Dear Mr. Dyer:
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or as subsequently amended).
This final permit includes the following significant changes:
➢ A footnote has been added to the TRC limit stating that the requirements only apply if chlorine is used for
disinfection.
➢ A provisional limit has been added for selenium. Results from a PPA analysis submitted by this facility
showed a selenium value above state water quality standards. The facility will be required to perform
monthly selenium monitoring. If 12 consecutive monthly samples are below the detection limit for this
parameter, you may request to have the permit requirements removed. If no request is made, a selenium
limit will go into effect after 18 months (December, 2006).
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh,
North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements
to obtain other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit
that may be required.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of this
permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive
authority to operate and discharge from this facility arises under the permit conditions, requirements, terms, and
provisions included herein.
Union County is hereby authorized to:
1. Continue operation of an existing 1.9 MGD wastewater treatment system, consisting of
the following treatment units:
• 6 influent pumps
• Mechanical bar screen
• Manual bar screen (back-up)
• Dual oxidation ditches with six aerators
• Four circular secondary clarifiers
• Six high rate tertiary rapid sand filters
• Two chlorine contact basins
• Dechlorination
• Cascade post aeration system
• Five aerobic (mechanical) sludge digesters
• Supplemental alkalinity feed system
• One effluent pump station with three pumps
The facility is located at the Crooked Creek Wastewater Treatment Plant, Sardis Church
Road, off of SR 1515 in Union County.
2. Discharge treated domestic wastewater from said treatment works at the location
specified on the attached map through outfall 001 into North Fork Crooked Creek which
is classified C waters in the Yadkin -Pee Dee River Basin.

Footnotes:
1. Sample Location: E - Effluent, I - Influent, U - Upstream 50 feet from the outfall, D - Downstream Y4 mile below
discharge and at SR 1514. Upstream and Downstream samples shall be grab samples. In -stream samples shall
be collected three times per week during June, July, August, and September and once per week during the rest
of the calendar year. Instream monitoring is provisionally waived in light of the permittee's participation in the
Yadkin -Pee Dee River Basin Association. Instream monitoring will be immediately reinstated should the
permittee end its participation in the Association.
2. The monthly average effluent BOD5 and Total Suspended Residue concentrations shall not exceed 15% of the
respective influent value (85% removal).
3. TRC limit and monitoring requirement only apply if chlorine is used for disinfection.
4. The selenium limit will take effect on December 1, 2006. If 12 months of samples are below the detection limit,
the facility may request to have the limit and monitoring requirements removed from the permit.
5. Chronic Toxicity (Ceriodaphnia) P/F at 90%: February, May, August, and November (see Part I. A. (2.)).
6. The pH of the effluent shall not be less than 6.0 nor greater than 9.0 (on the standard units scale)
7. The daily average dissolved oxygen effluent concentration shall not be less than 6.0 mg/1.
8. Fecal Coliform shall be calculated using the geometric mean, according to the procedure detailed in Part II.
Section A, Paragraph 9b.
There shall be no discharge of floating solids or foam visible in other than trace amounts.

A (2). CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or
"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent
versions. The tests will be performed during the months of February, May, August, and November. Effluent sampling
for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit
limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as
described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or
subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest
concentration having no detectable impairment of reproduction or survival and the lowest concentration that does
have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection
methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic
Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the
pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the
following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days
after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility
name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the
comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited
above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be
required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

1. One effluent sample showed a selenium level of 6 ug/l. Since
there
is no dilution, that exceeds NC's 5 ug/1 criterion. Shouldn't the
permit contain a selenium limit?
2. recommend changing "total suspended residue" to "total suspended
solids".

Creek #2 WWTP (NC0069841). There are only a few minor comments. Please find
each comment below:
• On SUPPLEMENT TO PERMIT COVER SHEET description of existing
f ilities - there are six (6) influent pumps as opposed to six (6) influent pump
stations.
• On the SUPPLEMENT TO PERMIT COVER SHEET description of existing
facilities - There are currently only two (2) chlorine contact basins as opposed
6 three (3). One (1) of the basins is being converted to a ultraviolet reactor
under ATC Number 069841 A01.
• On the SUPPLEMENT TO PERMIT COVER SHEET description of existing
facilities -There is a supplemental alkalinity feed system, however, there is not
polymer feed system.
• On jhe SUPPLEMENT TO PERMIT COVER SHEET description of existing
ilities - there is one (1) effluent pump station with three (3) pumps as
opposed to two (2) effluent pump stations.
• Under section A. (1.) EFFLUENT LIMITATIONS AND MONITORING
REQUIREMENTS - there is no footnote for the discontinuation of Cl2 testing
ce we convert to UV disinfection. Is this the appropriate time to add a
footnote?
We have begun PPA , low level Hg analysis and second species toxicity
testing.

The EPA, Region 4, is in receipt of the draft permit for the above referenced facility.
The Form 2A application transmitted to the Region for review with the draft permit did not
include the minimum of three priority pollutant scans, as required by 40 Code of Federal
Regulations (C.F.R.) Sections 122.21(j)(4)(ii) and (vi). As such, it does not serve as a
complete permit application. Because the information provided is inadequate to determine
whether the draft permit meets the guidelines and requirements of the Clean Water Act, I
request that a complete permit application for this facility be submitted that meets the
requirements of 40 C.F.R. §§ 122.21(j)(4)(ii) and (vi). Pursuant to federal regulatory
requirements and language of Section VII.A. of the North Carolina/EPA National Pollutant
Discharge Elimination System (NPDES) Memorandum of Agreement (MOA), this letter
constitutes an interim objection to the issuance of this permit.
In accordance with the MOA and federal regulations, the full period of time for review
of this draft permit will recommence when the requested information is received by this

Also, North Fork Crooked Creek is 303(d) listed.
• Weekly average ammonia limits were added based on implementation of new ammonia
policy (6.0 mg/L summer, 12.0 mg/L winter).
2.0 Background Information
The Crooked Creek WWTP #2 is owned and operated by Union County Department of
Public Works. The facility maintains one outfall (001) with effluent generated from 100%
domestic wastewater. At one point the Crooked Creek WWTP #2 had a full pretreatment
program and two SIUs, however both industries have gone out of business. The pretreatment
program has been inactive since 1998.
North Fork Crooked Creek is 303(d) listed according to the 2002 Impaired Waters list.
The stream is impaired due to biological data, cause unknown. Potential sources are urban
runoff and storm sewers. The 2003 Yadkin -Pee Dee Basin Plan notes that problems with low
dissolved oxygen in North Fork Crooked Creek were thought to be contributing to impairment in
1998. Aquatic life and secondary recreation continues to be impaired in the stream.
At the time the draft permit was completed, Crooked Creek WWTP #2 had not yet
performed the required PPA and second species toxicity tests. The facility has scheduled the
necessary tests, however, and the final permit will not be issued until the data has been
submitted.

DMR Data Review
Average flows at The Crooked Creek WWTP #2 show the plant to be at approximately 60%
capacity with peak flows at 94% capacity. With the exception of BOD and TSS, the facility
appears to be operating within its permitted limits. BOD results are discussed in further detail in
the Compliance History portion of the fact sheet. A summary of effluent data for the 2001-2003
review period is summarized in Table 1, below.

The facility is a member of the Yadkin -Pee Dee River Basin Association. There are two
monitoring stations near the Crooked Creek WWTP #2: Q8386000 is approximately 1.5 miles
upstream at SR 1520 and Q8386200 is approximately 1 mile downstream at SR 1514. With the
exception of an increase in downstream conductivity, the facility does not appear to have an
instream impact.
RPA Analysis
An RPA was conducted for copper. The highest reported value over the past year was 14 µg/L-
twice the stream standard, however since copper is an action level parameter and the facility has
passed all WET tests, they will not receive a copper limit. The monthly monitoring requirement
will remain in this permit renewal.
WET Test Results
Crooked Creek WWTP #2 has passed all 17 WET tests conducted since January 2000.
Correspondence File Review/Compliance History
Crooked Creek WWTP #2 had five monthly average BOD violations from October 2002 through
June 2003. According to the Mooresville Regional Office, these incidents were the direct result of
excessive rainfall during this period of time. There was also one monthly average TSS violation
in January of 2003. Union County was fined a total of $6006.35 for these violations. DMRs
around that time period indicate that I/I and high levels of solids may have been a factor. Timely
digester "haul -outs" were delayed due to the land being too wet for solids disposal. Due to the
opinion of the Regional Office that the facility is well maintained, and the fact that Crooked
Creek has not been in chronic noncompliance with its permit conditions, no special requirements
will be added to the permit as a result of these violations.
