Holly East Plant Mecklenburg County Dear Mr. Sanderson: Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or as subsequently amended.) Clariant Corporation should be aware that the Division will re-evaluate the justification for the entire 3.9 MGD flow requirement upon the next renewal of this permit in 2005. The following modifications from the draft permit previously sent to you have been included in this final permit: • Facility information on the map has been corrected to show the U.S.G.S. Quad # as F14SE and the stream classification as WS-IV CA. • There is a modification in the footnotes of Section A. (6) Effluent Pollutant Scan. Two copies of the test result report, DMR-PPA1, shall be submitted along with the DMR forms to the Division's Central Files. A copy of the form is attached to the permit. These conditions from the draft permit remain in the final permit. • Effluent limitations for BOD and Total Suspended Solids have been modified based on the revision of waste flows used for development of the allocations for OCPSF, non -categorical and centralized waste treatment waste streams. Effluent limitations have been reduced due to a smaller flow (not design capacity) being used for allocation development. The application support document submitted by Clariant describes the allocation process. • Tiered limitations have been placed in the permit. Tier 1 limits are effective for existing wastewater sources. Tier 2 limits become effective when any additional wastewater sources are added. Special condition A. (7) requires that Clariant notify the Division at least fourteen days prior to the addition of any new wastewater sources. • The effluent limitation for NH3 as N has been revised slightly downward to a mass -based limit of 618 pounds/day (monthly average) and 927 pounds/day (daily maximum). The reduction was based on the results of reasonable potential analyses that indicated that the relevant NC water quality standards would not be violated by the effluent discharge. A limitation is not required for these parameters but due to the nature of the discharge, effluent monitoring is still required. • Monthly monitoring for chromium and zinc has been added to the permit based on new wastewater streams from Seaboard Container Cleaning and SCR -Tech. • Effluent limitations for total nitrogen and total phosphorus have been added to the permit based on the Catawba River Basin Management Plan for nutrient protection in the Lake Wylie watershed. These are interim limits based on current information from the facility. A nutrient worksheet is attached for recording the monthly average total nitrogen and total phosphorus data to be submitted to DWQ. • A special condition has been added to the permit that will require Clariant to conduct a BAT study for the development of more accurate nutrient limits in 2003. • Mercury continues to be a water quality concern throughout North Carolina. NPDES permittees have worked with the State to reduce potential risks from this pollutant, including tasks associated with collecting and reporting more accurate data. The most commonly used laboratory analysis (EPA Method 245.1) has a detection limit of 0.2 µg/L while the current water quality standard is an order of magnitude lower at 0.012 µg/L. A more recently approved analytical test (EPA Method 1631) should produce a detection limit below the level of the standard. This will allow the Division to assess potential water quality impacts from discharges more accurately. Therefore, beginning on or before September 1. 2003, you will be required to begin using EPA Method 1631 when analyzing for mercury. Please note that mercury shall be measured as a grab sample. • Instream monitoring for BODS and NH3 have been deleted based on review of data, showing no impact on water quality in the Catawba River. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699- 6714. Unless such a demand is made, this permit shall be final and binding. This permit is not transferable. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits may be required. After four consecutive quarterly samples resulting in non -detection are achieved, the monitoring frequency will revert to annually. When an approved analytical protocol with the appropriate minimum detection level is followed and a result of "non - detectable" or "below quantitation limit" is obtained, the permittee will be considered to be in compliance with the numerical permit limit for that pollutant. A. (3) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 1.8%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of March June September and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control -organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A. (4) TOTAL PHOSPHORUS AND TOTAL NITROGEN MONITORING The Permittee shall calculate a 12-month rolling average mass loading as the sum of monthly loadings, according to the following equations: (1) Monthly Average (pounds/day) = TP x Qw x 8.34 where: TP = the arithmetic average of total phosphorus concentrations (mg/L) obtained via composite samples (either daily, weekly, or monthly average values) collected during the month Qw = the average daily waste flow (MGD) for the month 8.34 =conversion factor, from (mg/L x MGD) to pounds The 12-month rolling average mass loading is defined as the sum of the monthly average Loadings for the previous 12 months inclusive of the reporting month: 12 (2) 12-Month Mass Loading (pounds/day)= ETPma =12 (inclusive of reporting month) Where: TPma = the total phosphorus monthly average mass loading (calculated above). Total Nitrogen is to be calculated using the same method. The monthly average and 12-month average mass loadings shall be reported on the attached worksheet and submitted with the discharge monitoring report for Clariant Corporation. The first worksheet is due with the discharge monitoring report, 12 months from the effective date of the total phosphorus and total nitrogen limits. In the interim period between the effective date and the requirement to submit the attached worksheet, the total phosphorus and total nitrogen monthly average mass loadings should be reported on the discharge monitoring report for the respective facility. The Permittee shall report the total phosphorus and total nitrogen concentrations for each sample on the discharge monitoring report. Reporting of and compliance with the phosphorus and nitrogen limits shall be done on a monthly basis. 11 ti Permit NC0004375 A. (4) TOTAL PHOSPHORUS AND TOTAL NITROGEN MONITORING (continued) The permittee shall be required to perform a study which determines monthly average limits for total phosphorus (TP) and total nitrogen (TN) which can be met through the application of best available technology (BAT) that is economically achievable. The study shall be based on 12 months of effluent monitoring data collected from January 1, 2003 to December 31, 2003. The BAT study report shall be submitted to the NCDWQ for approval by July 1, 2004 and the division will apply BAT limits for TP and TN to the permittee's discharge based on the results of this study and the performance of other similar plants. The TP and TN limitations shown in A. (1) are interim limits which shall remain in effect until the BAT study is completed and BAT limits for TP and TN are established by the Division. A. (5) STAGING REQUIREMENTS (APPLICABLE APRIL 1— OCTOBER 31) The operating day runs from 7:00 am to 7:00 am. Each day, the permittee will calculate a running daily average stream flow as determined by turbine operation at Mountain Island Dam, leakage at the dam (80 cfs), and the 7Q10 flow of Dutchman's Creek (15 cfs). Updating the Tier 2 effluent limitations in the information database will be addressed upon receipt. 11/20/2002 Notes to Clariant File: 1. The special staging requirement for discharge. A research of the Clariant file found a 12/5/96 memo from the DWQ Instream Assessment Unit (IAU) addressing Clariant's 1998 challenge of several conditions found in the permit. IAU concurred that the staging requirement was not consistent with the BOD5 and NH3 effluent limits in the permit, and that because of the lower BOD5 limit there should be a modification. The response memo states that "The case scenario where the river flow is greater than 175 cfs and less than 250 cfs is no longer necessary because the combination of the revised BOD5 and NH3 limits would be much lower than the allowable 1044 lb/day. Since the new guidelines or limits are low, the equation is only needed when the river flow is less than or equal to 175 cfs." With the current renewal, a review of instream DO data for the past three years showed no violations of the 5 mg/1 DO standard downstream of the Clariant facility. It would not appear that an effluent DO limit is necessary. e. You are correct that Hg should be sampled as a grab instead of composite. A letter to the facility about the new method 1631 will clarify this and it will be corrected in the final permit. f. According to 15A NCAC 2B. 0505(c)(3)(C), chlorides is not one of the parameters listed that should be grab sample. It is not a volatile and should be sampled as composite. g. Clariant has agreed to the addition of a condition/permit language that they will notify DWQ at least 14 days prior to the addition of any new waste source to the treatment facility. Holly East Plant) in the Northwest portion of Mecklenburg County. Wastewater from the facility is treated in an on -site wastewater treatment plant (WWTP) and discharged to the Catawba River under NPDES Permit No. NC0004375. The permit allows a discharge of up to 3.9 MGD of treated industrial wastewater through one outfall (001). Clariant has submitted an application for renewal of this NPDES permit. The NPDES Unit has reviewed the application, correspondence files, discharge monitoring reports, permit files, instream data and other pertinent data in developing this permit. This fact sheet summarizes the rationale used to determine permit limits and conditions. Wastewater from the Clariant Corporation facility is treated in the on -site WWTP. The treatment plant is comprised of the following treatment units: • Two separate sewer systems, acid sewer and alkaline sewer. • Acid sewer lift station pumps. • Alkaline sewer lift station pumps. • 2.5 MG lined equalization basins for non -alkaline wastewater. • 3.5 MG lined equalization basins for alkaline sewer wastewater. • Two pH neutralization tanks with lime slurry addition. • Two primary clarifiers. • One 4.5 MG equalization basin with mixers and aerators. • One 2.5 MG activated sludge aeration basin with jet mixing and aerators. • Two secondary clarifiers. The last wasteload allocation was conducted in 1991. Since that time, there have been changes that would dictate a reevaluation of the wasteload allocation. The facility's existing permit incorporates water quality based limits for ammonia, acenaphthene, acenaphthylene, anthracene, benzo(a)anthracene, 3,4-benzofluoranthene, benzo(k)fluoranthene, benzo(a)pyrene, chrysene, fluorene, naphthalene, phenanthrene and pyrene. Monitoring is also performed on various other parameters including dissolved oxygen, fecal coliform, total nitrogen, total phosphorus, total phenols, total sulfate, chemical oxygen demand, methylene blue active substances, iron, chlorides and mercury. The existing permit also includes limits for a variety of organic chemicals as required by the US EPA for OCPSF categorical dischargers. Although changes are planned for the site manufacturing and warehousing operations, the wastewater to be produced is compatible with existing WWTP design. Clariant is converting the underutilized portions of the Clariant-Mt. Holly East facility into an industrial park, as space becomes available. Wastewater present or planned for immediate inclusion are from the following industrial categories of the US EPA Effluent Guidelines and Standards: • Organic Chemicals, Plastics and Synthetic Fibers (OCPSF) (40 CFR Part 414); • Centralized Waste Treatment (CWT) Point Source (40 CFR Part 437); and • Non -categorical industrial wastewaters. Discharge Monitoring Report Data Review According to the self -monitoring data, the facility is achieving compliance with the current permit limits. Current Stream Conditions The Catawba River flows from western North Carolina into Lake Wylie. The Catawba River is in the Catawba River drainage area. The Catawba River is classified as a class WS-IV CA water in the Catawba River Basin (North Carolina's classification system), which means it is a protected water supply and is designated for drinking water. The Catawba River is not listed as an impaired water according to North Carolina's draft 2000 303(d) list. Fact Sheet NPDES Renewal Page 2 G Instream Monitoring Clariant conducts monitoring of the Catawba River, both upstream and downstream of the WWTP discharge. Analysis of approximately 3 years of instream data (1989 - 2002), shows no violations of North Carolina's dissolved oxygen standard. Fact Sheet NPDES Renewal Page 3 Compliance Summary Staff Reports indicate that the facility is well maintained and operated. The Clariant Corporation WWTP has a very good compliance record. Over the past three years, the facility had no violations of monthly average limits. Toxicity Testing Current Requirement: Chronic toxicity limit monitored quarterly @ 1.8%. The facility has a good toxicity compliance record over the past six years. Recommended Requirement: Chronic toxicity limit monitored quarterly @ 1.8%. Toxicant Analysis Using the self monitoring data required per the NPDES permit and the approved Long Term Monitoring Plan, reasonable potential analysis' were conducted on the following toxicants: iron, manganese, chloride, mercury, total phenols and total sulfate. The standards used for the analysis are consistent with the standards for a class WS-IV stream. Refer to the proposed changes section to see results. Fact Sheet NPDES Renewal Page 4 tr Proposed Changes Since Clariant is developing the facility as an industrial park for compatible industrial operations, future wastewater sources will occur. In order to account for these future wastewater sources in the permit effluent limits, a tiered approach to developing the limits was used. The proposed limits for both conventional and non -conventional parameters are presented in two tiers, Tier 1 and Tier 2. The Tier 1 limits are based on wastewater flow from existing and planned wastewater sources. The Tier 2 limits are based on wastewater flow not only from existing and planned wastewater sources, but also from future wastewater sources. Tier 2 limits become effective when any new wastewater source, beyond the existing and planned wastewater sources, is added. Most of the NPDES permit limits for the facility have been significantly reduced compared to current limits due to the planned changes at the Clariant facility. The daily maximum limits and monthly maximum limits for the following parameters have been significantly reduced: 5-day biochemical oxygen demand (43% reduction), total suspended solids (44% reduction), ammonia -nitrogen (5% reduction) and fifty-three (53) OCPSF parameters (59 to 81% reduction). The monitoring frequency for total iron, MBAS, manganese, sulfates and chlorides have been reduced from monthly to quarterly based on results of the reasonable potential analysis that indicated that no violation of the water quality standard should occur from the discharge.. Daily maximum limits and monthly average limits for twenty-five (25) CWT parameters have been added. These include limits for the following: total antimony, total arsenic, total barium, total cadmium, total chromium, total cobalt, total copper, total lead, total mercury, total molybdenum, total nickel, total selenium, total silver, total tin, total titanium, total vanadium, total zinc, acetone, acetophenone, aniline, bis(2-ethylhexyl)phthalate, 2-butanone, butylbenzyl phthalate, carbazole, o-cresol, p-cresol, n-decane, 2,3-dschloroaniline, fluoranthene, n- octadecane, phenol, pyridine and 2,4,6-trichlorophenol. The monitoring frequency for OCPSF parameters has been reduced from quarterly to annually. However, should any annual monitoring result in detection of an OCPSF parameter, then quarterly monitoring must be performed until four consecutive quarterly samples result in non - detection. Monthly monitoring for chromium and zinc have been added to the permit based on new wastewater streams from Seaboard Container Cleaning and SCR -Tech that indicate their presence. Annual average effluent limitations for total nitrogen and total phosphorus have added to the permit based on the Catawba River Basin Management Plan for nutrient protection in the Lake Wylie watershed. These are interim limits based on current information from the facility. A special condition has been added to the permit that will require that Clariant will conduct a BAT study for the development of more accurate nutrient limits in 2003. Mercury continues to be a water quality concern throughout North Carolina. Holders of NPDES permits have worked with the state to reduce potential risks from this pollutant, including tasks associated with collecting and reporting more accurate data. The most commonly used laboratory analysis (EPA Method 245.1) has a detection limit of 0.2 ug/L while the current water quality standard is an order of magnitude lower at 0.012 ug/L. A more recently approved analytical test (EPA Method 1631) should produce a detection limit below the level of the standard. This will allow the Division to assess potential water quality impacts from discharges more accurately. Therefore, beginning on or before September 1, 2003, you will be reciuired to begin using EPA Method 1631 when analyzing for mercury. Instream monitoring for GODS and NH3 have been deleted based on review of data, showing no impact on water quality in the Catawba River. Fact Sheet NPDES Renewal Page 5 ADMINISTRATIVE PROCEDURES 15A NCAC 02H .0109 PUBLIC NOTICE (a) Notice of Application (1) Public notice of each complete individual NPDES permit application and each general NPDES permit shall be circulated in the geographical areas of the proposed discharge by the Director at least 45 days prior to any proposed fmal action: (A) by publishing the notice one time in a newspaper having general circulation in said county; and (B) by mailing the notice to all persons or agencies listed in Subsection (c) of this Rule. (2) The notice shall set forth at least the following: (A) name, address, and phone number of the agency issuing the public notice; (B) name and address of each applicant; (C) brief description of each applicant's activities or operations which result in the discharge described in the NPDES application; (D) name of waterway to which each discharge is made and a short description of the location of each discharge on the waterway indicating whether such discharge is a new or an existing discharge; (E) a statement of the tentative determination to issue or deny an NPDES permit for the discharge described in the NPDES application; (F) a brief description of the procedures for the formulation of final determinations, including a 30-day comment period and any other means by which interested persons may influence or comment upon the determinations; and (G) address and phone number of state agency premises at which interested persons may obtain further information, request a copy of the draft permit, request a copy of the fact sheet, and inspect and copy NPDES application forms and related documents. Copies of the fact sheet shall be made available free upon request. Copies of the information on file, other than fact sheets, will be made available upon request and payment of the cost of reproduction. (3) Public notice for those activities covered by Certificates of Coverage issued pursuant to a general permit and Authorizations to Construct shall not be required. (b) Notice of Public Meeting (1) Notice of public meeting on any NPDES permit application shall be circulated in the geographical areas of the proposed discharge by the Director at least 30 days prior to the date of the meeting: (A) by publishing the notice one time in a newspaper having general circulation in said county; (B) by mailing the notice to all persons and government agencies which received a copy of the notice or the fact sheet for the NPDES application; and (C) by mailing the notice to any person or group upon request. (2) The notice of any public meeting shall include at least the following: (A) name, address, and phone number of agency holding the public meeting; (B) name and address of each applicant whose application will be considered at the meeting; (C) name of waterway to which each discharge is made and a short description of the location of each discharge on the waterway; (D) a brief reference to the public notice issued for each NPDES application including identification number and date of issuance; (E) information regarding the time and location for the meeting; (F) the purpose of the meeting; (G) address and phone number of premises at which interested persons may obtain further information, request a copy of each draft NPDES permit, request a copy of each fact sheet, and inspect and copy NPDES forms and related documents; and Fact Sheet NPDES Renewal Page 6 (H) a brief description of the nature of the meeting including the rules and procedures to be followed; The notice shall also state that additional information is on file with the Division of Environmental Management, Department of Environment, Health, and Natural Resources at the Archdale Building at 512 North Salisbury Street, Raleigh, North Carolina, and may be inspected at any time during normal working hours. Copies of the information on file will be made available upon request and payment of cost of reproduction. (c) Mailing Lists. Any person may request to receive copies of all notices required under this Rule and the Director shall mail such notice to any such person. An annual charge of twenty- five dollars ($25.00) may be charged for any person desiring to be placed and maintained on the NPDES Permit mailing list. The Director shall also give notice to the following for NPDES permits: (1) State water pollution control agency for the States of Virginia, South Carolina, Tennessee, and Georgia; (2) Appropriate district engineer, U.S. Army Corps of Engineers; (3) Lead agency responsible for preparation of plan pursuant to Section 208(b) of the Clean Water Act, 33 U.S.C. Section 1251 et seq, in approved 208 areas; (4) State agency responsible for the preparation of plans pursuant to Section 303(e) of the Clean Water Act, 33 U.S.C. Section 1251 et seq; (5) North Carolina Department of Environment, Health, and Natural Resources, Division of Environmental Health; and (6) Any other federal, state, or local agency upon request. Any person who desires a public meeting on any NPDES permit application shall so request in writing to the Director within 30 days following the publication date of the notice of application. Any such request or petition for public meeting shall indicate the interest of the party filing such request and the reasons why a meeting is warranted. (2) The Director is delegated authority to determine if a public meeting shall be held in accordance with G.S. 143-215.1(c) (3) and to issue public notice and conduct such meeting for the Commission. (3) All comments received within 30 days following the publication date of the notice of NPDES permit application shall be made part of the application file and shall be considered by the Director prior to taking final action on the application. (4) Any meeting brought pursuant to this Subsection shall be held in the geographical area of the proposed discharge or other appropriate area, in the discretion of the Director, and may, as appropriate, consider related groups of permit applications. (b) Adjudicatory Hearings and appeals shall be conducted in accordance with Article 3 of Chapter 150B of the General Statutes. March 1, 1993; November 1, 1987. 15A NCAC 02H .0112 FINAL ACTION ON PERMIT APPLICATIONS Fact Sheet NPDES Renewal Page 7 (a) The Director shall take final action on all NPDES applications not later than 60 days following notice of intent to issue or deny, or, if a public meeting is held, within 90 days following the closing of the record of the meeting or in the case of an Authorization to Construct permit 90 days after the receipt of a complete application or, if a public meeting is held concerning the Authorization to Construct, within 90 days following the closing of the record of the meeting. (b) The Director is authorized to: (1) issue a permit containing such conditions as are necessary to effectuate the purposes of G.S. 143-215.1 and G.S. 143-215.67; (2) issue a permit containing time schedules for achieving compliance with applicable effluent standards and limitations, water quality standards, and other legally applicable requirements; (3) modify or revoke any permit upon giving 60 days notice to the person affected pursuant to Rule .0114(a) of this Section; (4) suspend a permit pursuant to Rule .0114(a) of this Section; (5) rescind a permit upon request by the permittee; (6) deny a permit application: (A) where necessary to effectuate the purposes of Article 21 Chapter 143, (B) for a discharge prohibited by G.S. 143-214.2(a), (C) where the Secretary of the Army fmds the discharge would substantially impair anchorage and navigation, (D) for a discharge to which the regional administrator of EPA has objected as provided in Section 402(d) of the Clean Water Act as amended, 33 U.S.C. Section 1251 et seq, (E) for any point discharge which conflicts with a plan approved pursuant to Section 208(b) of the Clean Water Act as amended, 33 U.S.C. Section 1251 et seq, effective February 4, 1987. (c) The permit applicant has the burden of providing sufficient evidence to reasonably ensure that the proposed system will comply with all applicable water quality standards and requirements. No permit may be issued when the imposition of conditions cannot reasonably ensure compliance with applicable water quality standards and regulations of all affected states. (d) Permits shall be issued or renewed for a period of time deemed reasonable by the Director except in no case shall permits be issued for a period to exceed five years. Thank you, Bob 1 of 1 11/15/02 2:59 PM ti SUMMARY OF CMUD/DWQ/SCDHEC SETTLEMENT AGREEMENT INTRODUCTION In the summer of 2001, the South Carolina Department of Health and Environmental Control (SCDHEC) filed a Petition for a Contested Case in the North Carolina Office of Administrative Hearings regarding the renewal of NPDES Permit No. NC0024970, the Charlotte Mecklenburg Utilities Department (CMUD) McAlpine Creek Wastewater Treatment Plant. The primary complaint on the part of SCDHEC has been that the permit was renewed without a phosphorus limit. Nearly all of South Carolina's municipal dischargers to the mainstem Catawba (upstream of Lake Wateree) have been given phosphorus limits, generally equivalent to 1 mg/L. The McAlpine Creek WWTP permit had a phosphorus optimization study special condition that stipulated preparatory requirements for the facility to ready itself for the upcoming phosphorus Total Maximum Daily Load (TMD). Since the summer, SCDHEC, the North Carolina Division of Water Quality (NCDWQ) and CMUD have been working towards achieving consensus on an appropriate phosphorus limit for the McAlpine Creek WWTP. The understanding has been that this decision will also affect DWQ's permitting strategy for three additional municipal permits: CMUD - Irwin Creek WWTP, CMUD - Sugar Creek WWTP, and Union County - 12-Mile Creek WWTP. The final settlement agreement includes the terms of the limits for all three CMUD plants. A similar strategy will be used by DWQ to limit phosphorus in the Union County permit. SUMMARY OF SETTLEMENT AGREEMENT Limits at McAlpine Creek WWTP Based upon a construction schedule provided by CMUD during the settlement proceedings, the compliance date for the total phosphorus limit at the McAlpine Creek WWTP is set for February 28, 2006. At this time, the McAlpine Creek WWTP must meet a 534 lbs./day total phosphorus limit. This limit is to be calculated as a 12-month rolling average. It corresponds to a 1 mg/L limit at McAlpine Creek's permitted flow of 64 MGD. This limit, as well as the monthly mass cap described below, shall be incorporated into a major modification to NPDES Permit NC0024970 with special condition language to be included with reference to the Irwin and Sugar Creek WWTPs. Since SCDHEC's stipulation was that any limit come into effect prior to the expiration date of the permit, the permit expiration date will also be modified to February 28t, 2006 (instead of June 30, 2005). This puts the permit out of sync with the Basinwide schedule, but is within the five years allowable for a permit term under federal regulations. Bubble Limit A major point of the settlement agreement is the idea of a bubble limit. This refers to a mass limit for total phosphorus that applies to discharge at the three CMUD plants combined. This type of a limit would give CMUD more operational flexibility with regard to phosphorus removal. The bubble limit, to be calculated as a 12-month rolling average, is 826 lbs./day of total phosphorus from all three CMUD plants. This corresponds to a 1 mg/L phosphorus limit at permitted discharge for the three plants. If CMUD conducts construction activities at either the Sugar or Irwin Creek plants, the compliance date for this bubble limit will be February 28, 2007. If CMUD decides not to conduct construction activities at either plant in order to achieve compliance, the bubble limit will come into effect on February 28, 2006. This is identical to the compliance date at the McAlpine Creek plant. Special condition language will be included in the Irwin and Sugar Creek WWTP permits regarding the compliance date. Mass cap In order to be protective of the water quality at the downstream lakes in South Carolina, SCHEC requested that monthly mass caps also be included as part of the total phosphorus limits at the three CMUD plants. This would also ensure optimized operation of the plants at all times. The mass caps at the three plants take the form of a monthly average mass limit and correspond to a concentration limit of 2 mg/L at maximum permitted flow. At McAlpine Creek, this limit is 1,0671bs. /day of total phosphorus beginning February 29, 2006. At the Sugar and Irwin Creek plants, the mass caps only come into effect if construction activities are pursued at each plant. At Sugar Creek WWTP, the limit is 334 lbs./day with compliance commencing on February 28, 2007. At Irwin Creek WWTP, the limit is 250 lbs./day with compliance commencing on February 28, 2007. TMDL As part of the settlement agreement DWQ requested a provision for full inclusion in the TMDL process for both DWQ and all affected NC entities (to be provided in a list by DWQ). APPLICABILITY TO PERMITTING PROCESS The three CMUD permits will have the bubble limit included as a special condition. Monitoring for phosphorus will be included in the regular effluent limit pages. Mass caps will also be included in the effluent limit pages, with a footnote specifying applicability (for Sugar and Irwin Creek plants) and compliance dates. The Union County - 12 Mile Creek WWTP shall have a mass limit equivalent to 1 mg/L at the permitted flow. As with the three CMUD plants, compliance for this limit is to be judged as a rolling annual average. Special monitoring language is being developed for this situation. It is also recommended that the phosphorus optimization study special condition from the original McAlpine Creek WWTP permit be included in this permit to allow DWQ time to review the County's preparations for the impending phosphorus TMDL. The site includes a batch organic chemical production facility which currently produces dyes for use in the textile industry a herbicide active ingredient and specialty chemials.
