I looked over the attachment and it looks like page 4 has the main points of their special use permit. I'm not sure why the information at the bottom of this email is not in there, but obviously these are critical points as well. Two points on page 4 that caught my eye are D which states that spoil piles can't be more than 40 higher than original contour and vertical slopes can't exceed material's natural angle of response. So I'd assume that overburden = spoil. Also the 250 foot setback is in there. Specifically it states that they are to retain existing vegetation for a visual screen and noise buffer. They have not adhered to this condition because they cut all of the timber off of the northern portion of the property within the last 5 years, including that within 250 of the property boundary. Page 3 has some information on standards of evaluation that address noise and vibration levels. I'm no expert on this, but I see nothing in the attachment on page 3 or in the text below that suggest that the primary crushing area couldn't be located on the north side of the wetlands. The standards are the same for any part of the operation regardless of where it occurs. There's nothing to say that in here that neighbor A on the north side of the wetlands must be treated differently than neighbor B on the south side. In addition, the following conditions were also placed on the approval by the Board of Commissioners. Additional Conditions: 1. Prior to any blasting on the new property, and subject to the property owners' permission, a pre -blast survey will be performed by an independent consultant, at Martin Marietta's expense, on all non - company owned, occupied structures existing as of the date of the permit, within 1000 feet of the proposed blasting activities on the property, with a copy of the result provided to each property owner. A record of the seismograph reading of each blast event will be kept for a minimum of five years at the quarry office and may be inspected by the County Manager or his designee. No explosives will be stored on the property and will be brought onto the site on the day of the blast. 2.
