Hi Amy,
Mr. Tabor contacted me last week to arrange a meeting with him on his property. He was
concerned about his pond, the spillway and thinks that DOT is at fault for causing pond water
quality/quantity problems. We met with him and his son yesterday. Amy Euliss attended too,
as requested by Pat Ivey. This section of the beltway was completed about two years ago. In
summary, his pond looked to be in good shape. We observed several fish (bass and bluegill)
swimming about. Water was clear, no turbidity. There was some iron oxide bacteria and small
amounts of algae along the downwind edges. However, the spillway has developed a
significant erosional feature approximately 15' deep by 25' wide by 50' long with steep eroded
banks on both sides. Mr. Tabor indicated that DEMLR visited at some point in the past but he
did not elaborate.
Basically, we explained to Mr. Tabor that DOT was in compliance with all their beltway related
permits and there was nothing further we could do. He requested that DWR require DOT to
clean -out his pond. I said we would not.
