Due to funding issues the LET for this project was delayed to September 2022.There have been no changes to this project design since the original submittal. Habitat for Wood stork (Mycteria americana)is present within the project study area per the Natural Resource Technical Report (NRTR)dated June 2016.and no birds or nest were observed at that time.The study area will be resurveyed this year between April 15 and July 15. It is anticipated that a MANLAA determination in accordance with the U.S. Fish and Wildlife Service programmatic biological evaluation(PBE)for the wood stork(Mycteria americana)for certain transportation projects in Divisions 1-8 with a federal nexus will apply to this project.The NLEB PBO will also be applicable to this project. By submittal of this request,the Department is requesting approval to proceed with construction of this project under the conditions of the 2022 Nationwide 3 Permit and corresponding GC 4239.
