The following items specify permit conditions and limitations that were iri violation during the time of the inspection. I. SCHEDULES (1.) Condition 1. Until and engineers certification is received for the installation of all approved facilities; flow will be Limited to 20,000 GPD. After reviewing the NDMR's submitted by Lake Creek Corporation; from Janauray 20087 through November 2010 NCDWQ found Lake Creek Corporation had violated their permitted flow limit 137 times in 2008, 53 times during 2009, and 108 times from January 2010 to November 2010. From January 2008 through November 2010 Lake Creek Corporation had 298 days with flow violations. Regional Aquifer Protection Supervisor NC DWQ /-Aquifer Protection Section 225 Green St. / Suite 714 Fayetteville, NC 28301 Re: Notice of Violation/ With Intent NOV-2011-LV-00001 Lake Creek Corporation Permit No. WQ0O187O8 Bladen County Dear Mr. Barnhardt: CORPORATION RECEIVED FEB 282011 DENR -FAYETTEVILLE REGIONAL OFFICE In response to your letter dated January 14, 2011 and addressed to Mr. Jones, attached please find a copy of the effluent monitoring limits as attached to DWQ Permit #WQO0187O8 under which Lake Creek Corporation, d/b/a Bay Tree Utilities Company, currently operates. The limitation here is a monthly average limit, not a daily maximum. Back in February of 2008, or about that time, this particular topic was discussed at some length during our meeting with you, me, Kim Colson, David Goodrich, Jim Barber and Bill Stafford. At that time, we all agreed that the limiting measure was la monthly average of the daily flows measured in gallons. In our discussions withotherORCs and folks in your office, it has been confirmed that the most predominantly accepted and approved method to measure effluent limits across the state and the industry is the monthly average. So, it is appropriatelthat the Bay Tree Utilities Company system serving Bay Tree Lakes continues to be permitted and monitored this way.
