I received a call from Kenny Batchelor, CEI with Volkert, regarding fill outside of permitted limits at
Permit Site 20 of I-5986B project. He also emailed me as well (see email below). Permit Site 20 only
impact wetlands for equalizer pipe installation; no stream impacts are associated. Please see
attached the photos taken by the CEI. The permit drawing for Permit Site 20 will be sent via another
email due to size constraints.

Jim and I met with contractor and CEI on site around 11AM this morning to address issue. We
discussed the importance of adequately surveying/staking out jurisdictional areas and using safety
fences to prevent such incidents from occurring. The impact area outside of permitted limits at
Permit Site 20 was approximately a 30’ by 15’ area of herbaceous wetland. Approximately 6.5 cubic
yards of fill was placed in the area. Laborers were already removing the fill by hand upon our
arrival. We told them to restore the area to original grade, rake, and plant with native wetland seed
mix and gently mulch afterwards. Photos following completion will be submitted. Let me know if

Attached are pictures of material placed in a wet land on the Harnett/Johnston I-95 project. This is
Permit Site 20. The pics labeled Y26 3 and Y26 4 show the PDE stakes. Any material beyond the
stakes would be beyond the permit limits. We have notified the contractor that this will have to be
removed. Please advise if this will need to be removed by hand or if equipment can be used. We
have also told the contractor that this will need to be reseeded with native seed.

If anything else needs to be done please let me know. We are currently waiting for your response
on how to proceed.
