8%, Dilution= 56:1). In 2010 permit renewal, Sergei added Hg limit (12/12) based on RPA (and no dilution based on EPA position on statewide listing). Facility contested Final Permit, and we stayed mercury limit and entered settlement agreement. Based on a few similar situations that EPA approved, the facility proceeded to collect upstream surface water to determine if surface water exceeds standard (12 ng/l). Facility collected bi-monthly upstream samples between Nov 2010 and April 2011 (n= 12), with 1 value= 3 ng/I and the remaining samples below 1 ng/I. Previously, we would redo RPA at this point, since surface water is not impaired. However, I additionally checked for fish tissue data collected by our Environmental Sciences Section (attached). For one station in Lake Wylie, there were no individual fish samples (n= 51) that exceeded the EPA mercury tissue criteria of 0.3 mg/kg. There was also an upstream station in Catawba River (Mountain Island Lake) that showed no tissue exceedances (n= 40 individual fish samples). Based on this data, it does not appear that surface water or fish tissue exceeds applicable criteria, and the statewide mercury listing is not validated. I'll need to discuss possible resolution at some point. Under settlement terms, mercury limit is stayed until 9/16/2011. As indicated by the enclosed results, the in -stream mercury concentrations in the receiving waters for the Facility's NPDES discharge are far less than 12 nanograms per liter ("ng/1"), ranging from below detection to 3.02 ng/l. Therefore, Clariant requests that, as required by the Agreement, the Division of Water Quality ("DWQ") (i) develop a new NPDES permit effluent limitation for mercury based on the results of the sampling and analysis conducted by Clariant (the "Modified Mercury Limit") and (ii) modify NPDES Permit No. NC0004375 for the Facility to replace the current mercury limit of 12 ng/1 with the Modified Mercury Limit. Based on the sampling results, and other relevant data such as the permitted flow of the Facility's wastewater treatment plant and the flow of the Catawba River at the Facility, and using DWQ's methodology for establishing effluent limitations, we estimate that a limit of 500 ng/l would be protective of the water quality standard for mercury in the river. However, Clariant is prepared to accept a substantially lower limit than that. Based on our historic discharge data, we believe it is unlikely that we will exceed a limit of 50 ng/l. Instead of a concentration limit, we request a mass limit since our peak flow in recent years is far below our permitted flow. The Parties hereby stipulate and agree as follows: 1. On September 9, 2010, DWQ issued National Pollutant Discharge Elimination Permit No. NC0004375 (the "Permit") to Clariant for its Mt. Holly East Facility. 2. Clariant has instituted Contested Case No. 10 EHR 6336 (the "Contested Case") in the Office of Administrative Hearings ("OAH") challenging the effluent limitation for mercury of 12 nanograms per liter ("ng/L") contained in Permit (the "Current Mercury Limit"). 3. DWQ has allowed other dischargers to demonstrate through in -stream sampling that mercury concentrations in the receiving streams to which they discharge are below the state water quality standard of 12 ng/L so that an effluent limitation for mercury of greater than 12 ng/L can be developed and included in their permits. The Parties now wish to use a similar sampling procedure in an attempt to resolve all matters in controversy between them relating to the Permit without the necessity of further litigation in the Contested Case. 5. In order to utilize the procedure described above, it is necessary to stay all proceedings in this Contested Case for a period of nine (9) months. 6. Clariant shall conduct upstream sampling for mercury using EPA method 1631E twice a month for six months at the upstream sampling location specified in the Permit. If the results of such sampling are above 12 ng/L for the first three months, Clariant may terminate the sampling and agree to accept the Current Mercury Limit and dismiss the Contested Case. 7. If Clariant documents that in -stream mercury concentrations are less than 12 ng/L, DWQ shall develop a new effluent limitation for mercury based on the results of the sampling and analysis conducted by Clariant ("Modified Mercury Limit") and shall modify the Permit to replace the Current Mercury Limit with the Modified Mercury Limit. Within thirty (30) days of receipt of the modified permit, Clariant shall either (i) dismiss the Contested Case with prejudice if it is satisfied with the Modified Mercury Limit, or (ii) dismiss the Contested Case without prejudice to instituting a new contested case to challenge the Modified Mercury Limit. 8. If DWQ does not modify the Permit to replace the Current Permit Limit with a Modified Mercury Limit, Clariant may resume prosecution of this Contested Case upon expiration of any stay granted by the Court. 9. With the exception of the Current Mercury Limit, the Permit shall otherwise become effective, with an effective date of December 1, 2010. The Current Mercury Limit shall continue to be stayed until the Contested Case is dismissed or a final decision adverse to Clariant is rendered in the Contested Case. 2 1 10. This Stipulation shall be final and binding upon the Parties, and their successors, assigns, parents, affiliates and subsidiaries, upon execution by the undersigned, who represent and warrant that they are authorized to enter into this Stipulation on behalf of the parties hereto. WHEREFORE, the Parties respectfully request that the Court: 1. Issue an order staying the proceedings in the Contested Case and all schedules and dates therein (i.e., discovery deadlines, hearing date, etc.) through and including September 16, 2011, to allow the Parties to take the actions agreed to herein, which the Parties expect will lead to settlement and dismissal of this Contested Case; and 2. I was waiting to get direction from my client and then got caught up in other matters. However, I now to have a proposal for resolving this matter that may not require a meeting. That proposal is based on my understanding from Tom that other dischargers have been allowed to demonstrate through monitoring that mercury concentrations in the receiving streams to which they discharge are below the state water quality standard of 12 ppt so that an effluent limitation of greater than 12 ppt can be developed and included their permits. My client proposes to do upstream sampling for mercury using EPA method 1631E twice a month for six months. (If results are above 12 ppt for the first three months, we would have the right to terminate the testing.) If we document that in -stream concentrations are less than 12 ppt, DWQ would agree to calculate a new effluent limitation for mercury based on the monitored in -stream concentration and to modify the permit to include that number. We need to structure a settlement agreement that stays the new limit until after this process has been concluded, but we are fine with the rest of the permit going into effect, subject to a couple of technical errors in the permit that we have discovered being corrected. Clariant Corporation is hereby authorized to: 1. Continue operation of a 3.9 MGD wastewater treatment plant consisting of the following treatment units: • Two stormwater equalization basins for non-alldaline wastewater; • Two stormwater equalization basins for alkaline wastewater; • Two acid neutralization tanks; • One lime slurry tank; • Two primary clarifiers; a One wastewater equalization basin; ® One aeration basin with mechanical aeration; • Two secondary clarifiers; ® Two polishing ponds; • Staged discharge facility including effluent holding basin and post aeration; • Two sludge holding tanks; and m Two sludge dewatering belt presses. This facility is located at the Mt. Holly East facility off NC Highway 27 northwest of Charlotte in Mecklenburg County. 2. Discharge treated centralized waste treatment (CWT) and non -categorical industrial process wastewaters from said facility at the location specified on the attached map through outfall 001 into the Catawba River, classified WS-IV CA waters in the Catawba River Basin. 2 A. (1) FFLUENT LIMITATIONS AND MONITORING REQUIREMENTS During the period beginning on the effective date of the permit and lasting until the addition of future wastewater sources or expiration, the Permittee is authorized to discharge treated CWT and non -categorical industrial process wastewater from outfall 001. There shall be no discharge of floating solids or visible foam in other than trace amounts. 3 When an approved analytical protocol with the appropriate minimum detection level is followed and a result of "non -detectable" or "below quantitation limit" is obtained, the permittee will be considered to be in compliance with the numerical permit limit for that pollutant. After four consecutive quarterly samples resulting in non -detection are achieved, the monitoring frequency will revert to annually. When an approved analytical protocol with the appropriate minimum detection level is followed and a result of "non - detectable" or "below quantitation limit" is obtained, the permittee will be considered to be in compliance with the numerical permit limit for that pollutant. A. (3) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodetphnia dubia at an effluent concentration of 1.8%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Cetiodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the month. of March, June, September, and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods arc specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: 4 Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be fled with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test fonn indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be • required during the following month. " Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require uninediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A. (4) TOTAL PHOSPHORUS AND TOTAL NITROGEN MONITORING The Pennittee shall calculate a 12-month rolling average mass loading as the sum of monthly loadings, according to the following equations: (1) Monthly Average (pounds/day) = TP x Qom, x 8.34 where: TP = the arithmetic average of total phosphorus concentrations (mg/L) obtained via composite samples (either daily, weekly, or monthly average values) collected during the month Qw = the average daily waste flow (MGD) for the month 8.34 =conversion factor, from (mg/L x MGD) to pounds The 12-month rolling average mass loading is defined as the sum of the monthly average loadings for the previous 12 months inclusive of the reporting month: 5 (2) i? 12-Month Average Mass Loading (pounds/day)= > TPma = 12 (inclusive of reporting month) Where: TPma = the total phosphorus monthly average mass loading (calculated above). Total Nitrogen is to be calculated using the same method. The monthly average and 12-month average mass loadings shall be reported on the attached worksheet and submitted with the discharge monitoring report for Clariant Corporation. The fist worksheet is due with the discharge monitoring report, 12 months from the effective date of the total phosphorus and total nitrogen limits. In the interim period between the effective date and the requirement to submit the attached worksheet, the total phosphorus and total nitrogen monthly average mass loadings should be reported on the discharge monitoring report for the respective facility. The Permittee shall report the total phosphorus and total nitrogen concentrations for each sample on the discharge monitoring report. Reporting of and compliance with the phosphorus and nitrogen limits shall be done on a monthly basis. A. (5) STAGING REQUIREMENTS (APPLICABLE APRIL 1— OCTOBER 31) The operating day runs froi,i 7:00 am to 7:00 am. Each day, the permittee will calculate a running daily average stream flow as determined by turbine • operation at Mountain Island Dam, leakage at the dam (80 cfs), and the 7Q1O'flow of Dutchman's Creek (15 cfs). Effluent release is to be controlled such that projected release of BOD and ammonia, using the most recent analytical values for these parameters, will not exceed the value given in the following formulas: (1) When the daily river flow is calculated to be < or = 175 cfs: BODS + 0.54(NH3 N) <=566.4 pounds/day (2) When daily average river flow is calculated to be >175 cfs but < or = 250 cfs: BODS + 0.54(NH3-N) <=1044 pounds/day The attached additional DMR sheet (see next page) shall be used to monitor compliance with BOD and NH3 staging requirements during the summer (April 1 — October 31) 6
