REQUEST FOR MORE INFORMATION
Dear Mr. Veit:
On July 31, 2006, the Division of Water Quality (DWQ) received your revised application dated July 3,
2006, to impact 720 feet of perennial stream and an undisclosed amount of Zone 1 Neuse River protected
riparian buffer and Zone 2 Neuse River protected riparian buffer [actually the buffer impacts would be
43,200 square feet of Zone 1 Neuse River protected riparian buffer (720 linear feet x 30-foot wide buffer
on both sides of stream), and 28,800 square feet of Zone 2 Neuse River protected riparian buffer (720
linear feet x 20-foot wide buffer on both sides of stream)] to construct the proposed piping of an onsite
stream. The DWQ has determined that your application was incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore, unless we
receive five copies of the additional information requested below, we will have to move toward denial of
your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete
until we receive this additional information. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. Please submit a mitigation plan for the stream and buffer impacts. Please be aware that
approximate mitigation costs for this project as currently proposed, and assuming payment to the
NCEEP and stream mitigation at a ration of 1:1, would likely be the following:
Stream mitigation at a cost of $219/linear foot x 7201inear feet of stream = $157,680
Buffer mitigation at a cost of 43,200 square feet Zone 1 x 3 (ratio) x 0.96 (mitigation
cost/square foot = $124,416
Buffer mitigation at a cost of 28,800 square feet Zone 2 x 1.5 (ratio) x 0.96 (mitigation
cost/square foot = $41,472
2. Please clearly indicate Zone 1 and Zone 2 buffers, and impacts to these, on the site plan.

3. Please indicate diffuse flow measures on the site plan.
4. You will need to apply for a Major Variance for impacts to the buffers as proposed. Your
application for a Major Variance will initially be reviewed by the Water Quality Committee of
the Environmental Management Commission (EMC), and then the full EMC.
Please contact the DWQ within three weeks of the date of this letter to verify that you have received this
letter and that you remain interested in continuing to pursue permitting of your project and will be
providing the DWQ the requested information at a later date. Please contact me in writing and Kyle
Barnes of the DWQ Washington Office. If we do not hear from you within three weeks, we will assume
that you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
