This letter is offered in response to your request for speculative effluent limits for the potential expansion
of the Pittsboro wastewater treatment plant (WWTP). The plant currently has a permit to discharge 0.75 MGD of
treated domestic wastewater to Robeson Creek (a tributary to Jordan Lake) in the Cape Fear River Basin in
Chatham County. You and your consultant requested speculative limits for potential flow increases to 1.245
MGD and 3.0 MGD. The current permit expires February 28, 2001.
We have reviewed the request and provide the following response with the enclosed speculative limits.
The speculative limits presented here are based on our understanding of the proposal and of present
environmental conditions. The Division of Water Quality (DWQ) cannot guarantee that it will issue the Town an
NPDES permit to expand its discharge of treated wastewater into waters of the State. Nor can we guarantee that
the effluent limitations and other requirements included in any permit will be exactly as presented here. Final
decisions on these matters will be made only after the Division evaluates a formal permit application for the
Town's discharge and notices the proposal for public comment.
Environmental Assessments of New Projects and Expansions:
Please be aware that you will have to evaluate this project for environmental impacts before applying for a
permit modification. Anyone proposing to construct new or expanded waste treatment facilities using public
funds or public (state) lands must first prepare an environmental assessment (EA) when wastewater flows (1)
equal or exceed 0.5 MGD or (2) exceed one-third of the 7Q10 flow of the receiving stream. Regardless of the
requested expansion flow, Pittsboro will be required to perform an EA based on the latter (criteria 2). DWQ will
not accept a permit application for a project requiring an environmental assessment until the Division has

approved the EA and sent a Finding of No Significant Impact (FONSI) to the state Clearinghouse for review and
comment. The Division is aware that the Town has submitted an Environmental Assessment for the project and
comments from the Division have been submitted to the Town.
Speculative Effluent Limits
Based on the available information, tentative limits for the proposed discharge to Robeson Creek are attached.
Some aspects of the speculative limits are explained below.
BOD5 and NH3-N. The Pittsboro WWTP currently has BOD and NH3-N limits of 5 mg/1 and 2 mg/1,
respectively. With any expansion above 1 MGD, the NH3-N limit will be reduced to 1 mg/1 (2 mg/1 winter).
These limits reflect the most stringent limits to protect the minimum streamflow of 0 cfs (7Q10s). Updated
streamflows provided by USGS were used in the development of the speculative limits, where appropriate.
Chlorine. The Division requires chlorine limits and dechlorination for all new or expanding dischargers
proposing the use of chlorine for disinfection. The process of chlorination/ dechlorination, or an alternate form
of disinfection such as ultraviolet radiation (as is currently used at the plant), should allow the facility to comply
with the total residual chlorine limit.
Chronic Toxicity Testing. The Town's chronic toxicity limit would continue to be a Pass/ Fail at 909 .
Toxicant Parameters. Estimation of toxicant parameters will not be given with this speculative letter, but will be
submitted as appropriate with the draft NPDES permit. However, due to the lack of dilution in the receiving
stream under design conditions, any toxicant which may be limited would be based on the water quality standard.
Nutrients. In reviewing the Town's request for speculative limits for a potential expansion, nutrients are a major
concern. Robeson Creek is listed as partially supporting and not supporting its designated uses on North
Carolina's 1998 303 (d) list. The 303 (d) list is mandated by the Clean Water Act and requires states to list any
impaired water, then develop a management strategy to restore the waterbody to its designated use. One of the
water quality parameters affected on Robeson Creek is chlorophyll -a, a measurement of algal activity which
responds to excess nutrients; elevated levels of chlorophyll -a were found in Robeson Creek due to point source
and nonpoint source contributions.
As you are likely aware, the General Assembly passed House Bill 515 during the 1997 session. This bill had a
direct effect on all wastewater treatment plant discharges to surface waters classified as nutrient sensitive waters
(NSW). In summary, the bill specifies an average annual mass load limit for total nitrogen and/or total
phosphorus, if one or both of these nutrients are deemed to be a parameter of concern. The General Assembly
also passed Senate Bill 1366 in 1997, which allowed an extension date for compliance with nitrogen and
phosphorus discharge limits until such time that a calibrated nutrient response model was developed in certain
water bodies where an adequate model did not exist. The Town of Pittsboro is a member of the Jordan Lake
Coalition, which has proposed a schedule to comply with the stipulations of Senate Bill 1366 and is not currently
required to meet nutrient limits.
Based on this information, the Division of Water Quality could only allow an expansion if nutrient loading
remained constant throughout any expansion phase. Table 1 provides approximate concentration values and
mass loading values for total nitrogen (TN) and total phosphorus (TP), if nutrient loadings were held constant
with expansions to 1.245 MGD and 3.0 MGD. At the requested flow of 1.245 MGD, the Town would have
difficulty complying with the estimated concentrations and loadings under the best circumstances with the
technology currently available. At the requested flow of 3.0 MGD, the Division knows of no feasible treatment
technology to achieve the nutrient limits listed in the table.

A possible alternative for the Town of Pittsboro, and one that may benefit the Robeson Creek drainage area,
would be to offset any additional nutrient loading, beyond what is technically feasible, by implementing best
management practices (BMPs) to certain land use areas within the drainage basin. Members of my staff have
evaluated land use area and estimated the current load contributed by nonpoint sources. Based on this
evaluation, it may be possible for the Town to expand to 1.245 MGD if the Town offsets the increased nutrient
load with BMPs.
The speculative effluent limits for the Town of Pittsboro's potential expansion to 1.245 MGD (from 0.75
MGD) are attached with this letter. The nutrient limits listed are for your review only. The Division and the
Town, as well as the Town's consulting engineer(s), would need to have further correspondence to determine the
most feasible approach, should the Town choose to expand at the current location.
I would strongly encourage the Town to review any and all means to reduce the wastewater discharge.
This may include, but is not limited to, reuse of wastewater and acquisition of land for spray irrigation. My staff
investigated potential relocation sites for the Town's wastewater discharge, but could not determine a location
where effluent limits may be less stringent.

A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to

Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998. or subsequent versions or

versions. The tests will be performed during the months of'March, June, September, and December. Effluent

Test data shall be complete, accurate, include all supporting chemical/physical measurements and
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility
name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the
comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited
above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be
required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream. this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

regional office of DWQ, Roberson Creek has a drainage area of 10.3 square miles at the
discharge location, an S7Q 10 of 0 CFS, and a 30Q2 of .60 CFS.
In addition to the previous request to determine limits at a discharge flow of 1.245
MGD, we request you also model a total discharge of 3.0 MGD.

Long Range Growth Considerations:
Dear Mr. Montgomery:
The purpose of this letter is to update you and your staff and to provide
information on the four items referenced above.
1. Rgcl.assification of Treatment Plant
Effective April 1, 1999, the NC Administrative Code classifies all
activated sludge plants with permitted flows between .50 MGD and 2.5
MOD as Grade III facilitie, unless a biological nutrient removal (BNR)
process is utilized (your plant does not use BNR). Therefore, your plant
should now be a Grade III. The problem I have discovered is that
Department of Water Quality (DWQ) apparently does not have a plan in
place to officially notify the plants that will change classifications due to
the new rules. I have called both the NPDES Permit Unit and the
Certification Commission to inquire how the reclassification will be
accomplished, but I have not received an answer. I have drafted a written
inquiry on behalf of the Town (copy enclosed) that I will submit after you
have reviewed and approved same. Hopefully this will prompt DWQ to
officially notify the Town that the treatment plant is a Grade III.

allocation is a determination by DWQ of your permit limits at a flow

higher than your current permitted flow of .75 MGD. I recommend this
request bc made for a total flow of .1245 MGD (.495MGD above your
current permit) for the reasons explained in item 4 below.
I have drafted this request and enclosed a copy for your review. This
request must come from the Town rather than myself, so you will have to
have it typed on Town stationery, signed and mailed.
3. En ineerin Alter i fives A a 's Re ,o t
This report is required for all applications for new or expanding NPDES
discharge permits. The report must discuss and evaluate all possible
alternatives to the expanded discharge, determine the present worth of
each alternative, and rank the alternatives according to their present
worth.
The Engineering Alternatives Analysis is a detailed and somewhat
complex study when the applicant is a private entity considering a new
package treatment plant. In the case of a municipality seeking to expand
an existing discharge permit, the report may not bc as difficult or
detailed. Diehl & Phillips can prepare this Engineering Alternatives
Analysis for the Town on a time and material basis, with a not to exceed
contract ceiling of $9,000.00. The Analysis would be written for a .459
MGD expansion.
For expansion of existing permits, the alternatives analysis does not
normally require a detailed report by a soil scientist (to evaluate Iand
based treatment systems). If DWQ requires a soil scientist's rcport for
your alternatives analysis, this would be an additional expense above the
$9,000 ceiling. The Alternatives Analysis report would`require
approximately 2 to 3 months to prepare. DWQ will normally take 6-7
months to review it and resolve any questions they have. Once they.
decide whether or not to expand the permit, their decision must be
advertised. The public will have 30 days to comment, and DWQ will
review all comments. If there is substantial public objection, DWQ may
hold a public meeting to discuss the permit expansion. It may be 9 to 12
months after submission before the expanded permit is issued, assuming
DWQ supported the request and there was no substantial public objection.
4. n Range Grow sideration,
The discussion above has been based on a .495 MGD permit expansion
because the NC Administrative Code requires an Environmental
Assessment (EA) or an Environmental Impact Study (EIS) for expansions
of .50 MGD or greater. The time required to prepare an EA or EIS and to
have it reviewed and accepted can be a one to three year process. It may

involve detailed studies of the receiving team, including surveys of
fishes, plant life, fresh water mollusks, and other wildlife.
Assuming the Town will ultimately require more than 1.245 MGD of
wastewater treatment capacity, you and your Board should start to look at
a long range growth plan (if you haven't already). How big do you
envision the Town being, and what areas will it serve? Is the current
treatment plant location the best one when you consider how the Town
wiII grow?
I recommend the Town pursue the relatively "quick" .495 MGD permit
expansion. At the same time you should begin the long range planning process,
which will lead you to knowing how much capacity the sewer plant should
ultimately have, and where it should be located. You can then have the EA
prepared to support the plant that will ultimately be needed by the Town. Diehl
& Phillips has performed long range utility studies for other municipalities and
counties, and would be glad to further discuss this with you at your
convenience.

Pursuant to the recently revised 15 NCAC 8G.0301(e) and 8G.0302(c), we
hereby request the Town of Pittsboro's Wastewater Treatment Plant be
reclassified from a Grade IV to a Grade III Biological Water Pollution Control
System. The Town's treatment plant is a .75 MGD activated sludge process that
does not utilize biological nutrient reduction. We make this request on behalf
of our client, the Town of Pittsboro.
