Ron,
According to Session Law 2011-394 (July 1, 2011), industrials don't need an ATC. Since they are
proposing a new treatment component, they might need a major permit modifica on . This is what I
gather from what is stated on our webpage: h ps://deq.nc.gov/about/divisions/water-resources/water-
quality-permi ng /npdes-wastewater/permi ng-process#Permit_Modifica ons. Minor modifica ons
for ownership name change and some technical correc ons.
I am star ng in the new posi on in the Industrial Permi ng Unit next week, please have them
coordinate with Joe Corporon or John Hennessy.

catchment pond to remove MTBE and prevent future viola ons. Is an AtC is required to do this? Also, would this
be a minor permit medica on?

Mr. Boone -
As per our recent phone call, Colonial Pipeline recently reported exceedances of the MTBE limit for Ou all 004
contained within NPDES Permit NC0031046. The exceedances were reported on the DMRs submi ed in March
and April 2022 and ranged from 25.9 ug/L to 45.1 ug /L (the permit limit is 19 ug /L). We believe that the presence
of MTBE within this ou all is related to the documented plume of MTBE in the ground water upstream of the
ou all. This plume is being addressed under Incident #18110 . The a ached map illustrates the ou all loca on
and the plume loca on in October 2021.
Colonial would like to install controls to address the presence of MTBE within this ou all. We are currently
inves ga ng an aera on system of some type within the pond upstream of the ou all but are open to other ideas
from the experts assis ng us. I know we agreed that this would likely involve a modifica on to the current permit
and or Correc ve Ac on Plan. Is there anything we can do to expedite that or eliminate the need for a
modifica on?
