Dear Mr. Stevens:
Please reference your Pre -Construction Notification Form (application) submitted
to our office via email on February 28, 2022, requesting the use of Nationwide Permit 39
for the Walkable Lifestyles project located at 3521 Battleground Avenue, in Greensboro,
Guilford County, North Carolina. By copy of the North Carolina Division of Water
Resources (NCDWR) correspondence, dated April 18, 2022 (enclosed), we have
learned that your request for a NCDWR 401 Water Quality Certification (DWR #
20220325) has been denied for this project. Therefore, under the administrative rules of
our regulatory program, we cannot give favorable consideration to issuance of
Department of the Army (DA) authorization. Accordingly, your request to verify the use
of Nationwide Permit 39 is hereby denied, without prejudice, and your file has been
retired.
Further consideration for DA authorization must await your re -application and
subsequent resolution with NCDWR concerning your 401 Water Quality Certification. In
addition to resolution of the above, please also reference our request for additional
information submitted to you via email on March 24, 2022 (enclosed), noting several
items that must be addressed in order to continue evaluation of your application. This
information is essential in our review of your permit proposal and should be included in
the resubmittal of your application.
