Sullins, Director Division of Water Quality August 27, 2007 DWQ Project No. 07-0621 Forsyth County Mr. Barry Siegal Post Office Box 8306 Greensboro, NC 27419 Re: Chamberlain Place Apartments, Forsyth County UT Muddy Creek [030704, 12-94-(0.5), C] STORMWATER MANAGEMENT PLAN APPROVAL Dear Mr. Siegal: On July 9, 2007, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to place permanent fill in 1201inear feet of perennial stream, and to place temporary fill associated with trenching and backfilling in 201inear feet of perennial stream in order to construct Chamberlain Place Apartments in Forsyth County. In order to meet Condition 2 of the 401 Certification for this project, a stormwater management plan was received by the DWQ on June 28, 2007. Additional information on the stormwater management plan was received by the DWQ on July 17, 2007. This Plan has been reviewed and satisfies the stormwater management conditions of the 401 Water Quality Certification. The structural stormwater practices as approved by DWQ as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. Stonnwater easements shall be recorded for a distance of at least 10 feet on each side of all stormwater conveyances on all lots containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners. Please note that per the latest version of the DWQ Best Management Practices Manual (published July 2, 2007), the DWQ will accept correctly designed grassed bioretention cells as well as bioretention cells vegetated with a combination of trees, shrubs and perennials as approved for this project.
