ACTIVE ENFORCEMENT ACTIONS
1. Immediate Corrective Actions from the 03/24/22 Not in Compliance Inspection Report for
Item(s) 3,5,10,11,12 have not been corrected. Compliance enforcement is under way and a
Notice of Violation is being issued.
INSPECTOR’S COMMENTS:
1. GROUND COVER REMINDER: Any portion of a site upon which further land disturbing
activity is not being undertaken shall be provided with ground cover sufficient to restrain erosion
within fourteen (14) calendar days of temporarily or permanently suspending the land disturbing
activity.

2. CERTIFICATE OF COMPLIANCE AND/OR OCCUPANCY: A certificate of compliance
and/or occupancy cannot be issued until an as-built certification for wet land, impervious survey
has been accepted by the City of Raleigh and all areas are stabilized (100% coverage and 80%
growth with no large bare patches when utilizing grass). If occupancy by a certain date is
necessary, it is recommended that the as-built certification package be submitted for review well
in advance of that date.
THIS PROJECT IS SCHEDULED FOR REINSPECTION IN SEVEN (7) DAYS TO CONFIRM
CORRECTION OF ALL IMMEDIATE CORRECTIVE ACTIONS LISTED.
Failure to remedy the listed Immediate Corrective Actions / violation(s) prior to reinspection will
result in a Notice of Violation and associated penalties may be assessed. These penalties shall
include retroactive and cumulative daily civil penalties of $5,000.00 per day until the violation(s)
are remedied [Raleigh Unified Development Ordinance, Section 9.4.11(A)].

Dear Property Owner and Financially Responsible Party:
An inspection of the above referenced site revealed violations to the Unified Development
Ordinance (UDO) and/or the City issued permits. The attached Compliance Inspection
Report details the specific violations, the required remedies and the time period in which
remedies must be completed. Failure to comply with this Notice of Violation will result
in an initial civil penalty of $7,500.00 for failure to protect public or private property,
failure to maintain measures, failure to install devices, failure to provide adequate
groundcover, and failure to act as well as continuing civil penalties of $5,000.00 per
day for failure to correct a violation after notice. Non-compliance could also result in
one or more of the following enforcement actions:

1. Denial of Permits and/or Inspections - No permits shall be issued to any person who
has failed, after notice, to remedy any violation or to otherwise comply with the UDO.
2. Criminal Penalties - The violator could be guilty of a misdemeanor punishable by
imprisonment not to exceed 90 days or by a fine not to exceed $5,000, or both, in the
discretion of the court [Raleigh UDO, Section 9.4.11(C)].
3. Injunctive Relief - Whenever the Raleigh City Council has reasonable cause to believe
that any person is violating any provision of the City Code or approved erosion and
sediment control plan, the City may institute a civil action for injunctive relief to
restrain the violation. The institution of the action for injunctive relief would not
relieve any party from any civil or criminal penalty described above [Raleigh UDO,
Section 9.4.11(D)].
4. SPECIAL NOTE - Subdivider's Forfeiture - Failure by the subdivider to correct any
violation shall result in forfeiture of any and all reimbursements stated in Section
8.10.2(E) of the Raleigh UDO.

The City of Raleigh, Stormwater Management Division has performed a stormwater compliance inspection of this project and
found the following violation(s) of the land disturbing permit, associated approved plans & specifications, and/or the Raleigh
Unified Development Ordinance. Specific violations and associated penalties are indicated below. Penalty assessments, if
any, will be issued under separate cover. See Immediate Corrective Actions below for required remedies and deadlines.

REQUIRED IMMEDIATE CORRECTIVE ACTIONS
1. Failure to protect public or private property:
(a) Minor off-site sedimentation has occurred at the southeastern corner of the property in a jurisdictional wetland. The
sediment is the result of undermining silt fence due to improper installation (not following City standard detail).
The extent of the impacts are mild. Remove sediment from wetland using shovels and buckets and reinstall silt
fence/silt fence outlet, per City standard detail (trenching in correctly). See Photographs 1-3 below.
2. Failure to maintain temporary and/or permanent measures:
(a) Re-install silt fence/silt fence outlet (refresh stone) in southeastern corner of property where sediment is
accumulating on silt fence and where silt fence has undermined resulting in sediment outside the limits of
disturbance in a jurisdictional wetland. See Photographs 1-5 below. At a minimum, removal of accumulated
sediment is required when sediment has accumulated to a maximum depth of one half the height of the silt fence and
silt fence must be securely trenched in and functioning properly.
(b) Re-install silt fence per City standard detail near basin/Stony Brook Dr. where equipment has run over it.
(c) Maintain inlet protection and refresh stone (at least 16” high) at one storm drain inlet near Stony Brook Dr. See
Photograph 6 below. Maintenance should include removal of accumulated sediment in pipes, inlets and protective
measures whenever protective measures are half full of sediment or not functioning properly.
3. Failure to install devices:
(a) Erosion and sediment control devices sufficient to retain the sediment generated by the land disturbing activity
within the boundaries of the tract and prevent off-site sedimentation are required.
(i) Due to inadequate spacing of baffles in the basin, install a new baffle near the inlet of the basin. See
Photograph 7 below.
(ii) Extend silt fence along the back of sidewalk on Stony Brook Dr. where vehicles have been entering the site
(near the permit box) or install a construction entrance.
4. Failure to provide adequate ground cover:
(a) Any portion of a site upon which further land disturbing activity is not being undertaken shall be provided with
ground cover sufficient to restrain erosion within fourteen (14) calendar d ays of temporarily or permanently
suspending the land disturbing activity.
(i) Groundcover shall be applied on basin slope between wall and basin and on slope along southwestern property
line. At the time of the inspection, the slope between the basin and retaining wall was being graded and some
seed had been applied. See Photograph 8 below.
5. Failure to Act
(a) Per NCGS §113A-54.1(e), the landowner, the financially responsible party, or the landowner's or the financially
responsible party's agent shall perform an inspection of the area covered by the plan after each phase of the plan has
been completed and after establishment of temporary ground cover in accordance with G.S. 113A-57(2). The person
who performs the inspection shall maintain and make available a record of the inspection at the site of the land -
disturbing activity. The record shall set out any significant deviation from the approved erosion control plan,
identify any measures that may be required to correct the deviation, and document the completion of those measures.
The record shall be maintained until permanent ground cover has been established as required by the approved
erosion and sedimentation control plan.
(i) No inspection records were observed on-site in the permit box. Phased inspections must be conducted and must
be made available on-site to City staff.

COMPLIANCE IS REQUIRED WITHIN TEN (10) DAYS OF
RECEIPT OF THIS NOTICE OF VIOLATION
ONCE THE LISTED REQUIRED IMMEDIATE CORRECTIVE ACTIONS HAVE BEEN COMPLETED YOU
MUST CALL FOR REINSPECTION.
THIS PROJECT WILL BE REINSPECTED TO CONFIRM CORRECTION OF ALL
VIOLATIONS / IMMEDIATE CORRECTIVE ACTIONS LISTED ABOVE.
Failure to remedy the listed Immediate Corrective Actions / violation(s) within the time limitations established in
this notice shall result in assessment of an initial penalt y of seven thousand five hundred dollars ($7,500.00) as well
as assessment of five thousand dollars ($5,000.00) per da y for failure to correct a violation after notice [Raleigh
Unified Development Ordinance, Section 9.4.11(F)(11)]. The $5,000.00 per day civil penalty shall be retroactive
following the date of this notice and cumulative until the violation(s) are remedied and found to be in compliance
[Raleigh Unified Development Ordinance, Section 9.4.11(A)].
COMMENTS:
1. Most of the listed Required Immediate Corrective Actions noted above were previously reported in the
NCDEMLR Sedimentation Inspection Report dated 4/24/2022 that was a result of a joint inspection
conducted by NCDEMLR and City of Raleigh staff.
2. Other items noted in the DEMLR report that are enforced under the NCG01 permit that have not been
addressed are as follows: (1) construction materials and debris are located closed to inlets, dispose of
trash and debris and relocate other construction materials and (2) NCG01 COC and inspection records
are not being maintained on-site.
3. If the ten (10) day timeframe required for compliance falls on a weekend/holiday or close to a rain
event please take photographs and provide to the inspector to document completion of required
immediate corrective actions. Although pictures may be accepted, it is the discretion of the inspector to
determine if the project is “In Compliance”.
