Dear Mr. Brogdon:
The Division of Water Quality has completed the review of the Tax Certification request
for real and personal property for the Clear Path Recycling LLC Facility's Wastewater
Treatment Plant. The Facility and WWTP is located at 3500 Cedar Creek Road southeast of
Fayetteville NC 28302 in Cumberland County. Clear Path recycles plastic bottles. Clear Path's
wastewater is treated and is discharged to DAK Americas on the same/adjacent industrial site.
Water Quality Permit information for Clear Path and DAK Americas is noted here for
reference. Wastewater from DAK Americas is discharged under NPDES Permit No.
NC0003719 issued by NC-DWQ to DAK Americas on 9/19/2011 effective from 12/1/2011 to
10/31/2016 with discharge outfall pipes to the Cape Fear River. DAK Americas also holds
Permit No. WQ0022581 for the Wellman Sanitary Sewer Lift Station and 12" Force Main which
discharges wastewater into the City of Fayetteville Public Work Commission (PWC) Sewer
Collection System (Permit No. WQ0020597) and is subsequently conveyed to PWC Fayetteville
Rockfish Creek Wastewater Treatment Facility (Permit No. NC0051105). DAK Americas
previously held a Pretreatment Permit No. 2116RF issued by PWC Fayetteville Permit, which
was replaced by their NPDES Permit in December of 2010.
The Wastewater Treatment Plant was inspected for Tax Certification purposes on
3/22/2013. This Wastewater Treatment Facility had previously received Tax Certification on
5/15/2011 from the Division of Waste Management.

Tax Certification requires continued compliance with all Division of Water Quality
and local Pretreatment Permits as applicable. Should compliance not be maintained please
notify the DWQ Regional Office, this office, and your county Tax office immediately. The
WWTP Operator in Responsible Charge (ORC), says that the plant is compliant with their
permits. The facility is inspected by DWQ Fayetteville Regional office staff and PWC
Fayetteville staff for compliance purposes as applicable.
A copy of your Tax Certificate and Inspe..ction Determination Form are attached to this
letter. Copies are also being sent to the County Tax Office. During the inspection and review it
was determined that items listed on your application being used exclusively for Wastewater
Treatment are eligible to receive tax certification, with the following exceptions; ITEM #20 does
not Qualify for Tax Certification because it is no longer present or part of the treatment process.
Please note that as part of this Tax Certification process, the inspector did not make any
efforts to confirm either the cost of the items certified, the year of acquisition, if items have
received other Tax Certifications from Air Quality, Solid Waste, or other agencies, or if items
that have been previously been listed for Wastewater Treatment Tax Certification are still
present and operational.
For future Tax Certifications please provide a list of all properties and assets for which
you currently have or want Wastewater Tax Certification, a copy of previous Tax Certifications,
a flow schematic of your WWTP showing items numbered, and a statement of compliance with

The Division of Division of Water Quality inspected these wastewater treatment facilities and
equipment on 3/22/2013. As of this date, based on the inspection and information supplied by the
applicant the equipment and facilities listed on the attached application that meet the following
requirements for Tax Certification are eligible.
1. The property has been, or will be, constructed or installed;
2. The property complies with, or if still under construction will comply with, the
requirements of the EMC,
3. The property is being effectively operated, or will when completed be required to operate,
in accordance with the terms and conditions of approvals issued by the EMC; and
4. The listed property has, or when completed will have, as its primary rather than incidental
purpose the reduction of water pollution resulting from the discharge of sewage or waste.
Items listed that are NOT eligible for Tax Certification are item # 20 which is no longer present.
Please note that as part of this Tax Certification process, the DENR-DWQ staff did not make any
