CONCURRENCE AS OPPOSED TO JD REQUEST. PJD IS GOOD AT YOUR DISCRETION
2. Avoidance and minimization, why does Impact # 2 need to occur? It appears that the fill is only for the
building of an additional 2 lots, if the builder were to nix those 2 lots then then impacts to the aquatic
resources could be lessened. Avoidance is not demonstrated. EXTENSIVE EFFORTS AT AVOIDANCE AND
MINIMIZATION HAVE BEEN MADE TOWARD THIS PROJECT. PLEASE FIND ATTACHED THE INITIAL,
LOCALLY APPROVED PLANS WHICH DEMONSTRATE A SIGNIFICANT REDUCTION IN PROPOSED IMPACTS
FOR THE PROJECT, PARTICULARLY TO TRIBUTARIES, AS INITIALLY PROVIDED FOR
SUBMITTAL. ALTHOUGH MINOR REDUCTIONS HAVE BEEN MADE ON THE WETLAND IMPACT (REDUCED
BY 0.012 AC), INITIALLY, 498 LF OF TRIBUTARY PIPING WAS PROPOSED AND ALL WETLANDS WERE
REQUESTED TO BE FILLED. THE IMPACTED WETLANDS ARE NOT FORESTED, HAVE BEEN HEAVILY
MANIPULATED IN THE PAST, ARE INFLUENCED BY THE EXISTING CULVERTED DRIVE AT THE PROPERTY
LINE, AND INCLUDE INVASIVE SPECIES. IMPACTS TO AQUATIC RESOURCES ARE ASSESSED TO BE
MINIMAL BASED ON THE AVOIDANCE AND MINIMIZATION EFFORTS, SITE REDESIGN, TOPOGRAPHIC

CONSTRAINTS FOR BUILDING FOOTPRINTS, AND BASED ON THE LOW QUALITY OF THE AQUATIC
RESOURCES TO BE IMPACTED. AFFORDABLE HOUSING IS IN SHORT SUPPLY FOR THIS REGION. THE
IMPACTS ARE ASSESSED TO BE THE MINIMAL AMOUNT NECESSARY TO PROVIDE FOR THE NEEDED UNIT
YIELD BASED ON SITE GRADING REQUIREMENTS AND IN ORDER TO MAINTAIN A MORE AFFORDABLE
PRODUCT FOR THE END USER/BUYER.
3. Why is the Rip -rap going to be a permanent impact? Embedding Rip -rap at level/at-grade would further
reduce stream impacts by 15 LF, is there a particular reason why this would not happen for this
project? THE RIP -RAP CAN BE EMBEDDED AT LEVEL GRADE IN ORDER TO FURTHER REDUCE THE
TRIBUTARY IMPACTS.
4. You have indicated that there is no critical habitat for any ESA, the standard ROW, was there any
pedestrian surveys completed for Schweinitz's (please submit with the PCN, or updates) THE ATTACHED
NHP REPORT DOES NOT INDICATE THAT CRITICAL HABITAT FOR THE SUNFLOWER IS LOCATED ON OR
WITHIN 1 MILE OF THE PROPERTY. ADDITIONALLY, NO KNOWN OCCURRENCES OF THE SUNFLOWER
WERE LISTED WITHIN 1 MILE OF THE PROJECT AREA. AS DEPICTED IN THE PHOTOS ATTACHED TO THE
ORIGINAL PNC, THE POWER LINE ROW IS NOT REGULARLY MAINTAINED AND IS DOMINATED BY DENSE
POPULATIONS OF INVASIVE SPECIES INCLUDING PRIVET, OLIVE SPP. AND KUDZU. THESE CONDITIONS
DO NOT PROVIDE SUITABLE HABITAT FOR SCHWEINITZ'S SUNFLOWER.
5. The Agent Authorization Letter is missing, please submit. THE APPLICANT SIGNED THE PCN FORM (NOT
SIGNED BY W&WAS AGENT; NOT SURE IF IT MAKES A DIFFERENCE, BUT WE INTENDED TO SUBMIT AS

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database indicates that
there are no records for rare species, important natural communities, natural areas, and/or
conservation/managed areas within the proposed project boundary. Please note that although there
may be no documentation of natural heritage elements within the project boundary, it does not
imply or confirm their absence; the area may not have been surveyed. The results of this query
should not be substituted for field surveys where suitable habitat exists. In the event that rare
species are found within the project area, please contact the NCNHP so that we may update our
records.
The attached 'Potential Occurrences' table summarizes rare species and natural communities that
have been documented within a one-mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one-mile
radius of the project area, if any, are also included in this report.
If a Federally-listed species is found within the project area or is indicated within a one-mile radius of
the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for
guidance. Contact information for USFWS offices in North Carolina is found here:

Please note that natural heritage element data are maintained for the purposes of conservation
planning, project review, and scientific research, and are not intended for use as the primary criteria
