This correspondence is with reference to the request you submitted to modify State Permit No. 90-19,
which was issued on November 18, 2019. The current permit is scheduled to expire on December 31,
2022.
The action propose tin your submittal consists of the installation of a 16' x 16' concrete pad (for cooler
placement) along the southeastern corner of the property. As designed, a small portion of the concrete
pad (approximately 4' x 6', or 24 sf.) would encroach within the 30' Coastal Shoreline buffer; however,
this area of Surf City has been designated as an "Urban Waterfront", therefore development within the
30' Coastal Shoreline buffer would be allowed. The property owner should implement any/all Best
Management Practices (BMPS) to reduce the amount of stormwater runoff from entering this vegetated
30' Coastal Shoreline Buffer. Such measures should include installing gutters or piping to re -direct
stormwater runoff away from the sound.
Upon review of the information provided, the Division of Coastal Management has determined that
the proposed action continues to be consistent with existing State rules and regulations and is in
keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement
authorizing the modification of State Permit #90-19, as described in your request dated April 11, 2022,
and drawing dated received by DCM on April 11, 2022. By copy of this letter we are notifying the US
Army Corps of Engineers of our action. Please note this refinement does not alleviate the need to obtain
any other local, state or federal permits.
