Noland, Regional Supervisor Fayetteville Regional Office' SUBJECT: Request to Eliminate a Downstream Sampling Point, Monsanto Company, Fayetteville f.' NPDES Permit No. NC0003719 A request was submitted by the Monsanto Company in Fayetteville, North Carolina for the elimination of one of the two downstream sampling points contained in their NPDES Permit No. NC0003719. The downstream sampling point Monsanto is requesting to eliminate is the sampling point on the Cape Fear River that is located closest to the facilities outfall. To obtain samples at this location, Monsanto had been using the abandon conveyor belt/bridge owned by the Becker Sand & Gravel Company. Recently the Becker Sand & Gravel Company dismantled the conveyor belt due to the high hazardous liability insurance cost Becker was going to incur if they allowed the bridge to remain in place. The staff of the Fayetteville Regional Office and Monsanto officials evaluated alternative sampling locations to replace the Becker bridge site, however no other access private or public could be found that would give good representative sample data and assure safety to those involved in obtaining the samples. Therefore, it is the recommendation of the Fayetteville Regional Office that a Permit amendment be issued to the Monsanto Company which allows only one downstream sampling point requirement. WATER SECTicf,�L/Ty • The criterion set forth in the above referenced permit, granted to Monsanto Ag. Co. since October 1987, requires sampling of the Cape Fear River on a 4 times per month per sample basis. This is done on each of the two downstream samples, as well as one upstream sample, taken at the stipulated lotions in the NPDES permit. Over the years Monsanto has continued to comply with the above requirements successfully. Recently, however, one of the downstream samples closest to Monsanto's outfall, referenced as Becker Sand and Gravel location, cannot be accessed due to a high sampling hazard identified and posted as a sign by Becker Sand and Gravel Co. During the month the existence of this hazard has been brought to our attention by our own sampling consultant. This sample has been procedurally grabbed while standing on an abandoned suspension bridge. This bridge was originally used by Becker Sand and Gravel Co. to transport their material across the river by using the conveyor belt system built on this bridge. This conveyor system. was abandoned sometime ago; however, .bridge remained somewhat accessible. At present any access to this bridge is not permitted as per the sign posted by the Becker Sand and Gravel Co. to prevent any mishap or injury. There appears to be no other viable alternative to sample the river around this location while insuring a representative sample. In view of this situation and based on the quality of river water on the two downstream samples, which continue to be well within the stated requirements, Monsanto Ag. It is recommended that this request be granted. This means only the station located just upstream of Lock and Dam #3 will be sampled. It should be noted that this WLA fact sheet is for the 002 pipe only. After consulting with Matthews (Aquatic Toxicology), it is recommended that the facility be required to implement a quarterly, 24-hour acute toxicity test using Fathead Minnows. Since the last permit was issued, this has become standard procedure for issuing toxic limits for facilities with IWC < 0.25%. Facility Name 14'156t`1 ra Permit # /t/000057( 9 ACUTE TOXICITY TESTING REQUIREMENT (QRTRLY) Fathead Minnow 24 hr.- No Significant Mortality The permittee shall conduct acute toxicity tests on a guarterLv basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration". The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test, using effluent collected as a 24 hour composite. The effluent concentration at which there may be at no time significant acute mortality in any two consecutive toxicity tests is 90% (defined as treatment two in the North Carolina procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The first test will be performed after thirty days from issuance of this permit during the months of f �1-2. 4' v , U t 9cJ . All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR.-1) for the month in which it was performed, using the parameter code TGE6C. Box 27687 Raleigh, N.C. 27611 • Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any. test data from either these monitoring requirements or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting(within 30 days of initial monitoring event).
