Dear Mr. Waters:
Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended) .
The following modifications from the draft permit are included in the final permit:
• Section A. (4.) in the draft permit contained the chronic toxicity language instead
of the acute toxicity language. The correct language was included in the permit.
• The description of the treatment system was corrected to read "four clarifiers"
instead of "five clarifiers".
• The total residual chlorine limit was corrected to read 28 µg/ L instead of 28 g/L.
If any parts, measurement frequencies or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and
filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and
binding.
Please note that this permit is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the permit. This permit
does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal
Area Management Act or any other Federal or Local governmental permit that may be
required.

This permit and authorization to discharge shall expire at midnight on November 30, 2009.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under
the permit conditions, requirements, terms, and provisions included herein.

Upon initiation of stream sampling by the Tar -Pamlico Basin Association, the instream monitoring
requirements as stated above are waived. Should your membership in the Association be terminated, you
shall notify the Division immediately and the instream monitoring requirements specified in your permit
shall be reinstated.
A. (3.) NUTRIENT SPECIAL CONDITION
Nutrient limits have not been included at this time because the facility is participating in the non -point
source trading option outlined in the Tar -Pamlico NSW Implementation Strategy Phase II; which was
adopted December 8, 1994 or subsequent approved revisions of the strategy. If compliance with any
element of this strategy or approved revision is not maintained, the Division reserves the right to reopen
this permit to include nutrient limits. If requirements other than those listed in this permit are adopted as
part of a revision of the strategy, the Division reserves the right to reopen this permit to include these
requirements.
A. (4.) ACUTE TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY)
The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North
Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A
Single Effluent Concentration" (Revised July, 1992 or subsequent versions). The monitoring shall be
performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent concentration at
which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure
document). Effluent samples for self -monitoring purposes must be obtained during representative effluent
discharge below all waste treatment. The tests will be performed during the months of February, May,
August and November.

All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code
TGE6C. Additionally, DWQ Form AT-2 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of
the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the
waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the report
with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the
Environmental Sciences Branch at the address cited above.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring
will begin immediately until such time that a single test is passed. Upon passing, this monthly test
requirement will revert to quarterly in the months specified above..
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly
test requirement will revert to quarterly in the months specified above.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened
and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will require
immediate follow-up testing to be completed no later than the last day of the month following the month
of the initial monitoring.

A. (5.) EFFLUENT POLLUTANT SCAN
The permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the table below
(in accordance with 40 CFR Part 136). The annual effluent pollutant scan samples shall represent seasonal
(summer, winter, fall, spring) variations over the 5-year permit cycle. Unless otherwise indicated, metals
shall be analyzed as "total recoverable." Additionally, the method detection level and the minimum level
shall be the most sensitive as provided by the appropriate analytical procedure.

NOTIFICATION OF INTENT TO ISSUE A NPDES
WASTEWATER PERMIT
On the basis of thorough staff review and application
of NC General Statute 143.21, Public law 92-500 and
other lawful standards and regulations, the North Caro-
lina Environmental Management Commission proposes to
issue a National Pollutant Discharge Elimination System
(NPDES) wastewater discharge permit to the person(s)
listed below effective 45 days from the publish date of
this notice.
Written comments regarding the proposed permit will
be accepted until 30 days after the publish date of this
notice. All comments received prior to that date are con-
sidered in the final determinations regarding the proposed
permit. The Director of the NC Division of Water Quality
may decide to hold a public meeting for the proposed
permit should the Division receive a significant degree of
public interest.
Copies of the draft permit and other supporting infor-
mation on file used to determine conditions present in
the draft permit are available upon request and payment
of the costs of reproduction. Mail comments and/or re-
quests for information to the NC Division of Water Quality

Dowry Creek Community Association, Inc. (PO Box 711,
Belhaven, NC 27810) has applied for renewal of NPEDS
permit NC0068426 for Dowry Creek WWTP in Beaufort
County. This permitted facility discharges 0.05 MGD
treated wastewater to Pungo River in the Tar -Pamlico River
Basin. Currently BOD, ammonia nitrogen, total residual
chlorine, enterococci, total nitrogen and total phospho-
rus are water quality limited. This discharge may affect
future allocations in this portion of the Tar -Pamlico River
Basin.

Summary: The City of Washington submitted a permit renewal application to the Division on May 19, 2004.
Since the previous permit renewal the facility was upgraded from 3.2 MGD to 3.65 MGD. Currently an
oxidation ditch and a RAS pump station are under construction as part of an improvement project. They have
a permit for reuse of treated effluent (WQ0019179). They reuse up to .00077 MGD of wastewater on athletic
fields on a seasonal oasis. The city participates as a member in the Tar -Pamlico River Basin Association.
Pre -Treatment: The city has an approved pretreatment program with 1 SIU and 1 CIU for a permitted flow of
0.0263 MGD. The permit requires the city to continue to operate its pre-treatment program.
Basin Plan: The Tar River is listed as impared because the chlorophyll -a criterion was exceeded in 17 % of
the samples. A TMDL has been approved by EPA to address nutrient overloading into the river. The Tar River
is also impaired on an evaluated basis in the fish consumption category because fish tissue samples
exceeded the criterion of methylmercury per gram of fish tissue. Mercury is a statewide issue. A new mercury
analytical method for measuring very low concentratIcns of mercury in water was approved by EPA. This
method is being used by wastewater treatment plants to determine levels of mercury from treatment plants.
The division is also conducting a study to gather information thak. will help in the development of a water quality
standard and a TMDL.
DMR Review: For 2003, flow averaged 1.89 MGD, BOD averaged < 2.0 mg/I, Total Suspended Solids
averaged < 1.0 mg/I. The Total Residual Chlorine daily limit was exceedeo once in 2004 and the ammonia limit
was exceeded once in 2004.
Reasonable Potential Analysis: The discharge is to tidal waters, therefore no reasonable potential analysi
was performed for chronic criteria. Acute criteria was compared to the maximum reported values. Values for
zinc and copper exceeded the 1/2 FAV. Monitoring will remain in the permit. The values detected for chromium
and lead were below the acute criteria.

Effluent Toxicity: The permit requires quarterly acute toxicity testing at 90%. The city passed all the toxicity
tests in the past four years.
Priority Pollutant Scan: The city performed three Priority Pollutant Scans as part of the application process.
Chromium, zinc, chlorodibromomethane, chloroform, bis(2-ethylhexyl) phthalate, and dichlorobromomethane
were detected. Concentrations detected were less than the acute criteria.

Dear Mrs. Stephens,
The City of Washington is requesting renewal of its existing NPDES permit number
NC0020648 of 3.65 MGD for treated wastewater discharge to the Tar River at
Washington.
We have enclosed for your review one original permit renewal application packet and
two copies of the same packet. Upon review of the packet, you will find some of the
requested analytical data missing. The first of these is the Priority Pollutant Analysis
(PPA). The renewal packet was received by the City in late December 2003. This left
only two quarters before the packet was required to be submitted. After a telephone
conversation with Mr. Charles Weaver in early January 2004 to discuss this issue, he
instructed us to schedule the PPA's with our next 3 quarterly toxicity samples (Feb., May
& Aug.) and to note this in the cover letter with the submitted packet
The second analytical information missing from the packet is second species toxicity test.
Again there were only two quarters left before the renewal packet was to be submitted.
Mr. Weaver forwarded me to Mr. Kevin Balden with the Aquatic Toxicology Unit for
guidance on this matter. Mr. Balden recommended collecting 4 consecutive monthly
samples beginning in February 2004. He also advised that the City would need to use
ceriodaphnia as the second species due to the fact that the City currently uses pimephales
promelas as the primary species for regular quarterly toxicity test. The City will submit
the results of these analyses as a renewal packet amendment as soon as all of the analyses
are complete.
