Tryon WWTP
Polk County
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
The following changes have been made to the final permit:
> • The chloride limit was erroneously included in the draft permit and has been removed. The monitoring
requirement has been returned to monthly, as in the previous permit. Chloride is an action level parameter
and should' only be limited if the facility is experiencing toxicity problems attributable to chloride; the facility
has passed all eleven of the WET tests performed since 2001.
➢ The TRC limit will become effective on August 1, 2005 - 18 months from the effective date of this final
permit, not 180 days as•stated in the draft.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required.

Town of Tryon

Tryon WWTP
East Howard Street
Tryon
Polk County
to receiving waters designated as Vaughn Creek in the Broad River Basin in
accordance with effluent limitations, monitoring requirements, and other conditions
set forth in Parts I, II, III and IV hereof.
This permit shall become effective February 1, 2004.
This permit and authorization to discharge shall expire at midnight on December 31, 2008.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of
this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the
exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements,
terms, and provisions included herein.
The Town of Tryon is hereby authorized to:
1. Continue to operate a 1.5 MGD wastewater treatment facility that includes

Notes:
1. The monthly average BOD5 and Total Suspended Solids concentrations shall not exceed 15%
of the respective influent value (85% removal).
2. The effluent daily average dissolved oxygen concentration shall not be less than 5.0 mg/L.
3. The total residual chlorine limit will take effect on August 1, 2005, 18 months after the
effective date of this permit.
4. Chronic Toxicity (Ceriodaphnia) P/F at 37%; tests shall be conducted in March, June,
September and December [see condition A. (2) for further details]. Chronic toxicity sampling
shall coincide with metals sampling.
5. U: upstream at least 100 feet from the outfall. D: downstream from the outfall, 50 feet
upstream of the Pacolet River. Upstream and downstream monitoring shall be conducted
three times per week in June, July, August and September and once per week during the
other months of the year.
There shall be no discharge of floating solids or visible foam in other than trace
amounts.

A. (2) CHRONIC TOXICITY PERMIT LIMIT (Quarterly)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or
significant mortality to Ceriodaphnia dubia at an effluent concentration of 37%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures
outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February
1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test
Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during
the months of March, June, September and December. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below all treatment processes:
If the test procedure performed as the first test of any single quarter results in a failure or
ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in
each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent
Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric
mean of the highest concentration having no detectable impairment of reproduction or survival and
the lowest concentration that does have a detectable impairment of reproduction or survival. The
definition of "detectable impairment," collection methods, exposure regimes, and further statistical
methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the
Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the
parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ
Form AT-3 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical
measurements and all concentration/response data, and be certified by laboratory supervisor and
ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be
measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity
monitoring is required, the Permittee will complete the information located at the top of the aquatic
toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the
month/year of the report with the notation of "No Flow" in the comment area of the form. The report
shall be submitted to the Environmental Sciences Branch at the address cited above.
Should the Permittee fail to monitor during a month in which toxicity monitoring is required,
monitoring will be required during the following month.
Should any test data from this monitoring requirement or tests performed by the North
Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may
be re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival, minimum control organism reproduction, and appropriate environmental
controls, shall constitute an invalid test and will require immediate follow-up testing to be completed
no later than the last day of the month following the month of the initial monitoring.

A. (3) EFFLUENT POLLUTANT SCAN
The Permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the attached table.
The analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently
sensitive to determine whether parameters are present in concentrations greater than applicable
standards and criteria. Samples shall represent seasonal variations. Unless otherwise indicated,
metals shall be analyzed as "total recoverable."

inoperable for more than 10 years (DISCONNECTED) (b) Aeroic digester is being used as
a sludge thickener and has been for approx 12 years, (c) Sludge drying beds out of
service for 13 years we've been land applying sludge since 1990's.
pg 5 (a) mercury needs to be changed from composite to grab (b) chloride limit needs

at further. Of the last 47 samples 20 would have been over the propsed limit. To my
knowledge we have no toxicity problem.

BACKGROUND
The Town of Tryon WWTP is a Class III facility with a permitted flow of 1.5 MGD. The permit was
originally issued on February 22, 1999 and expires on December 31, 2003. The last permit modification
was issued on March 26, 2001. The Permittee submitted EPA Form 2A on June 16, 2003 in order to
request renewal of the permit.
Since Tryon only has one Significant Industrial User (SIU) has a modified pretreatment program with the
Division of Water Quality's Pretreatment Unit and will continue to implement this program in the new
permit term. The facility has not requested any changes to the permit.
Over the course of this permit term, the facility has experienced a number of problems with mercury
compliance, which are discussed further in this Fact Sheet.
Instream Monitoring, Verification of Existing Conditions and DMR Data Review
This facility discharges to Vaughn Creek in subbasin 03-08-06 of the Broad River Basin. Vaughn Creek
is currently classified as C waters and is not on the 2002-303(d) list.
Tryon monitors for dissolved oxygen (DO), temperature, conductivity and fecal coliform instream. Plots
of upstream and downstream data from Discharge Monitoring Reports (DMRs) dating from January 2001
through July 2003 are attached to this Fact Sheet. Very little difference between upstream and
downstream was noted for dissolved oxygen and temperature and temperatures appear seasonally
appropriate. Fecal coliform levels were somewhat lower downstream as compared to upstream and were
frequently below 200 cfu/100 mL. Conductivity was elevated downstream as compared to upstream.
Effluent DMR data from January 2001 through July 2003 were reviewed. Data for conventional
parameters are summarized in Table I. The Permittee maintained compliance with the monthly average
permit limits for those parameters.
This facility also collects data for total nitrogen, total phosphorus, ammonia nitrogen (NH3-N), and total
residual chlorine. These are summarized in Table 2. Total residual chlorine is present at very high levels
in the effluent, well above the new water quality standard of 17 µg/L. Tryon will require dechlorination
in order to meet this new standard.

A review of the metals (from both the DMRs and Pretreatment data) data was also performed. These are
discussed in the Reasonable Potential Analysis section.
Correspondence
Prior to the year 2001, Tryon had a number of limit violations for mercury. There were 7 NOVs issued
from March to December of 2000. In a 2000 Performance Annual Report, the Permittee claimed that
mercury has been a problem since the NPDES permit issuance in 1994. The town was encouraged to use
clean sampling techniques for collecting mercury grab samples and in 2001 the Permittee requested a
permit modification so that mercury grab samples could be collected instead of composite samples. The
Permittee also required 3 dental offices to implement BMPs and use filters on their mercury containing
waste streams. Since 2001 no limit violations of any type have been reported.
In addition, a BIMS search revealed 6 monitoring violations for temperature over the two-year 2002/2003
period.
PERMITTING STRATEGY
Waste Load Allocation (WLA)
The Division prepared the last WLA for the previous permit renewal. The previous and current effluent
limits were based on guidelines and water quality standards. The Division has judged previous
parameters and limits to be appropriate for renewal with some exceptions. Changes to toxicant
monitoring are discussed in the Reasonable Potential Analysis section. An annual pollutant scan will be
added such that the Permittee can collect the necessary data required by EPA Form 2A throughout the
permit term. This condition is now standard on all major municipal permits in North Carolina.
Reasonable Potential Analysis (RPA)
The Division conducted EPA -recommended analyses to determine the reasonable potential for toxicants
to be discharged by this facility, based on DMR data from January 2000-May 2003. Calculations
included parameters listed in the previous permit and pre-treatment documents to include: arsenic,
cadmium, chloride, fluoride, lead, mercury, selenium, copper, and zinc.
Results suggest no reasonable potential for the facility to discharge arsenic, cadmium, fluoride, lead,
mercury and selenium. Monitoring for all except for fluoride and mercury may be eliminated from the
permit, as they are required parameters to be monitored through the Pretreatment Short Term Monitoring
Plan (STMP). Fluoride is not a required pretreatment parameter, so it cannot be eliminated from the
permit, but it can be reduced to a quarterly monitoring frequency. Due to the facility's problems with
mercury, it will remain in the permit at a monthly monitoring frequency.
Reasonable potential was demonstrated for chloride, copper, and zinc. Copper and zinc are action level
parameters, and would only be limited if the facility experienced consistent toxicity problems attributable

to copper and/or zinc. Since the facility has only failed three toxicity tests in the past five years, monthly

SUMMARY OF PROPOSED CHANGES
In keeping with Division policies, the following will be incorporated into the permit:
• Annual pollutant scan
• Elimination of the cadmium, lead, arsenic, and selenium monitoring requirements (Permittee
will continue to monitor these parameters through the STMP).
• Reduced monitoring requirement for fluoride (from monthly to quarterly)
• Eliminate mercury limit, reduce monitoring to monthly (from 2/month)
• Add chloride limit, increase monitoring to weekly (from monthly).
New Weekly Average and Daily Maximum limits are derived from the latest NC/EPA policies
considering '/z FAVs and allowable concentrations based on reasonable potential.

Reference is made to our conversation on January 15, 2003, concerning the schedule
to conduct the additional testing required for the NPDES Permit renewal at the Tryon
wastewater treatment plant. The requirement was for four (4) separate quarterly toxicity
test using two (2) different species and for two (2) priority pollutant analyses to be done
with seasonal variation. We had discussed moving your regular schedule forward a
month in order to get sample results back in time to meet the July 31, 2003, permit
renewal deadline.
On January 16, 2003, I discussed this change in schedule at length with Mr. Kevin
Bowden in the Division of Water Quality's Aquatic Toxicology Unit, who in turn
discussed it with Mr. Charles Weaver in the NPDES Unit. They suggested that you stay
on your current permitted schedule and conduct your samplings in March and June for
the toxicity and priority pollutant analysis. They stated that the June data could be
submitted after the NPDES Permit application deadline and it would not be a problem.
So, continue on as you have been doing and we will send them the June data as soon
as we get it back from the lab.
Mr. Bowden, also, stated to continue to send in all toxicity data to his group as you have
in the past. He said he had the September data, but had not received December.

For the NPDES Permit renewal package, all I will need to submit with the application to
the NPDES Unit will be the toxicity data on the fathead minnows and the priority
pollutant data. You do not need to send me the data on the Ceriodaphnia.
I enjoyed our meeting yesterday and the tour of the facilities. I hope this clears things
up. Feel free to give me a call if you should have any questions or require any
additional information.
