Dunn, Coastal Region Coordinator —� Habitat Conservation Program DATE: April 28, 2014 SUBJECT: Pre - Construction Notice for Abbington Oaks, Brunswick County, North Carolina. DWR project No. 20140266 Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the application with regard to impacts of the project on fish and wildlife resources. The project site is located near Jump and Run Creek near the intersection of NC 211 and NC 133 in Southport, NC. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Clean Water Act of 1977 (as amended). The applicant proposes to construct residential apartments on a 7.00 acre tract of land that contains 0.536 acre of wetlands, of which 0.141 acre is proposed to be filled under a NWP 14. The fill is proposed to allow two road crossings, one of which is at the turn into the parking area. The project location is near Jump and Run Creek and its associated wetlands within the Cape Fear River Basin. NCWRC has reviewed the application package and requests additional information prior to being able to complete our review. Our records indicate the proposed project area is in the vicinity of known red - cockaded woodpecker (Picoides borealis) activity. It is important to determine if there are any active cavity sites within the project area or if the project area overlaps the buffer of a nearby cavity site. To make this determination, a survey should be conducted and the results provided. Additionally, the Venus flytrap (Dionaea muscilnda) has been recorded near the project site. We recommend that any Venus flytraps that may be seen, be avoided and reported to the North Carolina Natural Heritage Program at (877) 623 -6748.
