Skvarla, III Secretary On May 12, 2014, the Division of Water Resources (Division) received information about the Dan River Steam Station — Town Creek Ash Removal Project, requesting concurrence that a 401 Water Quality Certification was not required. On May 13, 2014, the Division received confirmation from the U.S. Army Corps of Engineers (Corps) that EPA is operating under CELCLA and has determined that the activities are exempt from their permitting requirements. Upon review of the information provided by both you and the Corps, the Division concurs that a 401 Water Quality Certification is not required for this activity. This does not relieve you of the responsibility to obtain any other required federal, state or local approvals.
