Both ponds were in excellent condition. We seeded both pond banks with a combination of w111ter rye and
un-hulled Bermuda. This seed is showing excellent emergence. The annual cutting and spraying of the
cattails in pond 2 was also undertaken at this time. Addt#ional rip -rap was added to both pond's intake
piping, additional rip -rap was also added to pond i °s outfall box. Depth plots are pictured on page 3.

received a permit transfer of ownership package on January 25, 1999, that included a signed Operation and
Maintenance plan for a curb outlet system. Beacon Woods was permitted with two detention ponds, so the
curb outlet O & M is not a valid document.
Please sign the two enclosed O & M's for the maintenance of the 2 ponds. Upon receipt of the
documents and pending a clean final inspection by DWQ, the permit will be reissued. If you have any

Dear Mr. Turner:
On January 20, 1998, the Division of Water Quality issued you a modification to your Certification
of Compliance for Beacon Woods Subdivision to allow the rerouting of the outlet from the pond in order to
alleviate an unpermitted offsite flow into the Crosswinds Pond. This work was supposedly completed in May.
To date, neither the PE Certification for the project, nor a copy of the recorded .deed restrictions has been
received, as required by the Certification of Compliance issued to you on April 25, 1995.
On August 12, 1998, the DWQ received a copy of a revised Erosion Control Plan from New Hanover
County for the addition of an open swale behind Lots 99 through 107 and a pipe between Lots 104 and 105.
Please be reminded that the subdivision was approved as a high density project due to the amount of built -
upon area, and as such all runoff from all impervious areas on the lot is required to be directed into the pond.
Please submit the PE Certification and recorded deed restrictions by October 1, 1998. Failure to
submit these items is considered a violation of your Certification, and is subject to enforcement action
pursuant to NCGS 143-215.6A through 6C. If you have any questions, please do not hesitate to call me at

authorizes the development of 20.49 acres of land at Beacon Woods
in New Hanover County. This permit issued on April 4, 1995
is subject to compliance with the application and site drawings, all applicable regulations and special conditions and
notes set forth below. Any plan modifications must be approved by this office prior to field changes.
It is understood by the applicant that a reprsentative of New Hanover County's Engineering Department may inspect the
the site at anytime following the issuance of this Permit. A copy of the approved Soil Erosion Plan and this permit
must be available at all times at the site.
Failure to execute the provisions of this permit and the approved Soil Erosion Plan, or any other provisions of the
New Hanover County Soil Erosion and Sedimentation Control Ordinance, shall result in immediate legal action by the
County to the limits prescribed by the Ordinance. If the measures outlined on the approved Soil Erosion Plan and this
Permit prove insufficient, additional Erosion Control measures can and will be required which in turn be considered
provisions of this permit. This Permit does not perclude any other permits or approvals necessary for beginning or
completing this development. It is the Permittee's responsibility to obtain all necessary permits and approvals.

On January 20, 1998, the Wilmington Regional Office approved your request to modify the outlet
piping from Detention Pond #2 in Beacon Woods Subdivision. On March 24, 1998, an inspection of the pond
by Regional Office staff and a representative of the Attorney General's Office was performed to determine
the status of the outlet pipe rerouting for the project. The inspection revealed that the rerouting of the outlet
piping has not yet been accomplished.
The modification to the outlet piping as approved by this Office on January 20, 1998, must be
completed immediately. If it is not completed within 30 days of receipt of this letter, we will ask the Attorney
General's Office to take the necessary legal action to compel you to make the required corrective actions.

On November 6, 1997, the Wilmington Regional Office received your request to redirect the outflow from
the currently certified Beacon Woods detention pond outlet structure. The overflow from the pond currently travels
in underground collection piping east down Beacon Drive and turns north down Chalice Lane, under Hidden Valley
Road and across the Roseman property into an undocumented ditch, thence into the Crosswinds detention pond. The
April 25, 1995 approved plans shows the overflow from Beacon Woods Pond 2 getting to Hidden Valley Road, then
turning east down Hidden Valley Road and into the DOT ditch on Masonboro Loop Road.
The project was not constructed as approved, and as a result of the flooding in the Crosswinds Pond, the outlet
structure piping to Hidden Valley Road is being plugged, the outlet structure relocated, and the runoff directed through
a proposed 3:1 ditch in a new 30' drainage easement located behind Vineyard Geen Subdivision. From there, the
runoff is piped around Vineyard Green's detention pond, and connects into the outlet piping from Vineyard Green's
detention pond, as shown on the December 9, 1997 approved rerouting plans. The remaining aspects of the April 25,
1995 approved plans are still valid for the Certification of Compliance. This revision does not allow any increases in
built -upon area from that currently approved.

is subject to compliance.with the application and site drawings, all applicable regulations and special conditions and
notes set forth below. Any plan modifications must be approved by this office prior to field changes.
It is understood by the applicant that a reprsentative of New Hanover County's Engineering Department may inspect the
the site at anytime following the issuance of this Permit. A copy of the approved Soil Erosion Plan and this permit
must be available at all times at the site.
Failure to execute the provisions of this permit and the approved Soil Erosion Plan, or any other provisions of the
New Hanover County Soil Erosion and Sedimentation Control Ordinance, shall result in immediate legal action by the
County to the limits prescribed by the Ordinance. If the measures outlined on the approved Soil Erosion Plan and this
Permit prove insufficient, additional Erosion Control measures can and will be required which in turn be considered
provisions of this permit. This Permit does not perclude any other permits or approvals necessary for beginning or
completing this development. It is the Permittee's responsibility to obtain all necessary permits and approvals.

We are writing in response to your March 2, 1998 Notice Of Recommendation for
Enforcement. Please accept the following inforniation as explanation of our actions.
In accordance with our original stormwa.ter permit, it was our intent to discharge
runoff from Beacon Woods detention pond No. 2 into the road ditch along the north side
of Hidden Valley Road. During construction of the pond outfall, we discuvexud the
direction of runoff in the road ditch flowed in a westerly direction. Our original outfall
was proposed in an easterly direction. Jnstallation of the outfall in the easterly directi-ii,
as originally proposed, appeared futile since the outflow would eventually reverse and
flow backs in a westerly direction_ To match field conditions, we installed the outfall to
discharge to the west since the outflow ultimately flowed in the same direction regardless
of the direction of the outfall installation.
Beginning in September of 1997, we were notified by developers of an adjacent

through their detention pond. They felt this would not be acceptable_ We immediately
began to address their concerns_ An alternate drainage route was proposed to direct
runoff tbrough an existing ditch along the soutli side of Roseman Trailer Park,
Developers of. bath Cross Winds and the Roseman Trailer Park and ourselves
tentatively agreed to a proposed re-route through an existing ditch along the south side of
the RiDsexuan Trailer Nark. However, investigation of existing ditches downstream of this
route indicated these channels would not satisfactorily aaccommodate the additional
flow, We eventually proposed re-routing our drainage *ow Beacon Woods detention
pond No. 2, to the south around Vineyard Greens, ;w adjacent

subdivision to our south, discharging into an existing ditch which ultimately outfalls to
the Cape Fear River. We, obtaixted adjacent easements and submitted revised plans to
your office in early November of 1997. These plans were approved by your office on
January 20, 1998.
We are now in the process of installing the approved, revised outfhll. Completion
is anticipated very soon with the provision of good weather.
We have been, continually working to alleviate the concerns of all parties since we
first became aware of this situation. Please consider our prompt actions and efforts in
your review.

Dear Mr. Turner:
On April 25, 1995, the Wilmington Regional Office issued a Certification of Compliance to you for Beacon
Woods Subdivision. Per the requirements of the Certification of Compliance, a copy of the recorded deed restrictions
must be forwarded within 30 days of the date of recording. A review of our files indicates that a copy of the recorded
deed restrictions have not been received by this Office.
Failure to record and/or provide a copy of the recorded deed restrictions is a violation of your Certification
of Compliance, and subject to enforcement action. Please forward a copy of the recorded deed restrictions to this
Office at the address below by January 10, 1998, or enforcement action may be initiated and may include
recommendations for civil and criminal penalties and revocation of the Certification of Compliance. The approval of
the currently submitted revision to reroute the pond outlet for Beacon Woods is on hold pending receipt of the deed
restrictions.
