NORTH CAROLINA Director Environmental Quality March 24, 2022 CERTIFIED MAIL RETURN RECEIPT REQUESTED 7020 0090 0001 7206 2604 Craven Register 1040 Williamson Rd Clinton, North Carolina 28328 Subject: NOTICE OF VIOLATION/NOTICE OF INTENT Administrative Code 15A NCAC 2T .1304 Register Farm, Permit No. AWS820213 NOV-2022-PC-0134 Sampson County Dear Craven Register: On March 9, 2022 staff of NC Department of Environmental Quality (DEQ) Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS) noticed what appeared to be non -compliant sludge application. We wish to thank Mr. Craven Register and Carlton Register for their cooperation and assistance in this inspection. As a result of this notification, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1304, you have been found to be in violation of your permit as follows: ODE Department of Environmental Ouallty si North Carolina Department of Environmental Quality Division of Water Resources 512 North Salisbury Street 1611 Mail Service Center Raleigh, North Carolina 27699-1611 919.707.9000 Craven Register March 24, 2022 Page 2 Violation 1: At the time of sludge removal from a lagoon/storage pond, the sludge must be managed in accordance with the CAWMP. When removal of sludge from the lagoon is necessary, provisions must be taken to prevent damage to the lagoon dikes and liner —[15A NCAC 02T.1304(b)] (Permit No.100000 Section II 13). On March 9, 2022 DWR, staff drove past your farm on Hwy. 421 and observed what appeared to be non- compliant sludge application. DWR staff documented that sludge was applied within 200 feet of multiple residence not owned by you. In addition, sludge was applied with in twenty-five (25) feet of a well, in the public ROW and up to a property line. These documented application events were not done in accordance with your sludge WUP. It was stated that this was the first time your farm had applied sludge from your lagoon and that you failed to read the detailed setbacks stated in your Waste Utilization Plan (WUP). Required Corrective Action for Violation 1: In the future, apply sludge from your lagoon as stated in your sludge WUP and in your liquid waste from your lagoon as stated in your WUP for your permitted site. The WUP specifies that corn will be planted in these fields, this should be done within thirty (30) days after the application of this sludge. The Division of Water Resources requests that, in addition to the specified corrective action above, please submit the following items on or before 30 days from receipt of this letter: 1. An explanation from the OIC for this farm regarding why this violation occurred. 2. A list from the OIC concerning the steps that will be taken to prevent these violations from occurring in the future. 3 Provide DWR a copy of the completed sludge application records for this WUP, with a copy of the waste analysis. 4 you can send any correspondence by mail to the address on the bottom of page 1 or by email to steve.guyton@ncdenr.gov. Please note that assessment of civil penalties may have already, been recommended for violations described within this Notice of Violation. Failure to comply with the State's rules, in the manner and time specified, may result in the assessment of additional civil penalties and/or the use of other enforcement mechanisms available to the State.
