This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on October 27, 2004. The pH of the effluent shall not be less than 6.0 nor greater than 9.0 (on the standard units scale). 6. Chronic Toxicity (Ceriodaphnia) at 44%: Feb, May, Aug, Nov (see Part I. A. (2.)). 7. Sample collected three times per week during June 1 through September 30 and once per week October 1 through May 31. There shall be no discharge of floating solids or visible foam (other than trace amounts) in the effluent, unless ambient river conditions prevent compliance. Permit Number: NC0023981 A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 44%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of February, May, August, November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised - February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. COMPLIANCE SUMMARY: DMRs have been reviewed for the period January 2001 through September 2004. The facility has a negative compliance record. A compliance evaluation inspection conducted on May 4, 2004 found that the facility is well kept and is in compliance. INSTREAM MONITORING: Instream monitoring is required for temperature, dissolved oxygen, fecal colifomi, and conductivity. An analysis of DO, temperature and conductivity data showed that the facility may has no noticeable negative impact on stream water quality (table is attached). PROPOSED CHANGES: • MoratoringFnquerxi s: Monitoring for cadmium has been reduced to 2/Month due to the elimination of the limit. • Limi Based on the Reasonable Potential Analysis, the limit for cadmium has been eliminated. In addition, weekly average limits for ammonia nitrogen have been added to the permit. • Priority pollutant monitoring on an annual basis has been added to fulfill the permit application requirement in the future. The current permit expires on February 28, 2005. There have been no major changes at the facility since issuance of the last permit (effective date June 1, 2001). However, due to numerous operational problems, the dissolved air flotation tank (DAF) has been taken out of service. Sludge is thickened by turning off the return sludge pump. The thickened sludge is pumped directly from the bottom of the clarifier to sludge holding tank. Under normal operation the sludge holding tank has mixing provided (no aeration in this process). This sludge is mixed with sludge transported from the Lenoir Water Plant (alum sludge) and from the Gunpowder Creek WWTP. The Lower Creek WWTP Biosolids Facility is a "Class A" sludge treatment facility, which currently utilizes lime stabilization and pasteurization processes. Sludge from the holding tank is pumped onto a belt press at approximately 2% solids content. The press discharge is about an 18% solids cake. This sludge cake is augured into a thermoblender, where quicklime is fed and heat is applied. After this heating and mixing step, the product drops into the pasteurization vessel, where it is heated to at least 158°F for thirty minutes. The final product, called "Lenoir Blend" is conveyed to a dump truck, which dumps the biosolids onto a storage pad. Lenoir Blend is given to local farmers or is spread directly onto their fields by city personnel and city spreader truck. Sludge analysis on this final product is generally conducted four times per year, and includes nutrients, metals and fecal coliform bacteria. With the exception of effluent lead values (current permit limit — 33.8 pg/L daily maximum) during the July 2003 — June 2004 period, the plant has been reasonably compliant. Revamping the chlorination system in the plant solved the fecal coliform problems during August and September 2003. We have been working with the State Pretreatment Unit to help resolve the source of lead. However, we have found no significant source of lead contribution within industrial users, contributing sewer lines or plant recycle flows. Operating the plant at lower MLSS seems to be the only hope of reducing effluent lead. So far this year (2004) we have been successful in reducing MLSS in half (see attached chart and graph), but effluent lead values have not changed drastically (Note: The ideal MLSS during summer months should be around 1500 mg/L, about 60% of our current values). We are planning on expanding the "Class A" biosolids treatment during the 2005-2006 fiscal year, which should give us more flexibility in basin solids level control. We trust that the permit limit issued for lead for the upcoming permit will be as liberal as possible, while still protecting the water quality of Lower Creek and the Catawba River.
