Dear Mr. Emanuel,
On April 25, 2014, the Division of Water Resources (DWR) received an application for the above
referenced project; however, the DWR has determined that an Authorization is not needed as the
project is proposed. See the following for more detail:
• The subject stream does not have riparian buffers regulated by DWR so no Buffer
Authorization is needed for this activity.
• The proposed bank stabilization is above the ordinary high water mark of the stream bank;
therefore, a 401 Water Quality Certification is not needed at this time.
• You may want to contact the Land Quality Section of the Division of Energy, Mineral and
Land Resources at the Mooresville Regional office at (704) 663 -1699 for information on
erosion control or stormwater requirements for your project.
• Please note that if your project changes resulting in streambed stabilization or fill, a 401
Water Quality Certification will be required.
