The applicant is requesting to add 9 shore perpendicular docks, 18 slips total with 16 individual boatlifts and maintenance excavation along the old Showboat Hotel property (10 existing slip areas)which would accommodate the previously permitted bulkhead and 8 residential (16 living units) buildings. The previous land use was the Showboat Hotel that had several docking facilities along the property. The hotel has been removed and remnants of the Field Investigation Report: Showboat Investments, LLC do The Cullipher Group, PA Page 02 docks remain. The property has a permit history as follows: CAMA Major Permit 62-95 expired CAMA Major Permit 4-22 issued 1/26/22 NCDOT D022-0016-00095 issued 12/6/2021 PWS 21-01059 issued 12/20/2021 EO22-16-21-00413 issued 12/8/2022 DEQ Stormwater submitted on 1/12/2022 9. Project Description The project property was formerly developed with a hotel (the Showboat HoteI), paved parking lot, pool, boat ramp, bulkhead, and 10 slip docking facility. The property is located adjacent to the man-made canal to the east and is also contiguous with Bogue Sound, in Atlantic Beach, Carteret County. The property is bordered on the north by vacant commercial property (formerly the Channel Marker Restaurant) and on the South by a vacant commercial parcel and on the west by the Atlantic Beach Causeway. This property was previously developed for commercial use as a hotel. The existing drainage ground surface flow was into Bogue Sound. The existing building, pool, septic system, and parking lot have been razed and removed. There is an existing dilapidated bulkhead, boat ramp, and remnant dock structures and mooring pilings remaining on the property and within the property's riparian area. There was a previous CAMA Major Permit No. 62-95 (expired) issued for the docks and piers and an Express Major Permit 4-22 issued for bulkhead replacement and upland re-development. The elevation of the high ground of the parcel is approximately 2.5' to 4.0' above the normal high water (NHW). There is no vegetation on the tract. The 1.334-acre tract has approximately 470 linear feet of continuous shoreline, approximately 150' of that shoreline borders along the man-made canal waterway within the project site. The narrowest canal width adjacent to the southern end of the property is approximately 161' feet across and then open to Bogue Sound at the northern end of the property. There are no coastal or non-coastal wetlands within the project area. This area is designated as Urban Waterfront and is located within the Division of Water Resources White Oak River Basin area. The waters of Bogue Sound in this area are classified as SA; HQW. There is not a cultural resource within the project property. These waters are not classified as a primary nursery area and submerged aquatic vegetation is not present at this location. This area is closed to shellfish harvest. There is a federally designated channel that is parallel to the property shoreline and is within approximately 47' of the federal channel setback on the south end of the property, within approximately 26' of the channel setback near the northern end of the property and 22'at the most northern portion of the property. There is an easement agreement for a submerged land claim appurtenant to and that runs with the adjacent riparian or littoral land for this property for the existing docks Field Investigation Report: Showboat Investments, LLC c/o The Cullipher Group, PA Page 03 and piers lying over the state-owned submerged lands in Bogue Sound that is valid until April 23, 2050. The project area is found by turning off Highway 70 East in Morehead City (Arendell Street) onto the on-ramp for Atlantic Beach. Follow the Atlantic Beach bridge southward across Bogue Sound onto the Atlantic Beach Causeway. The project location is .11 mile on the left (east). The property is permitted for upland re-development through CAMA Major Development Permit 4-22. The property shoreline is stabilized with a vinyl sheetpile bulkhead that was previously permitted 5' above NHW to raise the elevation of the finished grade to a proposed 7' NHW elevation bringing the site up to the base flood elevation(AE 7). The previously permitted bulkhead was constructed two feet waterward of the existing bulkhead. The gap between the bulkheads was back-filled with clean earthen material. The bulkhead structural tie-back work corridor would be approximately 10-12' landward measured from the proposed bulkhead. The bulkhead was constructed with a shore-parallel, 6' wide x 425' long slatted boardwalk at grade level. The narrowest point between existing bulkheads within the manmade canal located along the southern portion of the project property measures approximately 161' in width. The existing bulkhead would vary from the western edge of the federal channel setback anywhere from 23'- 67'. Potable water would be provided by the Town of Atlantic Beach via a two-inch extension. The previous use as a hotel had several existing docking facilities. Through the authorized re- development, the existing docks would be removed before construction of any new docking facilities. 10. Proposed Project The applicant is proposing 9 shore perpendicular docking facilities, 18 slips (total) with 16 boatlifts, six tie pilings, side—too floating pier with a floating "day dock" platform and maintenance excavation. The proposed slips (1A and 1B) located along the southern portion of the property and within the "cutout" area, would be 19.5' x 50' wet slips with tie pilings and a shared finger pier. Slips 2A, 2B. 3A and 4B would be 16.5' wide x 38' long, would have six 16' x 16' boatlifts, two 6' x 40' shore perpendicular piers and one 6' x 38' pier. Slips 5A and SB would be 14.5' wide x 32' long, have two 12' x 12' boatlifts and one shore perpendicular pier. The remaining slips (Slips 6A, 6B, 7A, 7B, 8A, 8B, 9A and 9B) would be 12' wide and depending on location would be 26' long, 28' long, 30' long or 32' long and would have eight 12' x 12' boatlifts, one 6' x 32' pier, one 6' x 30' pier, one 6' x 28' pier and a final 6' x 26' pier. The final portion would be a floating shore parallel pier along the northern section of the parcel, that would attach via gangway to a 16' x 22' floating "day dock" platform. The USACOE channel setback is the limiting factor along this parcel (22' to 67' depending on location) however the '/4 rule is as well. The canal has a width 161' at the most constrictive point and a width of 186' within the "indented area at the most southern portion of the parcel. All measurements were field verified. The 1/4 rule would limit dock length to a maximum of 47' from nhw (bulkhead) within the "indented" area' from NHW. The Field Investigation Report: Showboat Investments, LLC c/o The Cullipher Group, PA Page 04 applicant is showing a maximum length of 50' from nhw. The proposed development within this area would remain within the existing dilapidated docks footprint. The remaining proposed development would be limited to a 1/4 distance of 40' from nhw (existing bulkhead). Waivers were obtained from both adjacent neighbors to encroach within the 15' setback. Boat size would be limited to 24' to 50' depending on the slip and would be of open runabout, sailboat, power boat and sport fishing design. The applicant is also proposing maintenance excavation within the proposed slip areas. The excavation area would be 29' wide x 350' long and has an average depth of -3.25' nlw. The connecting depths are 5' plus and the final depth for the excavation area would be -4' nlw. A total of 282 cubic yards of material would be removed. 11. Anticipated Impacts: The development would shade 1,800 sf and incorporate 18,669 sf of shallow bottom habitat. The proposed docking facilities would not interfere with navigation and would meet the %4 width rule and not extend into the channel portion of the canal and Bogue Sound. The excavation has the potential to cause temporary turbidity but would not exceed a final depth of -4' nlw within the proposed slip areas.
