I'm preparing the approval for this, but wanted to confirm that you've verified the impacts
associated with the project in terms of temporary vs. permanent. For instance, the PCN lists the
proposed instream structure and bank stabilization within the Thompson River as a temporary
impact (PCN Impact #'s S4 and S5). Based off design and impact to OHWM, shouldn't these be
permanent impacts? Would culvert daylighting be considered permanent impacts (currently listed as
temporary in PCN), given that the streambanks will be stabilized upon culvert removal? Would
flooding of wetlands associated with PCN Impact #1 be considered temporary or permanent (W5,
W6, W7)?

"3a. List by Stream impact number: / Permanent (P) or Temporary (T): Each stream
impacted must be identified on a location map (S1, S2, S3, etc.) and included in this table. If
you have more than 6 stream impacts, submit an additional sheet with a table listing the
additional impacts. For linear projects, such as roads or utility lines, attach a sheet that
separately lists the coordinates for each crossing of a stream."

Kaylie, Thanks for sending. The stream and wetland references in the table refer back to the
approved preliminary jurisdiction map approved by the Army Corps of Engineer and
included with our request. For instance, Stream impact S 1 in the table references the
approved PJD stream segment S5. We believe it would be more consistent to have the
impacts reference back to the approved PJD. Let me know if this helps.

The figure and impact table for this project need to correspond. For instance, one example, the
map indicates W8 shows 0.05 AC impact, but this is actually impact site W4 on the PCN table.
Another example, where are the proposed impacts to S6 for culvert daylighting on the map?
I've attached my markup/questions and the submitted PCN. The project is on hold until this
information is clarified.

On August 4, 2020, the Division of Water Resources (Division) received your
application requesting a 401 Water Quality Certification from the Division for the
subject project. The Division has determined that your application is incomplete and
cannot be processed. The application is on hold until the following items are
addressed:
1. Please enumerate all proposed wetland and stream impacts on the site plan and
clearly label all impacts (Wetland/Stream Impact 1, etc.). The impacts on the site

2. Please verify the stream, wetland, and open water impacts listed within the PCN
impact tables. The impact totals provided in the cover letter narrative do not match

3. The project proposes 175 linear feet of streambank stabilization. The project
application also proposes the removal of 20 linear feet of culvert for stream
daylighting associated with dam improvements. Please provide a streambank
stabilization plan and typical drawings for these activities. [15A NCAC 02H .0502
(c)] [15A NCAC 02H .0506(b)(2) and (3)]
4. Please provide further clarification on how the proposed rock vane structure
included within item "D" of the application cover letter is to be installed and how
permanent restrictions to streamflow and aquatic passage will be avoided. [15A
NCAC 02H .0502 (c)] [15A NCAC 02H .0506(b)(2) and (3)]
5. Please clarify if the proposed grade changes and inclusion of flashboard risers
within item "E" of the application cover letter are still requested. During a site visit
conducted on September 8, 2020, it was indicated that these components are no
longer required. If these activities are still proposed, please provide an explanation
for why grade changes and flashboard risers are required and a plan for how this
work will be completed. [15A NCAC 02H .0502(c)]
6. The project proposes to perform restoration activities within 20.76 acres of
wetland/bog complexes onsite. Please clarify what the proposed restoration activities
are and provide information on how these activities are to be performed. [15A

Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the
above requested information for the proper consideration of the application. If all of
the requested information is not received, the Division will be unable to approve the
application and it will be returned.
