VAN DER VAART secretary T.RACY DAVIS Director Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (-DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter and permit references DEMLR as the Division responsible for issuance of the permit. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit shall now be effective from the date of issuance until September 13, 2019, which includes all available extensions. On January 29, 2016, the Wilmington Regional Office received a request to revise the approved plans for Stormwater Management Permit Number SW8 050518. Additional information was received on April 8, 2016 and on June 30, 2016. The plan revision depicts the as -built impervious areas and green areas of the site based on updated satellite imagery. There was a slight increase in the low density drainage area DA2 due to the addition of baseball dugouts. Also, where stormwater runoff will flow to the existing wet detention pond, the following changes to built -upon area were observed: 1) addition of a wider driving aisle in the parking area nearest the end of Tortuga Lane 2) addition of a storage shed near the concession stand building 3) addition of sidewalk connecting the community center building to the parking lot 4) addition of impervious pavement in the street area 5) the removal of impervious area due to addition of parking islands near concession stand 6) the removal of an impervious walking track This resulted in having the same impervious area that is currently permitted and directed into the existing wet detention pond. It has been determined that a formal permit modification is not required for the proposed changes. We are forwarding you an approved copy of the revised plans for your files. Please add the attached plans to the previously approved plan set. In addition, please replace the previously issued permit with the revised, updated permit, attached. Any other changes to this project must be approved through this Office prior to construction. The issuance of this plan revision does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until September 13, 2019, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 237,364 square feet of impervious area in a drainage area of 640,716 square feet (the "High Density Tract"). The remaining project area of 477,468 square feet (the "Low Density Tract") must be maintained at 12% built -upon area or less, as required by Section .1005 of the stormwater rules. The overall built -upon area (BUA) for this permit, including that BUA in the Tortuga Lane drainage area, the high density drainage area, and the low density drainage area must cumulatively be maintained at 25% or less. 3. The High Density Tract will be limited to the amount of built -upon area indicated in Section 1.6 of this permit, and per approved plans. There is no allotment for future built -upon area. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. The runoff from all built -upon area within the permitted High Density Tract of this project must be directed into the permitted stormwater control system. 6. The following design criteria have been provided in the wet detention pond and must be maintained at design conditions: a. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 8. The only runoff conveyance systems allowed within the Low Density Tract will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 9. No piping is allowed in the Low Density Tract except that minimum amount necessary to direct runoff beneath an impervious surface such as a road or to provide access. 10. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 11. Within the Low Density Tract, a 50' buffer shall be provided adjacent all impounded structures, rivers, streams and tidal waters. The buffer is not required within the High Density Tract. 12. Roof drains in the Low Density Tract must terminate at least 50' from the Mean High Water line. Roof drains in the High Density Tract must be directed or connected to the stormwater management system. Page 4 of 11 State Stormwater Management Systems Permit Number SW8 050518 MOD II. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. a. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. b. The failing water from the fountain must be centered in the pond, away from the shoreline. C. The maximum horsepower for a fountain in this pond is 1 horsepower. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Access to the stormwater facilities shall be maintained via appropriate easements at all times. Page 5 of 11 State Stormwater Management Systems Permit Number SW8 050518 MOD 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 14. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface. 15. The permittee shall at all times provide the operation and maintenance necessary in the Low Density Tract to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 16. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121; e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D-6-07; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 2. The permit does not automatically transfer with the sale or conveyance of the property. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Any individual or entity found to be in noncompliance with the provisions of this storrmwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. If BUA credit for the use of permeable pavement within the lot (project) is desired, the permittee shall either modify this permit, or shall direct the lot owner to submit an application with all supporting documentation and the application fee to the Division and receive a permit prior to construction of the permeable pavement. Center Attachments: Drainage Area Map (Sealed 2016-6-24) (Notes).pdf I wasn't deeply involved with the permitting of the community park back in 2009, and the documentation I have isn't giving me an exact answer, but to the best of my knowledge I believe that the difference comes from the removal of the -4,000 sf walking track and the addition of 1,141 sf of future sidewalk connecting the community park building to the parking lot, as well as confirmation of as -built conditions. - Also, please edit your note about the offsite changing; it increased partly because of the wider Sea Turtle driving aisle, not at the end of Tortuga. Center Okay. Thank you very much. Here is a cut from my revised spreadsheet below. I will update the permit numbers with the issuance of this Plan Revision. It looks like the big difference is the deduct for sidewalks. Can you explain why that is? DA1 drains to the onsite constructed wetlands in this offsite permit; DA1 drainage area is 101,548 square feet with impervious area of 46,844 square feet. DA2 drains to the master permit SW8 050518.
