Mr. Bruce Marek, acting as agent for the Village of Bald Head Island, has submitted a request to
modify State Permit No. 91-14, which was originally issued to the Village of Bald Head Island on
July 25, 2014 for Terminal Groin Construction and was Modified on March 26, 2018 for the
placement of sand east of the Terminal Groin along South Beach. This permit has been renewed
and further modified. The most recent renewal was issued on December 13, 2017 and is due to
expire on December 31, 2022.
The Village is requesting authorization to construct a sandbag structure adjacent to the Shoals Club
on East Beach, located at 100 Station House Way adjacent to the Atlantic Ocean (see Sheet is and
2 of 4). This location is within the State Ports Inlet Management Area. According to the
proposal, increased erosion adjacent to the Shoals Club has resulted in the loss of the frontal dune
entirely and the applicant is requesting that the entire 420 linear ft. shoreline be protected with
sandbags in accordance with 15A NCAC 07H .0313(c)(3) and (4) (see Attached Rules). The
applicant has defined access location points and a staging area, which would be located on the
adjacent lot located at 3210 Shoals Watch Way. This lot is owned by Bald Head Ltd. (see Narrative
and Sheet 4 of 4). Work would be tidally dependent and the application states that all work would
be coordinated with the Bald Head Island Conservancy due to sea turtle nesting season. The
proposed project would take approximately 2 — 2.5 weeks to complete. Sandbags are proposed in
a parallel alignment with a 20 ft. base width and a maximum height of 6 ft. (see Sheet 3 of 4).
The permittee has submitted a check (#2164) in the amount of $100.00 for the modification. The
permittee has requested an expedited review of this proposal due to ongoing erosion. This
office has no objection to this modification request, but does support the recommendations of the
resource agencies, particularly the NC Division of Wildlife Resources and the USACE,
regarding potential impacts to sea turtle and bird nesting activity.

Dear Ms. MacPherson:
I have been retained as authorized agent for the Village of Bald Head Island in applying for a minor
modification to their major permit CAMA # 91-14. Current expiration date is December 31', 2022.
Permit request is for the installation of erosion control devices/sandbags per 15A NCAC 07H .0313
Use Standards for State Ports Inlet Management Areas in the vicinity of the Shoals Club on Bald Head
Island near the southeast corner of Bald Head Island//base of Frying Pan Shoals. The Shoals Club
address is 100 Station House Way, Bald Head Island, NC 28461. Brunswick County. Water body is
the Atlantic Ocean. Stream Index #99-3.
Per your e-mail of last Friday, 4-29-22, I have secured a letter of agreement from Mr. Chad Paul, CEO
of Bald Head Island Limited, LLC to allow the use of their Lot 3210, BrunsCo parcel i.d. 2xxxxxxxx,
3210 Shoals Watch Way, Bald Head Island for project access/construction entrance from Shoals
Watch Way and an appx 50'x60'lay down/staging area. Letter is included. This also approves access
for appropriate State, Federal and VBHI officials/employees, as well as the contractor and his
crews/subcontractors.
Village Manager Chris McCall has talked to the Bald Head Island Conservancy, and they have asked
to be able to monitor for turtle nests daily, similar to what was done for the 2014 terminal groin
project. There is no objection to this, with the caveat that these inspections are timely. Of course, sand
bag filling is very tide dependent, but construction crews typically take the first contractor ferry of the
morning, which leaves the mainland at 5:30 am, arriving at the island at 6 am. As the Conservancy has
interns living on the island, this should not be an issue, as long as any occasional delay is only minor.
No work is requested for after dark or before daylight.
My check #2164 for the $100 permit fee is included with this submittal.
Adjacent Neighbors have already been notified by Certified Mailings sent on 4-25-22. Mailing
Receipts with tracking numbers included. West adjacent neighbor, Lot 3210, 3210 Shoals Watch Way,
Bald Head Island Limited LLC has already responded by e-mail to me with "no objection". Copy

East adjacent State Property Office for Parcel picked up the certified mailing on Wednesday April 27,
2022. I have not seen a response, although one might have been sent directly to you. The l0-day
waiting period expires soon. The tracking information with pickup date is included.
My CAMA agent authorization form for the Village is included. CAMA Agent Authorization Forms
for the Shoals Club on Bald Head Island and for Lot 3210 are also included. 1 have done work for both
owners for years. Including being a project consultant on putting in utilities and roads for both Station
House Way and Shoals Watch Way, and for several beach bull dozing/sand push projects.
I am including a revised set of drawings Cl R1, C2 RI and C3 R1 updated from the ones I submitted
last week for your meeting with COE and Other Agencies. I am also including a sheet C4 which is a
sketch of the appx construction entrance and laydown area. All are seal dated 5-4-22.
Please note that the project area is primarily along the 420' length of dune escarpment/pool boundary
fence x 20' allowed width of sandbags. Including the construction entrance and laydown yard, and the
necessary fringe areas for sand bag filling, project is quite a bit under the 1 acre trigger for a State
Sediment & Erosion Control Permit. However, I will work with the VBHI Building Inspector/LPO to
install silt fence as appropriate at the construction entrance, along the 3210-3212 property line (on the
3210 side), and at the laydown area. Note that the contractor will have a large track hoe (D312), a
smaller track hoe, a spill box, and at least two pumps, which will have to be removed from the beach
after work for the day is complete. Again, no work is requested for after dark or before daylight.

within 10' of the Kiddie Pool Concrete Deck. The Shoals Club property width at the south (beach) side
is appx 420 feet, from the left/west side of the pool boundary fence to the State Property Office Parcel
26600001, Beach Parcels 9-12, which starts appx east of the beach access stairs in the picture. Beach
Parcels 9-12 is also known as the S.I.L.T. Tract, for the Smith Island Land Trust, who donated the land
to the State. The developer, Bald Head Island Limited had sold the parcel to S.I.L.T. years ago to
keep the point undeveloped/prevent future use of the site for a high rise hotel, inconsistent with
everything Bald Head Island.
There have been several recent severe erosion events at the southeast end of Bald Head Island, at/near
the base of Frying Pan Shoals. Including greater than 20 feet over recent 30 days, which allows this
permit modification request for temporary erosion control structures per 15A NCAC 07H0313 Use
Standards for State Port Inlet Management Areas. The 20'/30 days is condition (c)(4). We have also
lost the toe of the current primary due (c)(1). I am including a copy of the standard within this letter. I
believe we can also meet items (c)(3) imminently threatened primary dune; imminently threatened
infrastructure & hopefully (c)(2) Director of DCM agreement on accelerated erosion/risk of damage to
structures.
The pool boundary fence was rebuilt since the picture, with its waterward edge appx 1' south of the
bocce ball court wood walkway that can be seen in the picture. The waterward toe of the dune is now
gone. That's how the ship artifact became uncovered in January 2022. The artifact has recently been
removed from the beach under CAMA 99-87 LOR dated 4-22-22. Actually, several "primary" dune
toes and dunes themselves have been lost, as the pool boundary fence shown in the photo was
originally set in 2002 at the CAMA 235' small structure setback from first line of stable vegetation
(FLSV).
Proposed sandbag placement is per my detail sheet C3 R1. Base width shown as the 20' allowable
max, and height at the 6' maximum height. Sandbags are appx 15' x 5' flat; which is about 13' x 3'-
3.5' squished diameter. Bottom layer to have two rows parallel to the shore up against the dune
escarpment or pool boundary fence, and a waterward perpendicular row to make up the 20' base width.
The second/upper layer will have one row perpendicular to the water, staggered back from the
waterward edge off the first layer. I have shown it as either just the perpendicular row or as a
perpendicular row with a parallel row into the escarpment/along the fence. Depending on bag
availability (supply chain), we will need somewhere about 240 to 300 of the 15'x5' flat sandbags, and
possibly more with end returns at the project ends and if there are any additional severe erosion events
between now and completion.

Proposed/Estimated Timeline: Placement of Sandbags in a State Ports Inlet Management Area
1. Construction/grading of the appx 16'x75' construction access road/appx 50'x60' lay
down/staging area near the top/road end of Lot 3210, 3210 Shoals Watch Way, west adjacent to
the Shoals Club. ABC stone/rock is already stockpiled on island for these two areas. Silt fence
has been ordered and will be placed in coordination with Bruce Marek, P.E. and Stephen
Boyett, Building Inspector/CAMA LPO.
2. Sandbags: 60 sandbags are already on island from the original 91-14 2014 terminal groin
project, and are immediately available. Bag bundles are 10 per bundle, appx 5' wide x 8'-10'
long. Purchase of additional appx 240 will be made after issuance or quasi -guarantee of permit
mod issuance. I assume at least 2 week lead time from date of order. Previous supplier is from
Florida. Supply chain issues can scramble this, but the 60 will almost get us the first two
parallel to the shore rows of the first layer.
3. Equipment: The big track hoe is already on the island. A spill/transfer box is being sourced.
Pumps are on the mainland, awaiting permit issuance/quasi guarantee of permit mod issuance.
Smaller track -hoe will need to be barged to the island.
4. Porta-potty should be readily available from VBHI Utility Company.
5. 3210/3212 Shoals Watch Way property line was supposed to be flagged today.
6. The BHI Conservancy has requested a copy of my submittal for their timeline on having
inspections/search for turtle nests. This will happen this week.
7. Filling of sandbags once permit mod is issued. Very tidal dependent. On best days, if falling
tide is 2 hours from high tide, then there are appx 8 hrs available work time, tide wise. Appx
12 bags predicted. On worst day possible, say at mid tide, flood tide, there is only about an
hour before site becomes unworkable, and maybe 1 or 2 hours at end of work day. Well give
that 4 bags per day. So, the average is appx 8 bags average per 8 hour work day = appx 40
bags per week for standard 8 hr workdays. With startup learning curve, we would shoot for the
first 60 bags to be done in about 2 — 2 Y2 weeks after full mobilization. With days getting longer
after that, and if two crews or overtime work is done, we would shoot for 50 bags per week for
the 240 new bags, or appx 5 weeks after the first 60 bags.
Note this timeline is a work in progress as we await availability of the additional sand bags.

Bald Head Island Limited, LLC is in support of the Village of Bald I -lead Island's CAMA Permit
Modification request for Sandbags at the Shoals Club on Bald Head Island, at 100 Station House Way,
per 15A NCAC 07H .0313, the Use Standards for State Ports Inlet Management Area As west
adjacent neighbor of vacant lot 3210 Shoals Watch Way, Limited agrees to allow construction access
to this beachfront project tluough/over Lot 3210 and to provide a suitable staging/laydown area for an
appropriately insured, licensed contractor and his employees/subcontractors. This also applies to
access by appropriate VBHI, State & Federal employees, and design consultants.
Per Bruce Marek, P.E., the project engineer, the marled laydown area to be 50'x60'.and the
construction entrance to be appx 16' x 75'. The laydown area to be set back from the road a minimum
of 10' to avoid being in the utilities easement. The construction entrance to be appx 10' off the west
property line. A porta potty (or 2) will be required. The west property line will be staked. Silt fence
and construction area/no trespassing signs will be posted as directed by Mr. Marek and/or Stephen
Boyett, the Village Building Inspector/CAMA LPO.
In addition to beach access for the contractor's machinery, Limited agrees to allow any end
return/corner of the sandbags on Lot 3210. We have experienced the same accelerated erosion rate and
have lost almost all of our March beach bulldozing sand push. We look forward to this winter's nav
channel dredging to Bald Head Island. The smart thing would be for the sand to be deposited to the
east end first.

15A NCAC 07H .0313 USE STANDARDS FOR STATE PORTS INLET MANAGEMENT AREAS
(a) Development within State Ports Inlet Management Areas are defined by Rule .0304 of this Section in
accordance with the standards in this Rule.
(b) All development in the State Ports Inlet Management Areas shall be set back from the first line of stable and
natural vegetation, static vegetation line, or measurement line at a distance in accordance with Rule .0305(a)(5) of
this Section, except for development exempted under Rule .0309 of this Section.
(c) Notwithstanding the use standards for temporary erosion control structures described in Rule .0308(a)(2) of this
Section, a local government or State government agencies may apply for a permit to seek protection of an
imminently threatened frontal or primary dune, public and private structures and infrastructure within a State Ports
Inlet Management Area. For the purpose of this Rule, a frontal or primary dune, structure, or infrastructure shall be
considered imminently threatened in a State Ports Inlet Management Area if:
(1) its foundation, septic system, right-of-way in the case of roads, or waterward toe of the dune is
less than 20 feet away from the erosion scarp;
(2) site conditions, such as flat beach profile or accelerated erosion, increase the risk of imminent
damage to the structure as determined by the Director of the Division of Coastal Management;
(3) the frontal or primary dune or infrastructure will be imminently threatened within six months as
certified by persons meeting all applicable State occupational licensing requirements; or
(4) the rate of erosion from the erosion scarp or shoreline within 100 feet of the infrastructure,
structure, frontal or primary dune was greater than 20 feet over the preceding 30 days.
Permit applications to protect property where no structures are imminently threatened require consultation with the
US Army Corps of Engineers.
(d) Temporary erosion control structures constructed by a local or state government shall have a base width not
exceeding 20 feet, and a height not to exceed six feet. Individual sandbags shall be tan in color and be a minimum of
three feet wide and seven feet in length when measured flat.
(e) Established common-law and statutory public rights of access to the public trust lands and waters in State Ports
Inlet Management Areas shall not be eliminated or restricted. Development shall not encroach upon public
accessways nor shall it limit the intended use of the accessways.
(f) Except where inconsistent with the above standards, all other rules in this Subchapter pertaining to development
in the ocean hazard areas shall be applied to development within the State Ports Inlet Management Areas.
(g) In addition to the types of development excepted under Rule .0309 of this Section, small-scale, non -essential
development that does not induce further growth in the State Ports Inlet Management Areas, such as the construction
of single-family piers and small-scale erosion control measures that do not interfere with natural inlet movement,
may be permitted on those portions of shoreline within a designated State Ports Inlet Management Area that exhibit
features characteristic of Estuarine Shoreline. Such features include the presence of wetland vegetation, lower wave
energy, and lower erosion rates than in the adjoining Ocean Erodible Area. Such development shall be permitted
under the standards set out in Rule .0208 of this Subchapter. For the purpose of this Rule, small-scale is defined as
those projects which are eligible for authorization under 15A NCAC 07H .1100 and .1200.

As the adjacent riparian property owner to the aforementioned project, I am required to notify you in
order to give the opportunity to comment on the project. Please review this notification document &
15A NCAC 07H .0313. While (c)(4) is our primary basis for the section (d) type temporary erosion
control structure, we also meet (c) (I). as the waterward toe of the dune is now actually gone.
Actually, we have lost several "primary" dune toes as the pool boundary fence shown in the photo was
originally set in 2002 at the CAMA 235' offset from first line of stable vegetation (FLSV). We will be
providing (c) (3) and are also asking for (c) (2).
I have included the Division of Coastal Management Notification/Waiver Form, If you care to
comment, please notify Ms. Tara MacPherson, CAMA District Manager at the North Carolina
Division of Coastal Management, 127 Cardinal Drive Extension, Wilmington, NC 28405. I have
