Description of Activity: This letter is the result of a visit to Your property on 4/26/2022, where the extent of the permit non- compliance in waters of the US was determined. The permit non-compliance located on your property include the following: 1) Deposited runoff sediment, in some cases several inches thick, was found within the streams and wetlands within Permitted impact areas Wl-W3 and Sl-S2. We understand that much of the unstable sediment in these areas is the result of activities related to a City of Greensboro water line installation along Summit Avenue. However, there was evidence of sediment entering Stream CH 100 and Wetlands WL 1000 and 1100 between authorized impact sites from the SL Reedy Fork, LLC construction site, including some areas with deposition of construction run-off between 4 and 8 inches thick; 2) Sections of stream channel and adjacent wetlands, one just below Impact S4 and another approximately 220 feet east of Impact W5 (see attached marked -up plansheet and pictures) are nearly full of sediment, and appears to have had shredded leaves scattered over the top, perhaps in an effort to conceal the issue. This sediment deposition continues downstream for at least several hundred feet; 3) Per Permit Special Condition 5, groundwater base flow below the authorized impact limits at Impacts W4 and S4/W5 must be maintained ner the filtered trench drains as shown on Permit Figure 6: there was no field -based evidence that these features were installed as required. Any additional work in waters or wetlands in non-compliance with this permit may be considered an intentional violation of federal law. We hereby request you take the following actions to resolve this matter: Within 30 days of the date of this correspondence, a. Based on emails sent between NCDWR and Mr. Doug Keesee, it is or understanding that all sediment and erosion control items listed by NCDWR, including removal of sediment from streams and wetlands, has been completed. Please provide labeled pictures showing this completed work, ensuring that areas referenced by items 1 and 2 above are resolved; b. Address item 3 above. If these filtered trench drains have been installed, please provide labeled pictures showing their outlets into the wetland/stream at the authorized limits of Impacts W4 and S4/W5. If these features have not been installed, please provide a timeline for their installation; c. Provide an as -built survey showing the current farthest (most downstream) extents of the toe of slope (including any silt fence or associated rip rap/rock outlets) in the vicinity of permitted Impacts W4, S4/W5, and W6, overlaid on the Corps approved Wetland/stream delineation. Failure to comply with this request may result in referral of this case to the United States Attorney. Violations of the Clean Water Act can result in administrative penalties, civil penalties of up to $27,500 per day of violation, criminal fines or imprisonment.
