Enoch Engineers has completed the response to the request for more information letter from DWQ 401
Oversight/Express Review Permitting Unit dated June 20, 2007. The following responses were concluded
after the site meeting on April 5, 2007 with DWQ, US Army Corps of Engineers (USAGE), and Fuss &
O~teill.

Dear Ian:
o Quantify and indicate the impacts to wetlands/streams from all earlier phases of the subdivision
including earthen fill/culvert and road installation of Hallandale Road in Overhills Creek Section 4,
Part 4 and residential lot fill along approximately Lot 101 of Section 4, Part 5.
Response: Enoch Engineers is not aware of any earthen fill/ and road installation of Hallandale Road in
Overhills Creek Subdivision. Hallandale Road was established before Overhills Creek Subdivision began
construction. Enoch Engineers is aware of the wetland areas totaling 2.71 acres located approximately
north of Hallandale Road. It is understood that this wetland feature was restored previously from
impacts associated with the development of Overhills Creek Subdivision Section 5.
o Quantify and indicate the impacts to wetlands/streams from earthen fill, grading and grubbing in Lot
1 of Section 4 of Overhills Creek Subdivision.
Response: Impacts to Lot 1 of Overhills Creek Subdivision are limited only to Lot 1 and include 0.076
acres of impacted jurisdictional wetlands. The owner has been informed to remove any artificial drainage
(French drain) influencing the hydrology of the existing wetland feature. Upon removal of the french
drain, it is requested that the impacted wetland feature be returned to a natural grade and restored with a
wetland seed mix to establish wetland vegetation growth.
o Quantify and indicate the impacts to weflands/streams from earth fill, culvert and road installation,
and installation of the sediment basins at the crossing at Pender Road South along Lots 377 and 378.
Response: Impacts to this wetland feature are currently under review by the USAGE and DWQ. An
After-the-fact NWP 14, with Special Conditions has been issued to the owner. The Special Conditions of

the permit indicate that all unauthorized activities located within Overhills Creek Subdivision must be
resolved no later than October 15+~ 2007. The impacts resulting from unauthorized activities are
recognized as: (1) unauthorized culvert installation in wetlands, (2) unauthorized riprap dissipater pads
installation in wetlands, and (3) portion of gravel check dam installed in wetlands (Attachments). In
addition, an impact by sedimentation (4) consists of variable depths of sediment located approximately
100 feet down slope of impacts. Impacts (1), (2), and (3) have been included in the nationwide
permitting package and total an impact area of 0.083 acres. Impact (3) has been requested by Enoch
Engineers for the owner to be removed from the adjacent wetland features. Impact (4) has been
requested by Enoch Engineers for the owner to remove any sediment down slope of the impacts.
o Quantify and indicate the impacts to wetlands/streams from earthen fill and road installation of
Caldwell Street in Overhills Creek Section 7 -Part 1 along the area from Lots 598, 501, and 502.
Response: Impacts to this wetland feature are currently in review by the USACE and DWQ. An after-
the-fact NWP 14, with Special Conditions has been issued to the owner. These impacts are recognized as
(1) unauthorized earthen fill in wetlands and (2) unauthorized culvert installation in wetlands
(Attachments). Impacts (1) and (2) total an area of 0.054 acres with sedimentation approximately 800
feet down slope.
o Quantify and indicate the impacts to wetlands at sediment basin off of Yancey Court
Response: Enoch Engineers has requested the owner to remove any portion of the sediment basin
from the wetland feature. After the sediment basin is removed, a general restoration plan may be
implemented to protect and restore the impacted portion of this particular wetland system.
o Quantify and indicate the impacts to wetianas at me basin aiong Lots 50G and 501 including fine aam
and the south side of the basin.
Response: Enoch Engineers designed a sediment basin to serve as a catchment for water quality
purposes at that particular watershed. The sediment basin was placed between two wetland seeps based
on previous wetland delineations by a third party. Impacts to the south side of the basin consist of (1)
installation of a sewer line utility in wetlands (Attachments) and (2) sedimentation approximately 400 feet
down slope. Impact (1) totals an area of 0.031 acres.
o Quantify and indicate the impacts to wetlands/streams from utility line installations including sewer
lines.
Response: See Response immediately above. Sewer line corridor is adjacent to the southern portion of
the sediment basin.
o Quantify and indicate the impacts to isolated wetlands from earthen fill and road installation of W.
Iredell Street.
Response: Enoch Engineers is not aware of any impacts to isolated wetland features of W. Iredell
Street. Previous visits by USACE and DWQ indicate that there is an isolated wetland feature on Swain
Street (Attachments). Enoch Engineers used professional judgment to simulate approximately where this
isolated wetland is located. The total impact acreage is 0.049 acres from earthen fill. Enoch Engineers is
currently in the process of filling an isolated wetland permit package to DWQ.
o Quantify and indicate all waters/streams/wetlands/isolated wetlands on the site, including the
impacted areas and any proposed areas to be impacted. Include the isolated wetland located on lots
573 and 572.

Response: See Response immediately above for isolated wetland impacts. An additional isolated
wetland was located on Lot 573 from previous DWQ site visits. Enoch Engineers located and flagged
this isolated feature and determined it was located exclusively on Lot 573 and has a total area of 0.020
acres.
o All lots 2vhere u~aterr/streams/tvetlandr are indicated must have a deed natafication. This can be provided up
front, or required as a condition of the 401 permit.
Response: The owner wishes that conditions be included in the 401 permit indicating deed notification
for lots containing waters/streams/wetlands
o Numerous sedimentation impacts noted during the Apri15~ 2007 site visit must be restored.
Response: Enoch Engineers has recommended the owner to remove and restore any sedimentation
from impacts near wetlands or streams in Overhills Creek Subdivision.
