Jeanette, Wilmington has a question about the private SCM inspection requirements under their MS4 permit. Currently there are some wet ponds (and some swales in low density subdivisions) in Wilmington that were permitted by the State only and not the City. Wilmington has the understanding that they are not required to inspect these, and that it is the state’s responsibility. They further understand that they are required to inspect city-permitted ponds and city+state permitted ponds. Can you confirm that this is a correct understanding?
