Dear Anthony Sydes:
The DWR performed an onsite visit with the City of Jacksonville's Stormwater Manager Pat Donovan -Brandenburg and
Project Manager Andy Bourland. Multiple non -compliant stream crossings were documented during the visit. This
project has not applied for temporary or permanent stream impacts. These crossings were discussed with David Banks
who was on site and acknowledged the impacts. David assured the DWR and the COJ that he was capable of removing
crossings. David was informed that mechanical means are not be used in the stream channel as these are blue line
streams, also heavy equipment is not allowed within the wetlands to remove these crossings. Since these crossings were
created during the timbering phase of the project and were not part of the designs of the project, DWR and the City not
townTown of Jacksonville agreed to allow 90 days to remove the crossings and restore the areas back to their original
condition. After the 90 days that were agreed upon, if the streams in question are not restored the Division will issue a
Notice of Violation. The 90 days started upon Jacksonville's issuance of the Erosion & Sedimentation Control Inspection
Report that was deemed non -compliant on March 02,2022. These temporary impacts will be discussed with the Army
Corps of Engineers and may increase the cumulative impacts of this project.
