Based on an April 18, 1996 letter from Mr. Jimmy Gordon. th, monitoring location for the North Fork Crooked Creek has been changed from 500 feet above the outfialI to 50 feet above the outfall. Effluent sheets have been modified to reflect this change. Please insert the enclosed effluent sheets and discard the old pages. This permit modification becomes effective immediately. All other terms and conditions in the original permit remain unchanged and in full effect. These modifications are issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. If this modification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. Stream samples shall be collected three times per week during June, July, August, and September and once per week during the remaining months of the year. ** The monthly average effluent BOD5 and Total Suspended Residue concentrations shall not exceed 15 % of the respective influent value (85% removal). *** The daily average dissolved oxygen effluent concentration shall not be less than 6.0 mg/1. **** Chronic Toxicity (Ceriodaphnia) P/F at 90%; February, May, August, And November, See Part III, Condition F. + Monitoring data will be reviewed for possible removal of these parameters after collection of 12 samples over a duration of at least 1 year.
