I have reviewed the application and attachments submitted and require additional information to complete my review
of your request to utilize NWP 39 for the proposed project. Please see the items below and advise if more information
or clarification is needed.
1. Please confirm the north arrow and scale are accurate on the Overall Impact Exhibit.
Yes, north arrow and scale are accurate on the Overall Impact Exhibit sheet.
2. Please provide a profile view of the proposed stream impact / culvert placement.
Revised impact exhibits have been attached, including a depiction of the proposed stormwater control measure
locations and the profile view of the stream impact.
3. It is noted that the proposed stream crossing would be collocated with impacts necessary for construction of the
warehouse, but impacts needed for the facility are not well justified. It appears the same size warehouse could
be accommodated with no impact to jurisdictional areas by rotating it. Please provide justification for the
configuration proposed, or why either an adjusted or shifted footprint away from the stream is not feasible. If a
north -south orientation is necessary, would a narrower and longer building serve the same need? Perhaps
additional detail about the proposed warehouse's requirements would be helpful in understanding the need for
impacts.
Orienting the building in a north -south orientation on site has more than 40' of elevation differential. Significant
grading and utilization of a significant amount of retaining walls would be required to avoid stream impacts and
to stay out of floodplain which would not be feasible.
Proposed building requires access by WB-62 vehicles as well as aerial fire apparatus.
4. The application states than a headwall is proposed along New Bowers Road to accommodate a westward
shift. However, parking is shown between the road and the facility when ample uplands appear to be available
both north and south of the facility to accommodate parking. Were other layouts for support facilities
considered, and if so why is the proposed configuration necessary? Were headwalls also considered along the
stream to avoid/minimize impacts?
Sufficient space north of the facility does not exist to accommodate the desired amount of parking for the
facility. Additionally, ADA required parking spaces need to be provided at the proposed entrances to the
facility. Parking to the south side of the building would create a remote lot that conflicts with tractor trailer
service and the dock area. This would mix car traffic with tractor trailer traffic in addition to unsafe access
conditions to the building through the dock area.
Headwalls are not an option around the stream due to the required fire lane access around the building being
directly over the existing stream.
The existing power and sanitary force main easements preclude shifting the building farther southwest.
Impacts to the stream would be necessary in any site layout to utilize the area across the stream where the
proposed trailer parking is.
5. What is the purpose of the stub shown on the east side of the proposed remote parking lot? Please note NWP
39 can only be used to construct 'single and complete' impacts.
The 'stub' is for backing and turn -around movements by vehicles moving and storing trailers. This 'stub' is not
for future development or expansion.
6. Ample uplands appear to be available adjacent to the proposed remote parking lot to accommodate facilities of
equal or greater size/capacity. Please explain the need for the configuration shown.
The additional area adjacent to the trailer storage lot is not sufficient to accommodate the needed depth for the
trailer spaces and associated drive aisle. Turn movements for tractor trailers could not be accommodated.
7. The application states that stormwater management plans will be complete in May 2022. Is there any chance
the BMP shown would expand into potentially jurisdictional areas?

There is no chance that the stormwater BMPs will encroach upon jurisdictional areas. See attached impact
exhibits for a depiction of the SCM locations.
8. We will need to consult with the USFWS prior to verifying use of NWP 39. Our SLOPES agreement with USFWS
should address concerns for Northern long-eared bat. However, the attachments provided state that potentially
suitable habitat for Schweinitz's sunflower occurs onsite. Please provide additional information, including dates
of surveys and findings, four our use in this consultation. A review of historical imagery (attached) showed that
the site has been in active cultivation since at least 1948. This would not allow the sunflower to become
established on the site. In addition, literature suggests that sites providing habitat for the sunflower often
succeeds into a post oak — blackjack oak community or prairie. Neither of these communities were identified
elsewhere on the site. Finally, soils where the sunflower is often found are generally considered shallow with
exposed rock or bedrock, fine textured, and tend to exhibit shrink/swell characteristics. While the soils did have
some shrink/swell characteristics, overall these qualities were not observed on site. As a result, it is our opinion
that the site does not exhibit suitable habitat for the sunflower.
