Thanks for your PCN and attached plans, dated and received 4/16/2014, for the above referenced project. I have
reviewed the information and currently the project as described does not fit the terms and conditions of Nationwide
Permit 12 http: / /www,saw.usace.army.mil/ Portals /59 /docs/ regulatory /regdocs /NWP2012 /NWP12 3- 23.pdf. Please
see the attached document (2014 -00852 Incomplete Tearsheet.pdf) and submit the requested information (via e-mail is
fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide
Permit or consider your application withdrawn and close the file.
Also, as requested last week, I would like to schedule a field verification of the Jurisdictional resources in the project
corridor.

Location/Description of Proposed Activity: The project is located on the west side of the Haw River between
US 70 Bypass and Riverside Drive in Burlington, Alamance County, North Carolina. Latitude 36.099450 N,
Longitude - 79.379159 W. The applicant has submitted a Preconstruction Notification (PCN) application for 5
total crossings in order to replace existing 42" and 15" gravity sewer lines with 42" and 16" gravity sewer
lines, respectively, resulting cumulatively in 155 linear feet of temporary stream impacts, 0.3273 acre of
temporary riparian, non - riverine wetland impacts, and 0.226 acre of permanent conversion of forested to
herbaceous wetlands.

REMARKS:
1. Your PCN included impacts to wetlands, streams, and open waters, however these jurisdictional boundaries
have not been verified by the USACE. Please schedule a time for an on -site verification with the USACE.
2. According to the plans, rip rap is proposed for Impacts 1 and 4; however this is not mentioned in the PCN.
Please include these impacts as permanent in the PCN (although they would not be considered a loss of
Waters). Also, please explain why rip is not proposed for Impacts 2, 3, and 5.
3. According to the plans, the utility lines are buried for Impacts 4 and 5; however they are not buried for
Impact 1 -3. Please explain how Impact 1 -3 will avoid impeding flow, so as to comply with Nationwide
Permit Condition # 2. Please note that, based on the plans, Impact 3 appears to have the effect of
permanent fill.
4. Per Regional Condition # 4.1.8 please provide a plan to restore and re- vegetate wetland areas cleared for
construction. Note that Fescue grass shall not be used.
5. Please confirm that, in wetlands, the top 6 to 12 inches of the trench will be backfilled with topsoil from the
trench, as required in the Nationwide Permit 12 description.
