Subject:FERC Two-Year Pilot Licensing Application NOT filed for P-14521-NC Hydroelectric Project at Corps' Falls Lake Dam Messrs. Jayjack, Turner and Spencer: I thank you and the other FERC staff who met with me on April 29. As reflected below, my belief was not shared by the dam owner or cooperating agencies that sufficient progress was made by the City of Raleigh that I could continue to complete the FERC process on an expedited basis. I remain hopeful that I can, nonetheless, proceed to develop and submit a FERC license application consistent with existing regulations within the one year period envisioned in the pilot process, while concurrently addressing the requirements of the Corps 408 process, that I believe is the more critical path to obtaining approval to construct and operate a hydroelectric facility at this site. I will be providing information as I am able to assemble and develop data and analysis for Corps and other agency feedback over the course of the summer and into the fall. In contrast to the other licensing processes, the applicant is expected to have expended more time and effort working with the agencies to resolve potential issues before the FERC is engaged in the two-year process. Presumably, if the issues can be resolved by the applicant to complete a final license application within a one-year time frame, the FERC anticipates concluding its environmental review and issuing the license at the end of the next year. > > Thank you for your feedback, > > Kelly > 2
