Dear Secretary Boyette,
The Division of Energy, Mineral and Land Resources (DEMLR) received NCDOT comments on the subject
permit on April 12, 2022. The draft permit was public noticed in the North Carolina State Register on
March 15, 2022 with intent to issue a National Pollutant Discharge Elimination System (NPDES)
Municipal Separate Storm Sewer System (MS4) permit. NCDOT's comments were the only public
comments received for the noticed draft permit. As such, DEMLR has finalized the permit and is
providing the attached:

0 Response to public comments.
The new permit is effective for the period from May 1, 2022 through April 30, 2027. The issuance of this
final permit concludes all required actions under Notice of Compliance number NOC-2020-PC-0206, and
this action has been officially closed.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable, the Permittee has the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such
demand is made, this decision shall be final and binding.
