Be advised that no modification is required. The second paragraph of the approval letter states, “this approval is valid for the purpose and design described in your application.” There was no “additional” condition included that would negate this statement regarding this condition of the general certification. A few weeks ago, we briefly discussed a Water Quality Certification 3886 requirement for the Haydock to Junker (P-5208ACGI) project (NCDWQ Project Number 13-0485). This conditions applies to the drainage of stormwater from bridges directly into streams below and affects two proposed project bridges. In researching this condition, the Rail Division believes this condition was designed for application to roadway bridges, and due to the differing natures and use of railroads and roadways, this condition should not be applicable to the rail. Therefore, the NCDOT Rail Division is respectfully requesting that they be released from this permit condition, and has prepared the attached letter in support of this request. Also attached are Material Safety Data Sheets [MSDS, for the locomotive brake shoes (V330) and rail car brake pads (V2661 and V2662)] in support of this document. We are also 1 placing a hard copy of the attached letter and MSDS in the mail to you tomorrow. If you have any questions at all or would like to discuss any items, please let us know.
