This meeting will occur in the Ground Floor Hearing Room of the Archdale Building at 512 N. Salisbury
St, Raleigh, NC. Commissioners, staff, and scheduled speakers will attend in-person. Limited seating will
be available to the public. Face coverings are optional for employees and visitors. Meeting audio and

I. Preliminary Matters
1. Call to Order and Notice of NCGS 138A- 15………………… Chair Deerhake
North Carolina General Statute 138A-15 mandates that at the beginning of any meeting
of a board, the chair shall remind all members of their duty to avoid conflicts of interest
under this Subchapter. The chair also shall inquire as to whether there is any known
conflict of interest with respect to any matters coming before the board at the time.

II. Action Item
1. Request Approval to Proceed to the EMC with the 2022 Yadkin Pee-Dee River
Basin Resources Plan (Virginia Baker, Division of Water Resources – Basin
Planning Branch)
Staff will update the WQC on the completion of the 2022 Yadkin-Pee Dee River Basin
Water Resources Plan and introduce recommendations for this river basin.

2. Request Approval to Proceed to the EMC with Proposed Reclassification of Teer
Quarry and a Section of the Eno River to WS-IV Critical Area (CA) (Neuse River

Basin) (Elizabeth Kountis, Division of Water Resources – Classifications, Standards,
and Rules Review Branch)
The City of Durham has requested the reclassification of Teer Quarry and a section of the
Eno River in Durham County (Neuse River Basin). In order to allow for the construction
of a new public water supply riverine intake, a portion of the Eno River is to be
reclassified from Class IV (Protected Area or PA) to Class WS-IV CA. The quarry is to
receive water from the proposed Eno River intake, and is to be reclassified from WS-IV
(PA) to WS-IV CA. This proposal is necessary as the City of Durham plans on using
water in the quarry as a raw public water supply to aid in meeting local water demands.
The waters in the quarry and at the proposed intake location meet the existing state
surface water quality standards for the proposed reclassification according to 2021 DWR
studies. The WQC will be asked to approve this reclassification request in order for staff
to proceed to the full Environmental Management Commission (EMC), at which
approval of the fiscal analysis and permission to send the proposed reclassification to
public notice will be sought.

3. Request Approval to Proceed to the EMC with Revised Neuse and Tar-Pamlico
New Development Stormwater Local Programs (Trish D’Arconte, Division of Water
Resources – NonPoint Source Branch)
The amended Neuse and Tar-Pamlico New Development Stormwater rules (15A NCAC
2B .0711 and .0731 respectively), effective April 1, 2020, stagger program approval
timeframes for local governments subject to the original rules and those newly subject,
with original communities seeking approval first. There are 23 local programs under the
original Rules. For the May Committee meeting, DWR staff recommend approval of 12
revised local programs. Staff expect to bring the remaining revised local programs, as
well as proposed programs for newly subject communities, to subsequent Committee
meetings. DWR requests that the WQC approve the request to take the first set of local
programs implementing amended Neuse and Tar-Pamlico Stormwater Rules to the EMC
for approval.

III. Information Items
1. NCDEQ’s Estimated Timeline for Development of a Statewide Recreational Standard for Escherichia coli (E. Coli) in Primary Recreation (Class B) Waters
(Christopher Ventaloro, Division of Water Resources – Classifications, Standards, and Rules Review Branch)
Staff will provide an estimated timeline for the development of a statewide recreational standard that uses E. coli as the pathogenic indicator of fecal contamination in primary
recreation (Class B) waters in NC. The different steps of this timeline will be discussed,
and tentative dates of completion will be provided.

2. 2022 North Carolina Water Quality Assessment and 303(d) List Update and
Prioritizing Waters for Restoration (Cam McNutt, Division of Water Resources
- Modeling Branch)
Staff will provide a brief overview of the results of the 2022 statewide water quality
assessment and 303(d) list that was submitted to EPA on April 1st, 2022. This will
include a review of comments received and potential issues to address in the 2024 EMC
303(d) Listing and Delisting methodology. Staff will also provide an overview of the
restoration prioritization process and development of restoration plans.
