Dear Mr. Finch:
This correspondence is with reference to the request you submitted to modify State Permit No. 62-09 which was
originally issued to River Bluff Holdings, LLC on June 5, 2009 for the development of a docking facility in Leland,
Brunswick County. This permit has been continuously renewed and modified. The most recent modification was for
small dimensional changed and was issued on September 10, 2020 and the permit is due to expire on December 31,
2022.
The action proposed in your submittal consists of the addition of one additional slip for a total of 51 slips. The proposed
slip would include a 24' by 11' (264 ft2) floating lift located on the eastern end of the permitted docking facility and would
incorporate an additional 264 ft2 of Public Trust Area (see sheet 1 of 1 dated March 29, 2022). The docking facility is
located in a Primary Nursery Area with the proposed additional slip and floating lift in depths greater than 2' at a mean
low water. The waters surrounding the docking facility are closed to shellfish harvest. Shellfish sanitation had no
comments on the proposed additional slip per the attached email dated March 29, 2022.
Upon review of the information provided and in coordination with NC DMF, Shellfish Sanitation, the Division of Coastal
Management has determined that the proposed action continues to be consistent with existing State rules and
regulations. I hereby submit this Letter of Refinement authorizing the modification of State Permit #62-09, as described
in your request dated April 21, 2022. By copy of this letter we are notifying the US Army Corps of Engineers and the
Division of Water Resources of our action. Please note this refinement does not alleviate the need to obtain any other
local, state or federal permits.

The latest modification to permit number 62-09 for River Bluffs Holding II included minor dimension changes
to the approved docking facility around the temporary tie up slip and slip number 1 and was issued on
September 10, 2020. Since that time, the first section of the facility has been constructed and the applicant is
now continuing construction on the remaining portion.
After review of the approved layout, the outside of the last finger pier was not labeled as a slip (eastern end of
the facility adjacent to slip 50, see attached figure). We'd like to request authorization to add this as a formalized
slip with a floating lift. Can this be authorized with a letter of refinement?
