Lee Energy Complex Goldsboro, NC 1.0 INTRODUCTION On August 24 and 25, 2021, Walter Gerald (NC L.G. #0446) of SynTerra inspected the H.F. Lee Energy Complex (H.F. Lee or Site) property for existing and potential new seeps. General observations include: • Previously unidentified seeps were not observed during the inspection. • Notable changes to seeps were not observed during the inspection. Observations are consistent with past inspections. • Seeps eliminated by decanting of the Active Ash Basin are consistent with past observations. • The decanting target for the Active Ash Basin was reached in November 2018. • Dewatering of the Active Ash Basin began in July 2019 and is ongoing. • Removal of ash from the Active Ash Basin began in September 2020 and is ongoing. Inspection activities were performed in accordance with North Carolina Environmental Management Commission (EMC) Special Order by Consent (SOC) WQ#S18-006. The SOC describes inspection requirements as follows: Duke Energy shall conduct annual comprehensive surveys of areas down gradient of the ash basins, the Lay of Land Area (LOLA) and the cooling pond, identifying new seeps, and documenting the physical characteristics of previously documented seeps. All examinations of seeps must include identification of seeps by approximate latitude and longitude and date-stamped digital photographs of their appearance. A report summarizing the findings of the surveys, including a section analyzing the effect decanting of the basin(s) has on seep flows, accompanied by copies of the photographs noted above ("Annual Seep Report"), shall be submitted to DWR in conjunction with submittal of the April 30 quarterly report noted in 2(b)(3) above. This Annual Seep Report must list any seep that has been dispositioned (as described below) during the previous year, including an analysis of the manner of disposition. Each location documented as a seep at issuance of the SOC, as listed in Table 1, was observed and documented with photographs during the inspection. The weather was clear to partly cloudy before and during the inspection. Temperatures ranged from approximately 75 to 90 degrees Fahrenheit. No rain was recorded at the on-Site weather station over the period of August 21 to August 25, 2021, including the two days of seep inspections. Lee Energy Complex Goldsboro, NC Mr. Gerald reviewed previous seep inspection reports and the weekly dam safety inspection reports for the Site's four ash basins: • Active Ash Basin (AAB) • Inactive Ash Basin 1 (IAB1) • Inactive Ash Basin 2 (IAB2) • Inactive Ash Basin 3 (IAB3) Sharat Gollamudi (Duke Energy system owner) conducted the ash basin dam safety inspections and prepared those reports. Observations from the dam safety inspection reports were consistent with observations made during the seep inspection. The inspection included observations in the following areas (Figure 1): • Along the shore of the Neuse River and Halfmile Branch • Areas along and downgradient of the ash basin dams • Drainage features associated with the ash basins Seep locations and inspection areas are shown on Figure 1. Observations noted during the inspection are summarized on Table 1. Representative photographs taken of each seep location during the inspection are included in Appendix A. Lee Energy Complex Goldsboro, NC 2.0 FINDINGS 2.1 General Observations Inspection observations for each seep are described in Table 1. The following general observations were noted during the inspection: • New seeps were not observed during the inspection. • Dewatering equipment/piping was observed at the edge of the Neuse River on the southwest side of the AAB. • The United States Geological Survey (USGS) gage station (02089000) located approximately 10 miles downstream reported the Neuse River ranged from approximately 5.2 feet to 4.8 feet and was falling over the two days of inspection. • Several seeps previously determined to be below the ordinary high water mark were observed along the AAB and cooling pond areas due to low river levels. 2.2 Effects of Decanting Decanting of the AAB at H.F. Lee commenced in April 2016 and was completed in November 2018. Dewatering of ash pore water began July 2019 in the AAB and is ongoing. Decanting of the AAB has reduced seep flow to the perimeter ditch in areas north, east, and west of the AAB. North of the AAB, no flow was observed at S-01 and S-06. Seeps S-27 and S-28 exhibited reduced flow compared to previous observations. East of the AAB, no flow was observed at 5-07, and 5-08 exhibited reduced flow compared to past inspections. West of the AAB, no flow was observed at S-02. Decanting of the AAB does not appear to have reduced seep flow in areas south of the AAB (5-22, S-23, S-24, S-25, and S-26). 2.3 Changes to Seep Status Mr. Gerald inspected each seep to evaluate whether it met requirements to be dispositioned in accordance with the SOC.The requirements for dispositioning a seep are as follows: For purposes of this Special Order, "dispositioned"includes the following: (1) the seep is dry for at least three consecutive quarters;(2)the seep does not constitute, and does not flow to, waters of the State or Waters of the United States for three consecutive quarters;(3) the seep is no longer impacted by flow from any coal ash basin as determined by the Director of DWR in accord with applicable law and best professional judgment; or (4) the seep has been otherwise eliminated (e.g., through an engineering solution). If a seep that has been dispositioned through drying up reappears in any subsequent survey, such a seep will no longer be deemed dispositioned and can be subsequently re-dispositioned as specified above. Lee Energy Complex Goldsboro, NC Seeps LOLA S-01, S-01, S-02, S-04, S-06, and S-07 have been observed as dry or not flowing to Waters of the State or Waters of the United States for more than three consecutive quarters. Those seeps were proposed for dispositioning in the 2021 Final Seep Report(SynTerra, 2021), and Duke Energy has requested that the North Carolina Department of Environmental Quality (NCDEQ) review and certify that they be dispositioned in accordance with the terms of the SOC.
