Michael, Thank you for your PCN, dated 4/21/2022, for the above referenced project. I especially appreciate the thorough description of on -site habitat, which will greatly ease my coordination with USFWS. That said, there are a few areas of clarification needed before I can proceed with verifying the use of Nationwide Permit (NWP) 29 (https://saw- reg.usace.army.mil/NWP2021/NWP29.pdf). Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1) For the road crossing impact the PCN references rip rap, and plansheet "Perennial Wetland Impact Map" references "Road/Culvert Impact." However, no culvert or rip rap is shown through the wetland impact necessary to continue flow and circulation of waters of the US (i.e. Wetland WA) downslope. As currently designed the crossing may not comply with NWP 29 General Condition 8, and may also result in additional indirect impacts (per NWP 29 District Engineer's Decision part 2) to Wetland WA through alteration of hydrology downslope. Please revise the plans accordingly; 2) The "Perennial Stream/ Wetland Impact Location Map, Rock Creek Station Apartments" shows a plunge pool discharge from a wet detention pond and what appears to be a rip rap pad extending to the edge of Wetland WD. Please provide a zoomed -in detail plan showing this area in greater detail in order to facilitate our full evaluation of this project. Sue, please advise as to the 401 requirements for this project so that, if an Individual 401 WQC is required we can implement our responsibilities under the EPA's 2020 Clean Water Act section 401 rule.
