Dear Mr. Cutler:
This letter is in response to a request from your consultant Thomas Howell, III, P.E. of Rivers &
Associates, Inc. for speculative effluent limits for a proposed expansion from 3.2 MGD to 3.65 MGD
and 4.6 MGD. We have reviewed the request and provide the following response with the enclosed
speculative limits.
The speculative limits presented here are based on our understanding of the proposal and of present
environmental conditions. The Division of Water Quality (DWQ) cannot guarantee that it will issue the
Town an NPDES permit to expand its discharge of treated wastewater into waters of the State. Nor can
we guarantee that the effluent limitations and other requirements included in any permit will be
exactly as presented here. Final decisions on these matters will be made only after the Division
evaluates a formal permit application for the Town's discharge and notices the proposal for public
comment.
Environmental Assessments of New Projects and Expansions
Please be aware that you will have to evaluate this project for environmental impacts before applying
for a permit modification. Anyone proposing to construct new or expanded waste treatment facilities
using public funds or public (state) lands must first prepare an environmental assessment (EA) when
wastewater flows (1) equal or exceed 0.5 MGD or (2) exceed one-third of the 7Q10 flow of the receiving
stream. DWQ will not accept a permit application for a project requiring an environmental assessment
until the Division has approved the EA and sent a Finding of No Significant Impact (FONSI) to the
state Clearinghouse for review and comment.

Based on the available information, tentative limits for the proposed discharge of 3.65 MGD and 4.60
MGD flow to the Tar River are presented below. At this time the Division does not anticipate any
significant changes to the Town's existing 3.2 MGD permit upon renewal.

Acute Toxicity Pass/Fail @ 90% with Pimephales promelas
Flow Limits. The flow will be limited to 3.65 and 4.60 MGD as requested by the consultant. This limit
will be applied as a monthly average.
BOD5 and NH3-N. Limits for these oxygen consuming wastes are based on maintaining existing
permitted mass load.
TSS. The limits for total suspended solids are standard for secondary treatment of municipal
wastewater.
Fecal Coliform, pH. The limits for fecal coliform bacteria and pH are derived to protect water quality in
the receiving stream and remain the same as the existing permit.
Chlorine. The Division requires chlorine limits and dechlorination for all new or expanding
dischargers proposing the use of chlorine for disinfection. The process of chlorination/dechlorination,
or an alternate form of disinfection such as ultraviolet radiation, should allow the facility to comply
with the total residual chlorine limit.

Acute Toxicity Testing. Acute pass/fail toxicity testing at 90% with Pimephales promelas will remain a
condition of the NPDES permit for waste flows of both 3.65 and 4.60 MGD. Quarterly monitoring will
be required. We will perform a complete evaluation of limits and monitoring requirements for metals
and other toxicants when we review the City's formal permit application.
Total Phosphorus, Total Nitrogen. Speculative limits on total phosphorus and total nitrogen have not
been included at this line because the Town is participating in the nonpoint source trading option
outlined in the Tar Pamlico NSW Implementation Strategy. If compliance with any element of this
strategy, or subsequent approved revisions to the strategy, is not maintained, the Division reserves the
right to include nutrient limits in any NPDES permit issued to the Town.

the City of Washington and designing a wastewater treatment plant upgrade. The current
permitted flow is 3.2 mgd. The proposed Phase I Improvements flow would be 3.65 mgd in 2-5
years. The proposed Phase II improvement flow would be 4.50 mgd in 5-10 years.
