The problems that plague the Bay Tree facility are not immergent but chronic and on -going permit violations. The system has been studied in the past, it should not be necessary to complete this process again. We require a plan of action that goes beyond the studying or planning phase. The, plan of action is to include: 1. Specific steps to address the excess'influent flow. 2. Specific steps to address the 12-month floating total violation. Additional information to be included with the items above is a specific time line. It should include planned start dates and completiondates for us to consider. This will assist with accountability. JAY ZIMMMERMAN Director You are hereby notified that, having been issued a permit for spray irrigation operations for the subject facility, Lake Creek Corporation,: was found to be in violation of the following permit conditions. - Violation I: Failure to meet the effluent limits of Attachment "A"for Permit Number WQ0018708. Review of the monthly reports for Lake Creek Corporation., Permit WQ0037185, (05/2012—'03/2016) revealed a violation for Flow, in conduit or through the plant. The limit for Flow, is 20,000 GPD monthly average. (See Permit dated February 3, 2009) The facility has exceeded this maximum value each month for the period previously stated. Suggested Corrective action for Violation I: I .. 1. Upgrade the facility to accommodate the increased flow. 2. Eliminate Inflow and Infiltration concerns in the collection system. This will reduce the flow entering the facility which will in turn result in lower application rates to the existing fields. 2. Permit additional land for new spray irrigation fields. This will allow the effluent to be applied over a larger area, reducing the overall application rate per acre.. You are required to take any necessary action to immediately correct the above violations and to provide a written response to this Notice by July 15, 2016. Please include in your response a plan of actions to include a time line for the necessary upgrades and/or repairs. Please be advised that this Notice of Violation does not prevent the Division of Water Resources from taking enforcement actions for this violation or any past or future violation. Neither does this notice remove you from the responsibility or liability for failure to comply with any State Rule, State Statue or permitting requirement. Furthermore, the Division of Water Resources has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. Henson Regional Supervisor - NCDEQ Division of Water Resources Water Quality Regional Operations Section Fayetteville Regional Office Re: Lake Creek Corporation Permit No. WQ0018708; Letter dated June 15, 2016. • Dear Ms. Henson: In response to the subject letter and the effluent limits and the yearly application' limits forthe subject Waste Water Irrigation System (WWT system), first know, that the work has begun in this area. Lake Creek Corporation (LCC) has engaged Edwin Andrews & Associates, P.C. (Edwin Andrews III, PG, NCLSS) and LKC Engineering,.PLLC (Adam Kiker, R.E.) to work together to analyze our spray irrigation system and develop solutions to resolve the issues noted. A hydrogeologic, soils and agronomic analysis has been performed to evaluate the function of the spray irrigation system on 5.06 acres. The field work has'.included soils analyses, Ksat analyses, aquifer testing and water level mapping. Thus far, it has been determined that the limitation of the site is not associated with soils hydrology (Ksat), but rather lateral drainage. As such, the coordination of the' process to engineer modification of drainage and spray distribution with the remainder of the hydrogeologic, soils and agronomic analyses has begun. Upon completion of the engineering and modifications above, LCC, with the help of LKC, Andrews, Envirolink and other experts as appropriate, will turn its attention to another round of study on collection system with the objective of better determination of the primary locations of the system's inflow and infiltration. The goal will be to map the areas contributing to this inefficiency in the system so as to engineer, plan and execute improvements in the efficiency in the collection system and thereby the WWT system overall. As you are probably aware, over the Iasi three years, Envirolink has been engaged as the operator of responsible charge (ORC) for LCC's waste water treatment and spray -irrigation facility. Since hiring Envirolink as the ORC, LCC's facility has become a significantly better system through tighter operations. Additionally, over the last 18 months, Envirolink, has become BTUC's contract billing and payment collections agent; and this, in turn, has translated to the funding of improvements in maintenance on both the sewer collections and WWT;ends of the system. We believe we have a solid team of professionals engaged and working to identify the fundamental causes of issues across the system, engineer sound solutioins, and assist in the actions that we will take to correct the issues and continue to improve the system.
