Dear Mr. Pardo and Mr. Shahbain:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on December 16, 2021. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
1. Section IX of the Application — Since the Applicant is also the Property Owner, the
Property Owner Authorization is not required and should not be signed. With your
permission, I will cross -out this signature on the form. If that is not acceptable, please
provide a revised signature page for the Application.
2. General MDC 4 — Please provide calculations showing that the inlet to the SCM has been
adequately designed to protect the SCM from erosion. It is noted that the 10-year design
storm does not result in a discharge from the SCM so outlet calculations are not required.
3. General MDC 9 — Please increase the size of the SCM access/maintenance easement to
include the entire SCM system. Per the provided plans, the emergency spillway appears
to be partly located outside of the easement. Per the Manual, the entire footprint of the
SCM system (The SCM system includes the side slopes, forebay, riser structure, SCM
device, basin outlet, dam embankment, outlet, and emergency spillway) must be included

in the access and maintenance easement. You may wish to extend the easement an
additional 10 feet around the SCM system to provide sufficient room to complete
maintenance tasks.
4. Supplement-EZ Form, Infiltration System Page:
a. Line 22 —Per the provided soils report (9/21/2021), the soil conditions were only
evaluated to elevation 422. Please either revise this item to "< 422" or provide a
soil report verifying that the SHWT is lower than elevation 415 (as shown on the
form).
b. Line 24 — Per the provided soils report, the SHWT was not observed within 15
feet of the ground surface elevation. Per the prior comment, the soil conditions
were only evaluated to elevation 422 so the ground surface elevation can be
determined to be at elevation 437 (422 + 15). Please either revise this item to
"437" or provide a soil report verifying that the ground surface elevation is at
elevation 440 (as shown on the form).
c. Line 26 — Per the provided soils report, the soil infiltration rate at the proposed
bottom elevation of the infiltration basin is 18 in/hr (10 in/hr if using the more
conservative infiltration rate at a slightly lower elevation). Please either revise this
item to coincide with the soils report or provide a soil report verifying that the
infiltration rate is 9 in/hr (as shown on the form). If the infiltration rate was
intentionally lowered (to account for clogging of the soils that will happen over
time) you can make a note of it in the "Additional Information" section (Line 46)
and use the lowered infiltration rate for this item.
d. Line 30 — The storage elevation for the infiltration basin is the elevation that the
design volume (7,481 cf) would pond to. Per the provided stage -storage table, the
design volume would pond to an elevation of approximately 437.25 (The
provided storage volume at elevation 437 is only 5,830 cf). Please revise as
needed.
e. Line 33 — Similar to the prior comment, the surface area for the storage elevation
should be evaluated at the elevation that the design volume would pond to. Per the
provided stage -storage table, the design volume would have a surface area of
approximately 6,500 sf. Please revise as needed.
f. Line 45 — Please calculate the actual drawdown time of the design volume (72
hours is the maximum allowable per the MDC, but the actual drawdown time of
this infiltration basin would be much faster. Equation 2 in Part C-1 of the Manual
can be re -arranged as follows to calculate the actual drawdown time based on the
actual design parameters:
T = FS * (DV * 12) / (K * SA)
5. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, 1 hardcopy of other
documents, and a response to comments letter briefly describing how the comments have
been addressed.

Please reach out to me prior to hand delivering a submission to make
sure that I (or someone else in my group) will be able to receive the
submission. Do not leave the package in the foyer with the
security guard.
NOTE: Hard copies should not be sent to a Regional Office. Doing so
will delay the review process and the submission package may be lost
while being sent from the Regional Office to me in the Central Office.
While it is not required, it is recommended that the off -site drainage from upstream properties be
diverted around the SCM since the Applicant cannot maintain control over the development of
property that they do not own. If the Applicant elects to account for off -site drainage, it must be
accounted for at its full build out potential (per 15A NCAC 02H .1003(3)(b)) which can either be
assumed to be 100% BUA or can be handled by having a recorded legal agreement in place
between the Applicant and the Owner of the upstream property in which the Owner of the
upstream property agrees to record a deed restriction limiting the minimum/maximum amount of
BUA on the upstream property that will be treated in the Applicant's SCM, the locations and
sizes of access and drainage easements, how construction and/or ongoing maintenance costs will
be handled, maintenance responsibility, a list of legal recourses available to each party should
one party fail to hold up their end of the agreement, and any other related legal issues.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to March 11, 2022, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW6211203 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
