On site aquatic resources include the three streams (CH 100, CH 200, and CH 300) and one wetland WL 3000. The streams on site are unnamed tributaries to Afton Run which is classified as a "Class C"water by the North Carolina Division of Water Resources. CH 100 is perennial while CH 200 and CH 300 are intermittent. WL 3000 flows into CH 300. The Corps approved the Preliminary Jurisdictional Determination request on September 24, 2021. The enclosed permit application request is for 537 linear feet of stream permanent impacts in order to facilitate the construction of an industrial development (two buildings), two water quality ponds, truck dock areas, trailer parking, access roads, employee parking, and other necessary infrastructure. Permanent impacts to intermittent stream CH 200 of 496 linear feet (0.035 acre), and intermittent stream CH 300 of 41 linear feet (0.003 acre) are requested to facilitate construction of one of the buildings, truck and employee parking, and access roads. Impact S1 will be 496 linear feet (0.035 acre) of fill for construction of one industrial building and loading area. S2 will be 41 linear feet (0.003 acre)for a loading area. W1 is also necessary for the building pad of this structure and includes impacts to 0.046 acre. This area is very attractive for industrial development due to the existing development already present in the vicinity as well as its close proximity to highways and interstates. The project is in very close proximity to Highway 73 and Interstates 85 and 485. The planned industrial development is being constructed with features and flexibility to attract a wide array of tenants that are interested in occupying this product type in this location. A variety of businesses across multiple industries will be able to utilize this development in this location depending on their warehouse space needs. Business activities among these tenants may include freight forwarding, third party logistics, food/beverage distribution, light assembly/manufacturing, wholesalers, and others. The proposed industrial use of the property is consistent with the City of Concord's adopted land use plan. Users of such buildings often require anywhere from 20,000 square feet to 2.5 million square feet. While the property's location has certain logistical advantages for industrial warehouse users, these tenants will require competitive market rents to operate out of these proposed facilities. Rental rates are directly related to the cost of the land and improvements, much of which is fixed regardless of the size of the building being developed. These fixed costs, which this development also will incur, include the land itself, utility infrastructure improvements, offsite roadway improvements, legal and financing costs, marketing, construction costs, and other costs. In the current market tenants need larger buildings to account for the increase in on-line shopping and quick delivery deadlines. Stream mitigation will be required for project impacts. Atlas proposes to mitigate for the intermittent stream impacts at a 1.5:1 ratio. CH 200 and 300 are intermittent and medium quality. A copy of the NC Division of Mitigation Services acceptance letter is enclosed. Enclosed is a copy of the US Fish and Wildlife Service (FWS) Section 7 comment letter. Based on comments received in the July 22, 2021 FWS response Atlas Environmental staff conducted a second survey for Schweintiz's sunflower (Helianthus schweinitzii) on August 30, 2021 during its flowering season and none were observed at the time. Section 7 consultation with the Service has been satisfied. Enclosed is a copy of the NC Historic Preservation Office (HPO) Section 106 comment letter. The HPO office had no comment related to project impacts. Section 106 consultation with the Service has been satisfied. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e); the National Environmental Policy Act(42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended(16 U.S.C. 1531-1543)(Act). Project Description According to the information provided, the Applicant proposes to construct an undisclosed commercial development on approximately 16.5 forested acres in Concord,North Carolina. The information provided suggests that the proposed project will require authorization from the U.S. Army Corps of Engineers for impacts to Waters of the United States. Based on the information provided, onsite habitats are dominated by successional mixed forest,but also contain forested riparian and wetland habitats (unnamed tributaries to Afton Run), maintained utility and road rights of way,maintained open space, and transitional edge habitats. No project design plans or a description of impacts to onsite habitats have been provided at this time. Federally Listed Endangered and Threatened Species According to Service records, suitable summer roosting habitat may be present in the action area (50CFR 402.02)for the federally threatened northern long-eared bat(Myotis septentrionalis). However,the final 4(d)rule, (effective as of February 16, 2016)exempts incidental take of northern long-eared bat associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known,occupied maternity roost during the pup season(June 1 —July 31). Based on the information provided,the project would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d)rule for this species. Although not required,we encourage the Applicant to avoid any associated tree clearing activities during this animal's maternity roosting season from May 15—August 15. Your correspondence states that the entire project review area was thoroughly traversed to identify areas that contain suitable habitat for federally listed species on April 20,2021 and that no occurrences for the federally endangered Carolina heelsplitter(Lasmigona decorata)and Schweintiz;s sunflower(Helianthus schweinitzii)were observed at that time. Please describe the methods used to survey for this animal species and provide the results of this survey to our office to complete our review. If surveys were not conducted for this species,negative survey results are not informative and should have no bearing on an effect determination from the action agency. Your correspondence also states that you did not observe occurrences of Schweintiz's sunflower during your April 20, 2021 evaluation. We remind you that negative results from botanical surveys conducted outside of the appropriate survey window should not be used to inform an effect determination from the appropriate action agency. Erosion and Sediment Control Measures to control sediment and erosion should be installed before any ground-disturbing activities occur. Grading and backfilling should be minimized, and existing native vegetation should be retained(if possible)to maintain riparian cover for fish and wildlife. Disturbed areas should be revegetated with native vegetation as soon as the project is completed. Ground disturbance should be limited to what will be stabilized quickly,preferably by the end of the workday. Natural fiber matting(coir) should be used for erosion control as synthetic netting can trap animals and persist in the environment beyond its intended purpose.
