Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. This permit approves the construction and operation of the subject wastewater treatment and spray irrigation facilities for a five-year cycle. Please take the time to review this permit thoroughly as some of the conditions contained are unique or of importance to your permit. Of particular interest are the following peinutting conditions: > Condition I.2. — This condition requires that a representative from the Fayetteville Regional Office (FRO) witness whether or not the spray irrigation system is properly operating. If not, the Permittee shall not operate the spray irrigation system until thesystem is modified such that the FRO is satisfied and the Division is notified in writing. > Condition I.5. — This condition stipulates .that the Permittee may conduct a one (1) time disposal of existing residuals contained in the converted sludge storage lagoon onto the spray irrigation field. > Condition I.7. — The Permittee shall physically remove the effluent pipe from the converted storage lagoon. Please note that capping both ends of the pipe will be deemed unacceptable by the Division and will result in a permit violation. I > Condition 11.12. — This condition states that the proposed future spray irrigation fields on the plans shall be held in reserve. If any parts. requirements, or limitations contained in this peinnt are unacceptable. you have the right to request an adjudicatory hearing upon written request within thirty (30) days; following receipt of this permit. Thorpe, Ph.D. 2 NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND 'NATURAL RESOURCES RALEIGH SPRAY IRRIGATION SYSTEM PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED, TO, Lake Creek Corporation, Bladen County FOR THE construction and operation of, a 40,000 gallon per , day (GPD) wastewater treatment and spray irrigation facility consisting of an influent flow . monitor, a barscreen, the expansion of the existing 20,000 GPD extendedaeration system to a 40,000 GPD unit, new sludge holding tank, the continued use of a storage lagoon with a volume of at least thirty (30) days storage, a chlorine contact chamber, the conversion of a sludge holding pond to a 40,000 gallon holding basin with pump station, 465 feet of 3 inch force main, a 5.08 acre spray irrigation area covered with coastal bermuda, twenty (20) 81.5 gallon per minute (GPM) spray irrigation heads and ten (10) 108.5 GPM spray irrigation heads with a spray diameter of approximately 130 feet and all associated piping, valves, and appurtenances to serve Bay Tree Lakes, with no discharge of wastes to the surface waters, pursuant to the application received June 27, 2000, and in conformity with the project plan, specifications, and other supporting data' subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until August 31,, 2006, and shall be subject to the following specified conditions and limitations: I I. PERFORMANCE STANDARDS 1. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted' facilityhas been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If this project is to be completed in phases and partially certified. you shall retain ithe responsibility to track further construction approved under the same •permit, and shall provide a final certificate of completion once the entire project has been completed. Mail the Certification to the Non -Discharge Permitting Unit, Division' of Water Quality, 1617 Mail Service Center, Raleigh, NC 27699-1617. 1 2.. The Fayetteville Regional Office, telephone number (910) 486-1541, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. In addition, a representative from the Fayetteville Regional Office shall be present at the start up of the spray irrigation system. The representative shall bear witness to determine whether or not ponding and/or runoff is occurring on the spray irrigation fields. If ponding and/or runoff occurs, the Permittee at a minimum shall modify the spray irrigation system, and have a licensed soil scientist determine a suitable instantaneous loading rate prior- to any- additional flow being made tributary to the system.• After modification, the representative from the Fayetteville Regional Office once again shall be contacted and shall witness whether or not the modifications were successful. 3. The spray irrigation facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement wastewater treatment and disposal facilities. 4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 5. The Permittee may conduct a one time application of existing residuals contained in the sludge storage lagoon onto the existing spray field. The residuals shall be applied within the permitted spray field only. Prior to application, the residuals shall be analyzed and submitted to the Fayetteville Regional Office. The residuals shall be analyzed to determine the concentrations for the following substances: Arsenic Cadmium Chromium Copper Lead Mercury Molybdenum Nickel Selenium Zinc Aluminum Ammonia -Nitrogen Calcium Magnesium NO3 / N022 Nitrogen % Total Solids pH Plant Available Nitrogen (PAN) * Phosphorus Potassium Sodium TKN * A PAN loading rate of 200 lbs/acre shall not be exceeded The residuals shall be incorporated into the soil within six (6) hours of land application. 6. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. 7. Prior to the start up of the spray irrigation facilities, the Permittee shall have the effluent pipe that currently discharges into the nearby creak physically removed from the ground and have the subsequent hole in the lagoon embankment properly filled and compacted. 8. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 2 9. The following buffers shall be maintained: a) b) c) d) e) f) g) 400 feet between wetted area and any residence: or places of public assembly under separate ownership, � - 150 feet between wetted area and property lines, 100 feet between wetted area and wells, 100 feet between wetted area and drainageways orsurface water bodies, 50 feet between wetted area and public right of ways, . 100 feet between wastewater treatment units and wells, and 50 feet between wastewater treatment units and property lines. II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. 2. Upon classification of the facility by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of_the wastewater treatment facilities.'!The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to thewastewater treatment facilities by the WPCSOCC. The Permittee, must also a employ a certified back-up operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC ,of the facility must visit each Class' I facility at least weekly and each Class's lI, III, and IV, facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation' and maintenance of the facility and must comply with all other conditions of 15A NCAC 8G .0202. Once the facility is classified, the Permittee must submit a letter to the WPCSOCC which designates the operator in responsible charge within thirty days after the wastewater treatment facilities are 50% complete. 3. A suitable year round vegetative cover of coastal bermuda shall be maintained. 4. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. I i 5. Adequate measures shall be taken to prevent wastewater runoff from the spray field. 6. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 7. The application .rate shall not exceed a cumulative loading of 105.8 inches over any twelve (12) month period at an instantaneous application rate not to exceed 0.25 inches per hour. 8. No type of wastewater other than that from Bay Tree Lakes shall be sprayed onto the irrigation area. 9. No traffic or equipment shall be allowed on the disposal area except while .installation- occurs or while normal maintenance is being performed. 10. Public access to the land application sites shall be controlled during active site use. Such controls may include the posting of signs showing the activities being conductedllat each site. 11. Freeboard in the storage lagoon and daily holding basin shall not be less than two feet at any time. 12. Future spray irrigation fields noted on plans shall be held in reserve. 3 III. MONITORING AND REPORTING REQUIREMENTS 1. Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. Adequate records shall be maintained by the Permittee tracking the amount of wastewater disposed. These records shall include, but are not necessarily limited to, the following information: a. date of irrigation, b. volume of wastewater irrigated, c. field irrigated, d. length of time field is irrigated, e. continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each field, f. weather conditions, and g. maintenance of cover crops. 3. Influent flow shall be continuously monitored and daily flow values shall be reported on Form NDMR. The Permittee shall install an appropriate flow measurement device consistent with approved engineering and scientific practices to ensure the accuracy and reliability of influent flow measurement. Flow measurement devices selected shall be capable of measuring flows with a maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. Records of flow measurement device calibration shall be kept on file by the Permittee for a period of at least three years. At a minimum, data to be included in this documentation shall be: a. Date of flow measurement device calibration b. Name of person performing calibration c. Percent from true flow 4. The effluent from the subject facilities shall be monitored by the Permittee at the point prior to irrigation every March, July and November for the following parameters: BOD5 TSS Fecal Coliform pH NH3 as N 5. Three (3) copies of all operation and disposal records (as specified in condition III 2) on Form NDAR-1 and three (3) copies of all effluent monitoring data (as specified in condition III 3 and III 4) on Form NDMR-1 shall be submitted on or before the last day of the following month. A representative annual soils analysis (Standard Soil Fertility Analysis) shall be conducted on each spray field and the results maintained on file by the Permittee for a minimum of five years. The Standard Soil Fertility Analysis shall include, but is not necessarily limited to, the following parameters: Manganese Percent Humic Matter 1 pH Exchangeable Sodium Percentage Base Saturation (by calculation) Acidity Calcium Copper Magnesium Cation Exchange Capacity 7. Noncompliance Notification: The Permittee shall report by telephone to the Fayetteville Regional Office, telephone number (910) 486- 1541, as soon as possible, but in no case more than 24 hours oil on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment• facility which! results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. Potassium Sodium Zinc Phosphorus b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of _adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report! must outlinethe actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. Prior to beginning waste disposal operations, a fifth monitoring well, MW-5, shall be installed to monitor groundwater quality immediately adjacent to the storage lagoon. i The well(s) shall be constructed such that the water level in the well is never above or below the screened (open) portion of the well at any time during the year. The location of the monitoring well must be approved' by the Fayetteville Regional Office prior to construction. The monitoring well shall be constructed in, accordance with this permit and approved by the Fayetteville Regional Office. 2. Prior to beginning waste disposal operations, monitoring well MW-4 shall have its water level measured concurrently with the other four monitoring wells, have the elevation of its measuring point surveyed, and shall then be permanently abandoned. Within thirty (30) days of 'abandonment, a Well Abandonment Record (GW-30 form) shall be completed for each well abandoned and mailed to the Groundwater Section, Permits and Compliance Unit,1636 Mail Service Center 1Raleigh, N.C. 27699-1636. The well' shall be abandoned by either a North Carolina Certified Well Contractor, the property owner, or the property lessee according to General Statutes 87-94.4(b)(2). ' If the abandonment is not performed by a certified well contractor, the property owner or lessee must 1physically perform the actual well abandonment activities and the well shall be abandoned according to the North Carolina Well Construction Standards (15A NCAC 2C .0113) and local county rules. 5 3. Monitor wells MW-1, MW-2, MW-3 and MW-5 shall be sampled initially after construction and thereafter every March, July and November for the following parameters: Water Level pH Chloride Total Dissolved Solids (TDS) Fecal Coliform Total Organic Carbon (TOC) Nitrate (NO3) Total Ammonia Total Phosphorous The measurement of water levels must be made prior to sampling for the remaining parameters. The depth to water in each well shall be measured from the surveyed point on the top of the casing. The measuring points (top of well casing) of all monitoring wells shall be surveyed to provide the relative elevation of the measuring point for each monitoring well. If TOC concentrations greater than 10 mg/1 are detected in any downgradient monitoring well, additional sampling and -analysis must be conducted to identify the individual constituents comprising this TOC concentration. If the TOC concentration as measured in the background monitor well exceeds 10 mg/1, this concentration will be taken to represent the naturally occurring TOC concentration. Any exceedances of this naturally occurring TOC concentration in the downgradient wells shall be subject to the additional sampling and analysis as described above. The results of the sampling and analysis must be received on Form GW-59 (Groundwater Quality Monitoring: Compliance Report Form) by the Groundwater Section, Permits and Compliance Unit, 1636 Mail Service Center Raleigh, N.C. 27699-1636 on or before the last working day of the month following the sampling month. 4. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary is for the disposal system constructed after December 31, 1983 is established at either (1) 250 feet from the waste disposal area, or (2) 50 feet within the property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action in addition to the penalty provisions applicable under General Statute 143- 215.6A(a)(1). 5. In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action on the part of the permittee. 6. All wells that are constructed for purposes of groundwater monitoring shall be constructed in accordance with 15A NCAC 2C .0108 (Standards of Construction for Wells Other than Water Supply) and any other state and local laws and regulations pertaining to well construction. 7. The Fayetteville Regional Office, telephone number (910) 486-1541, shall be notified at least forty-eight (48) hours prior to the construction of any monitoring well so that an inspection can be made of the monitoring well location. Such notification to the regional groundwater supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding state holidays. 6 8. Within sixty (60) days of completion of all monitoring wells, the permittee shall submit two original copies of a scaled topographic map (scale no greater than 1":100); however, special provisions may be granted upon prior approval for large properties. The map(s) shall be signed and sealed by a professional engineer or a state licensed land surveyor that indicates all of the following information: (a) the location and identity of each monitoring well, j j (b) the location of the waste disposal system, • (c) the location of all property boundaries within 500 feet of the spray irrigation area(s), (d) the latitude and longitude of the established horizontal control, monument, (e) the relative elevation of the top of -the -well -casing (which shall be known as the "measuring point") relative to a common datum, (t) the depth of water below the measuring point at the time the measuring point is established, (g) and the location of Review and Compliance boundaries. i ' The survey shall be conducted using approved practices outlined in North Carolina General Statutes Chapter 89C and the North Carolina Administrative Code Title 21, Chapter 56. The surveyor shall establish a horizontal control monument on the property of the waste disposal system and determine the latitude and longitude of this horizontal control monument toa horizontal positional accuracy of +/- 10 feet. All other features listed in a. through e. above shall be surveyedrelative to this horizontal control monument. The positional accuracy of features listed in a. through e. above shall have a ratio of precision not to exceed an error of closure of 1 foot per 10,000 feet of perimeter of the survey. Any features located by the radial method will_be located from a minimum of two points.' Horizontal control monument shall be installed in such a manner and made of such materials that the1mohuinent will not be destroyed due to activities that may take place on the property. The map shall also be surveyed using the North American Datum of 1983 coordinate system and shall indicate the datum on',ithe map. All bearings or azimuths shall be based on either the true or NAD 83 grid meridian. If a Global Positioning System (GPS) is used to determine the latitude and longitude of the horizontal control monument, a GPS receiver that has the capability to perform differential GPS shall be used and all data collected by the GPS receiver will be differentially corrected. • The maps and any supporting documentation shall be sent to the Permits and Compliance Unit, Groundwater Section, 1636 Mail Service Center, Raleigh, NC, 2709-1636. 9. Within thirty (30) days of completion of all well construction activities, a certification must be received from a professional engineer or .a licensed geologist certifying that the monitoring wells are located and constructed in accordance with the Well Construction Standards ((15A NCAC 2C) and this permit. This certification should be submitted with copies of the Well Completion Form (GW-1) for each well. Mail this certification and the associated GW-1 forms to the Permits arid .Compliance Unit, Groundwater • Section, 1636 Mail Service Center, Raleigh, NC, 27699-1636. 10. For the initial sampling of the well as specified elsewhere in the permit, the permittee shall submit a copy of the GW-1 Form (Well Completion Form) with the Compliance Monitoring Form (GW-59) for that well. Compliance Monitoring Forms that do not include copies of th'e GW-1 form will be returned to the permittee without being processed. Failure to submit these forms as required by this permit may result in the initiation of enforcement activities pursuant to NC General Statutes 143-215.6A. 11. No land application of waste activities shall be undertaken when the seasonal high water table is less than one foot below land surface. 12. The lagoon shall have a liner of natural material at least one foot in thickness with a hydraulic conductivity of no greater than 1 x 10-6 cm/sec when compacted,or a synthetic liner of sufficient thickness to exhibit structural integrity and an effective hydraulic conductivity no greater than that of the natural material liner, according to 15A NCAC 2H .0219(f). 7 V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain 'samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2.- This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 5. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the Division's General Permit NCG0100000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500. 6. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of the project. 7. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after' being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4). 8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Chemical Process - shall mean a wastewater pollution control system process consisting exclusively of the addition of chemicals to treat wastewater. Collection System - shall mean a continuous connections of pipelines, conduits, pumping stations, and other related constructions used to conduct wastewater to the water pollution control system. Electrodialysis System - shall mean a system utlizing a selective eparation of dissolved solids. .. process that is based on electrical charge and diffusion through a semipermeable membrane. Physical Process - shall, mean any water pollution control system process consisting of electrodialysis, adsorption, absorption, air stripping, gravimetric sedimentation, floation, and filtration as a means of treatment. Reverse Osmosis System - shall mean a system which utilizes solutions and nsemipermable membranes to separate and treat wastewater. Ultrafiltration System- shall mean a system which utilizes a membrane filter to remove pollutants from wastewater. Water Pollution Control System -`shall mean any systemfor the collection, treatment, or disposal of wastewater and is classified under the provision- of G.S. 90A-37. Note: Please refer to G.S. 90A-37 for additional information and definitions. , Classification of Spray Irrigation Water Pollution Control Systems: / Systems.which utilize spray irrigation for the reuse or disposal of wasterwater. These systems include: septic tanks, sand filter, oil/water Separators, lagoons, storage basins, screening, sedimentation. Systems other than those listed above shall be subject to additional classification. Classification of Land Application of Residuals Systems: Systems permitted and dedicated for land application of residuals that are produced by a water pollution control system or contaminated soils. Classification of Physical/Chemical Water Pollution Control Treatment Systems: _ Grade I Physical/Chemical: Any water pollution control system that utilizes a primarily physical process to treat wastewater. This classification includes groundwater. remediation systems. ** Grade II Physical/Chemical: Any water pollution control ;system that utilizes a primarily chemical process to treat wastewater. This classification includes reverse osmosis, electrodialysis, and ultrafiltration systems. ** ** Any water pollution control system that utilizes a phyical/chernical process to enhance an activated sludge or fixed growth process, -shall not be. subject to additional classification. Classification of Subsurface Water Pollution Control Systems: Systems which utilize the soil for subsurface treatment and disposal of wastewater and/or are required to have a certified operator under 15Ai NCAC 18A.1961. *** *** Any subsurface system that has as part of its treatment process a water pollution control systems that may be classified under Rules .0302 through .0307 of this section shall be subject to addional classification. Classification of Biological Water Pollution Control Treatment Systems: Grade I Biological WPCS - Septic tank/sand filter systems - Biological lagoon systems - Constructed wetlands and associated appurtenances Grade II Biological WPCS - Systems that utilize an activated sludge or fixed growth process with a permitted flow less than or equal to 0.5 million gallons per day (mgd) Grade III Biological WPCS - Systems that utilize an activated sludge or fixed growth process with a permitted flow of greater than 0.5 through 2.5 million gallons per day (mgd) - Grade II systems that are required to achieve biological nutrient reduction * Grade IV Biological WPCS - Systems that utilizing an activated sludge or fixed growth process with a permitted flow of greater than 2.5 million gallons per .day (mgd) - Grade III systems that are required to achieve biological nutrient reduction * * Biological Nutrient Reduction - The reduction of total nitrogen or total phosphorous by an activated sludge or fixed growth process as required by the facilities permit. Classification of Collection Water Pollution Control Systems: (whichever provides lowest grade) Same grade as biological water pollution control system. Grade of system: Based on population served: 1,500 or Less = Grade I 1,501 to 15,000 = Grade II 15,001 to 50,000 = Grade III 50,001 or more = Grade IV
